An ordinance amending Chapter 60 ofthe Saint Paul Legislative Code pertaining to zoning for the City of
Saint Paul and the zoning maps thereo£
WHEREAS, Pursuant to Minnesota Statutes {462357 and 64.400 of the Legislative Code, Pat Carney and
Jules Inda duly petitioned to rezone properiy at 1956 Feronia Avenue being legally described as (see file), from
RM-2 (multifamily) to OS-1 (office service) to allow mixed use residential and office services, the petition
having been certified by the Planning Division on 12/8/99 as having been consented to by at least 67% of the
owners of the area of the property to be rezoned, and further having been consented to by at least two-thirds
of the owners of the property situated within 100 feet of the total contiguous property within one year
proceeding the date of the petition; and
WI3EREAS, The Zoning Committee of the Planning Commission on O1/06/00, held a public hearing for the
purpose of considering the rezoning petition, and pursuant to { 107.03 of the Administrative Code, submitted
its recommendation to the Planning Commission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning petition at its meeting held on O1/14/00 and
recommended that the City Council approve the petition; and
WHEREAS, notice of public hearing before the City Council on the said rezoning petition was duly published
in the official newspaper of the City on O1/15/00 and notices were duly mailed to each owner of affected
property and property situated wholly or partly witlun 350 feet of the property sought to be rezoned; and
WHEREAS, a public hearing before the City Council hauing been conducted on O1/26/00, where all interested
parties were heard, the Council having considered all the facts and recommendations concerning the petition;
now, therefore
THE COUNCIL OF TI� CTTY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul, Sheet Number 17, as incorporated by reference in {60301 of
the Saint Paul Legislative Code, as amended, is hereby fixrther amended as follows:

WHEREAS, Pat Carney and Jules Inda (File 99-178-a60) have annlied to rezone
property at 1956 Feronia Avenue, legally described as (see =i1e), from RM-2
(residential multiple-family) to OS-1 (office service) to allow a mixed office
residential use; and
WHEREAS, the Zoning Committee of the Planning Commission on O1/06/00 held a
public hearing at which a11 persons present were given an opportunity to be
heard pursuant to said application in accordance with the requirements of
Section 64.300 of the Saint Pau1 Legislative Code; and
WHEREAS, Saint Paul. Planning Commission, based on the evidence presented to
its Zoning Committee at the public hearing as substantially reflected in the
minutes, made the following findings of fact:
1. The applicants have an option to purchase the property and are
proposing to convert this vacant 21 unit apartment complex into a mixed
� office residential use. Estimated acquisiCion and rehabilitation costs
are $1,000,000. The applicants are proposing to use the basement and
first floor for their design studio business. The second floor would be
commercial office space and the applicants would live on the third
floor. The applicant's design business currently has twelve employees
and their office hours would be Monday through Friday from 8:00 a.m. to
5:00 p.m.
2. Section 60.512(7)(a) identifies the following condition for mixing
residential and office uses in an OS-1 district. "Residential uses are
limited to not more than fifty (50) percent of the basement and first
floor. The entire upper floors may be used for residential use. At least
fifty (50) percent of the basement and first floor shall be devoted to a
principal use permitted in this district, except residential use." This
condition is met. The basement, first and second floors will be occupied
by a permitted office use. The third floor will have one residential
unit.

City Land Use Plan (5.2.1) states, "In traditional neighborhoods, the
City will support compatible mixed use within single buildings and in
separate buildings in close proximity." p. 27.
4. The rezoning is compatible with the way the area has developed and
will not have an adverse impact. Across St. Anthony Street to the south
are railroad tracks and Interstate 9?. To the north, across Feronia
Avenue, are auto repair uses in an I-1 and P-1 districts. To the east,
abutting the property, are two duplex structures in an Ri�I-2 district. To
the west, across Prior Avenue, ase industrial warehouses ir_ an I-1
district. This portion of Prior Avenue carries approximately 6,425
vehicles a day. The proposed mixed office residential use wi11 reguire
27 off street parking spaces. A preliminary site plan shows 15 off
street parking spaces. A parking variance will be required.
5. The applicant submitted a sufficient petition of two-thirds of the
property owners within one hundred (100) feet of the property stating
support for the rezoning (13 parcels eligible, 9 parcels required, and
10 parcels signed).
Therefore, Be It Resolved, based on findings 1 through 5 the Planning
Commission recommends to the Saint Paul City Council approval of the
application to rezone property at 1956 Feronia Avenue from RM-2 to OS-1.

for the building at 1956 Feronia. Thank you so much for your encouragement. I am
writing to introduce us, apprise you of our situation, and, perhaps, to ask for your
assistance.
My wife, Julie Inda and I are graphic design professionals. We are involved in our
professionai and neighborhood community. Julie is the Creative director of Walman

of Pat Carney Studio, Inc., a graphic design firm presently housed in the Minneapolis
Warehouse District.
We are interested in purchasing the building at the corner of Feronia and Prior in
the Merriam Park neighborhood, 1956 Feronia. Our ptan is to convert the first floor
� and the basement into Pat Carney Studio. The second floor would be commercial
rental space, hopefully for a business symbiotic with the studio.
Julie and I would make our home on the third floor.

The building is a bit of a mystery. We think it was used as a Victorian era railroad
depot, but we are not sure of the architectural origins of the structure. It is a
rounded wedge shaped building vaguely reminiscent of New York's Flatiron
Bui(ding. The two walis forming the rounded point are made up of twelve arches on
each of the three fioors. The effect is stunning. I am looking forward to discovering
more about the origins of this truly unique building and preserving iu grandeur.
Thus far the plan is moving ahead as smoothly as one might expect. We have
contacted the lris Pask Bfock Club, the Merriam Park Community Council, Nancy
Homans concerning zoning and Theresa Laws from Economic Development. We are
now interviewing banks, architects and contractors. I am including photos of the
building as it is now, some PhotoShop-altered photos of what we hope it will look
like and some sketchy floor plans.
I know you are interested in jobs and the revitalization of the St. Paul's
neighborhoods. What we have here is an opportunity to accomplish both at one
time. 1956 Feronia is a derelict buiiding last used as a crack house and closed by the
St. Paul Pofice Deparcment. You can see by the photos the building is in need of
some loving care.
Pat Carney Studio is a growing firm with twelve employees at the present time and
every intention to be twice this size. Our client list is a who's-who of the Twin Cities
finest businesses incfuding Target, Daytons, Generaf M'rlfs, and Hazelden'Sreatment
Center. We have been in business for fifteen years and in the same building in the
Minneapolis Warehouse District for ten years. i have enclosed our mini-portfolio. We

Our challenges are:
Financing
eanks want a commitment from the city before they are willing to commit.
The building is in such disrepair, banks fear the cost of rehabilitation will
exceed the value of the building upon completion. '
Zoning
The building needs to be rezoned for our plan to be a reality. The process
typicalty takes 90 days and can't begin until the financing is in place. Our
purchase agreement gives us until January 28 to meet our contingencies,
zoning being one. Is there some way to expedite the rezoning or guarantee
the rezoning before we purchase the building?
Variances
We may need a waiver on the number of parking spots per the square
footage of the building. We are a low traffic business, and we are sure we
can accommodate the employee and visitor parking. However, St. PauV codes
may require more space than is available.
Finally, a paragraph or two about the neighborhood and their enthusiasm. Every
effort to revitalize a neighborhoad is a risky endeavor. Tfie lynchpin of success is the
evolvement of the neighbors.
The Merriam Park neighborhood has embraced our efforts in a most friendly and
energetic way. They have made it clear to us they want us to succeed and will do
whatever asked to see that we succeed.
� When we needed to hunt down the owners of the properties near the Feronia
building the (ris Park Block �lub volunteered to secure the signatures we needed. it
happened without our involvement.
We are regular attendees at their meetings. They have made it ciear they are ready
to help with anything else we need to make this a reality. Julie and I and Pat Carney
Studio, Inc. are willing to work towards this goal and to commit the resources we
have to this end. With the help of the neighborhood, the Iris Park Block Club, The
Merriam Park Community Council and your help we are sure we can accomplish this.
