14 (a) The fee required for a license defined under this chapter shall be established by ordinance as provided °ui section
15 310.09(b) of the Legislative Code.

17 (b) The billable transaction fee shall reflect the cost of processing transac6ons as determined by the director of the
18 Office of License, Inspections and Environmental Protection (hereafter, in this chapter, "LIEP director") and the
19 chief of police (hereafter, in this chapter, "chief') ar their designees. These fees shali be established by ordinance as
20provided in section 310.09(b) of tfie Legislative Code. The billable transacfion fee shall be required of all licensees
21 as defined under this chapter except:

If a licensee is unabie to saccessfully transfer the required reports via modem, the licensee must provide the
police department printed copies of all reportable transactions along with the videotape(s) for that date, by
twelve o'clock noon (12:00) the next business day, and must be chazged for billable transactions at a rate to
be determined by the automated pawn system (hereafter, in this chapter °'APS") for manual processing.
If the problem is deterxnined to be in the licensee°s system and is not corrected by the close of the first
business day following the failure, the licensee must provide the required reports as detailed 'm section
344.04(a), and may do so for up to ten (10) consecutive days without penalty. However, after the tenth day,
if the licensee still cannot report via modem, the licensee may, at the discretion of the LIEP director and the
chief, be fined one hundred dollars ($100.00) per day not to exceed twenty (20) days. If the licensee cannot
report via modem after thirty (30) days from the first date of failure, the license may be revoked.
35 (3) If the problem is deternuned to be outside the licensee°s system, the licensee must provide the required
36 reports as detailed in section 344.04(a), and will be charged for billable transactions until the error is
37 corrected. If the regulatory agency is unable to collect the required data via modem, no additional chazges
1 � will be assessed against the pawnbroker.

3(4) The licensee who has consistently reported via modem, and is unable to capture, digitize, or transxnit the
4 photographs as required under section 344.04(a), must immediately take all required photographs with a still
5 camen, immediately develop the pictures, cross reference the photographs to the conect transacrion, and
6 deliver them to the police department by twelve o'clock noon (12:00) on the next business day. Such failures
7 shall follow the same time lines and presume the same penalries as idenfified in section 344.02(b)(2),
9(5) The LIEP director, in conjuncrion with the chief, upon presentarion of extenuating circumstances, may
10 extend the grace period for a qualifying licensee beyond ten (10) days or may extend the penalty beyond
11 twenty (20) days, notwithstanding other provisions as outlined in section 344.02.

13 (c) Licensees shall be notified in writing at least thirty (30) days before any fee adjustment is implemented. Billable
14transaction fees shall be billed monthly and are due and payable within thirty (30) days. Failure to do so is a
I S violation of this chapter and may result in the following actions:

Fees due past thirty (30) days may result in up to a two-hundred-fifly-dollar fine.
Fees due past sixty (60) days may result in up to a five-hundred-dollaz fine.
Fees due past ninety (90) days may result in a license suspension.
Fees due past one-hundred twenty (120) days may result in a license revocation.
25 (5) Any and a11 adverse actions taken against licensees and their licenses as defined in this chapter shall be
26 ordered by the city council and 'unplemented by the office of LIEP. All judgements made by the city council
27 shall be final.

29 (d) Any applicant for a new license under this chapter shall be required to deposit a fee established bv ordinance as
30 soecified in section 310.09(b� of the Legislative Code , . ' to the
31 office of LIEP at the time of original application Such deposit shall be used to cover the cost of application
32 verification and any additional expense associated with investigations performed to assure compliance with this
33 chapter. If, however, the cost of investigations exceed the original deposit, the Office of License, Inspections and

Currently, the initial investigation fee for pawn shops is cited in both
Chapters 344 and 310. This may lead to an inconsistency in the future when
