Notwithstanding any other provision of ordinance or resolution to the contrary, each managed competition cof�tract to which the City of Saint Paul is a pariy sha11 first be expressly authorized by the council by resolution, and executed by the mayor, city clerk and director of the office of financial services or designee. The term "managed competition contract" shall mean any contract for labor or personal services to be performed by persons who are not City employees for work that is either (i) seasonal ar temporary and has been performed by City employees within the past five years, or (ii) within the scope of any job rifle, position or classification in the classified service of the City. Such term shall also include any contract for labor or personal sezvices to be performed by City empioyees after such City employees have been eapressly or impliedly directed (A) to bid, prepare bids or compete against non-City parties for such labor or services, ar(B) to participate in, or be bound by, such bids, competition or any contract resulting therefrom. 25 (b) Disclosure. Each party to a managed competition contract shall disclose all 26 contributions to any candidate for mavor or council in the Cit�of Saint Pau1 p�ie-�ee which 27 were made or given by such pariy during the five-year period immediately preceding the 28 submission of such contract to the council for authorization. The term "contribution" sha11 be as 29 defined in Minn. Stat. § 211AA1 (1998). The term "pariy" as used in this subsection shall 30 include natural persons as well as firms, corporations, partnerships or other associations or 31 entities, and the officers, directors, shareholders, partners and principals of such firms, 32 corporations, partnership or other associations ar entities. The terms "shazeholders," "partners" 33 and ^principals" sha11 apply only to those who control, hold or own at least a 5% equity or other 34 ownership shaze in the firm, corporation, partnership or other association ar entity which is the 35 non-City party to such contract. Such disclosure shall contain the name of the candidate, the date 36 and amount of the contribution, and if the contribution was non-monetary, a description of the 37 contribution and its estimated market value.
