An ordinance amending Chapter 60 of the Saint Paul Legislative Code pertaining to zoning for the City of
Saint Paul and the zoning maps thereof:
WHEREAS, Pursuant to Minnesota Statutes §462357 and §64.400 of the Legislative Code, CAYUGA
STREET, LLC duly petitioned to rezone 199 and 201 CAI'LJGA STREET being legally described as All that
part of Lot l O lying northwesterly of a line drawn parallel to and 15 feet southeasterly measured at right
angles to the northwesterly line o£ said Lot 10, Auditor's Subdivision No. 8, except Soo Line right-of-way;
and Lots 11 and 12, Auditor's Subdivision No. 8, from RT-1 (two-family residential) to I-1 (industrial) for
the purpose of developing surface parking, the petition having been certified by the Planning staff on October
27, 1998, as having been consented to by at least 67°l0 of the owners of the azea of the property to be rezoned,
and fiirther having been consented to by at least two-thirds of the owners of the property situated within 100
feet of the total contiguous properly within one year proceeding the date of the petifion; and
WHEREAS, the Zoning Committee of the Planning Commission held a public hearing on December 10,
1998, far the purpose of considering the rezoning petition, and pursuant to §107.03 of the Administrative
Code, submitted its recommendarion to the Planning Commission that the petition be granted; and
18 VJHEREAS, the Planning Commission considered the rezoning petition at its meeting held on December 18,

CAYLJGA STREET LLC submitted a petition to rezone properry at 199 AND 201 Cayuga St., on the
north side between Agate and Lorient Sts. The Zoning Committee of the Planning Commission held a
public hearing on the proposed rezoning on December 10, 1998. The applicant's representative
addressed the committee. At the close of the public hearing, the committee voted 7-0 to recommend
approval to rezone to I-1. The Planning Commission upheld the Zoning Committee's recommendation
for approvai on a unanimous vote on December 18, 1998.
This proposed rezoning is scheduled to be heard by the City Counci] on January 27, 1999. Please notify

WHEREAS, CAYiJGA STREET, LLC, File # 98-290, has petitioned to rezone 199 and 201
CAYUGA STREET, situated on the north side between Agate and Lorient Streets, from RT-1
(two-family residential) to I-1 (industrial); and
WHEREAS, the Zoning Committee of the Planning Commission on December 10, 1998, held a
-� public hearing at which all persons present were given an oppor[uniTy to be heard pursuant to _
said application in accordance with the. requirements of Section 64.400 of the Saint Paul
Legislative Code; and
WI-IEREAS, tlie Sainf Paul Planning Commission, based on the evidence presented to its Zoning
Committee at the public hearing as substantially reflected in the minutes, made the following
findings of fact:

1. Cayuga St. LLC is the owner ofthe properties at I99 and 20I Cayuga St. According to
the applicant's representative, Cayuga St. LLC is also in the process of purchasing the �
property immediately east of the subjecY property at 215-217 Cayuga St. for the purpose
of combining the properties and developing pazking that would be leased to the adjacent
Tilsner Carton Co. for overnight parking of semi-trailers. The rezoning is necessary to
allow use of the subj ect property for pazking. The 215-217 Cayuga property is vacant but
contains hazardous materials that the LLC proposes to clean up.
2. The rezoning is consistent with the Comprehensive Plan. The District 6 Plan
recommends industrial use for ffie area that includes this property (p. 8). The Economic
Development Strategy chapter recommends that the City provide adequate land for
industrial and commercial development and expansioa in order to iacrease the proportion
of commerciaUindustrial tax base (Policy 25, p. 17). The subject property is curtently
vacant and if developed for parking, would generate properry tax revenue as well as serve
the adjacent business.
3. The rezoning is consistent and compatible with the way the azea has developed. The
subject property is surrounded by industrial zoning on three sides. It is very unlikely that
the properry would be developed for residential use in the future.

4. The rewning will not have an adverse impact on adjacent property. Industrial use will be
compatible with the existing business to the west. The residential neighbozhood to the
south should not be adversely impacted, as it is buff'ered by Cayuga Pazk and the natival
topography of the site, which slopes down to the north.
5. The applicant has submitted a sufficient petition of two-thirds of the property owners
within one hundred (100) feet of the properry stating support for the rezoning (6 parcels
eligible, 4 required, 4 signed).
NOW, THEREFORE, BE IT RESOLVED, by the Saint Paul Planning Commission that the
petition of CAI'I3GA STREET, LLC to rezone property at 199 and 201 CAYiJGA STREET,

John Manillo, president of Scenic Minnesota, who indicated that he had not seen Brian Bates'
letter before it had eone out. nor had anyone else in the organization.
Commissioner Field responded to the allegations made in the lettec A[ the committee level
and in the past_ Commissioner Fietd stated, that he has disclosed that his building has a

$2.600 per year. Prior to sen ine on the task force, he consulted with Mr. Warner, City
Attornec�s Office and ccas advised that there was no conflict of interest for him to serve on
either the LeQislatice Ad� ison Task Force or the Plannin� Commission. He noted that he has

Commissioner Vaught stated that he made the motion at Zoning Committee and he wrote the
• resolution. The sunset provision was put in at the suggestion of Commissioner Gordon.
Commissioner Vaught said that he didn't like it and would have voted for the original motion
�vithout the sunset provision in it because he thinks it is reasonably clear that this is a business
si�n and not an advertising sign. Commissioner Vaught thinks there are probably many ways
thatthis could be sliced and diced.

Cayuga Street.
Donna Drummond gave a slide presentation and reviewed the staff report. Ms. Drummond stated
that staff recommends approval of the rezoning to allow the proposed development of surface
parking. Ms. Drummond said the District 6 Planning Council also recommends approval of the
rezoning application.
tn response to Commissioner Faricy, Ms. Drummond stated that the signature by the
Superintendent of Parks and Recreation was a standard signature on any rezoning petitions, to
indicate that they take no position on the subject petition.
John DeLanoy, 50 Prior Avenue South, appeared. Mr. DeLanoy stated the he is the attomey for,
and the officer of the applicant. He explained that this is part of a major expansion by Tiisner
Carton factory. Mr. DeLanoy further stated that fhey are tooking at adding 60,000 square feet of
factory space and about 60 jobs.
No one else spoke. The Public Hearing was closed.

An ordinance amending Chapter 60 of the Saint Paul Legislative Code pertaining to zoning for the City of
Saint Paul and the zoning maps thereof:
WHEREAS, Pursuant to Minnesota Statutes §462357 and §64.400 of the Legislative Code, CAYUGA
STREET, LLC duly petitioned to rezone 199 and 201 CAI'LJGA STREET being legally described as All that
part of Lot l O lying northwesterly of a line drawn parallel to and 15 feet southeasterly measured at right
angles to the northwesterly line o£ said Lot 10, Auditor's Subdivision No. 8, except Soo Line right-of-way;
and Lots 11 and 12, Auditor's Subdivision No. 8, from RT-1 (two-family residential) to I-1 (industrial) for
the purpose of developing surface parking, the petition having been certified by the Planning staff on October
27, 1998, as having been consented to by at least 67°l0 of the owners of the azea of the property to be rezoned,
and fiirther having been consented to by at least two-thirds of the owners of the property situated within 100
feet of the total contiguous properly within one year proceeding the date of the petifion; and
WHEREAS, the Zoning Committee of the Planning Commission held a public hearing on December 10,
1998, far the purpose of considering the rezoning petition, and pursuant to §107.03 of the Administrative
Code, submitted its recommendarion to the Planning Commission that the petition be granted; and

CAYLJGA STREET LLC submitted a petition to rezone properry at 199 AND 201 Cayuga St., on the
north side between Agate and Lorient Sts. The Zoning Committee of the Planning Commission held a
public hearing on the proposed rezoning on December 10, 1998. The applicant's representative
addressed the committee. At the close of the public hearing, the committee voted 7-0 to recommend
approval to rezone to I-1. The Planning Commission upheld the Zoning Committee's recommendation
for approvai on a unanimous vote on December 18, 1998.
This proposed rezoning is scheduled to be heard by the City Counci] on January 27, 1999. Please notify

WHEREAS, CAYiJGA STREET, LLC, File # 98-290, has petitioned to rezone 199 and 201
CAYUGA STREET, situated on the north side between Agate and Lorient Streets, from RT-1
(two-family residential) to I-1 (industrial); and
WHEREAS, the Zoning Committee of the Planning Commission on December 10, 1998, held a
-� public hearing at which all persons present were given an oppor[uniTy to be heard pursuant to _
said application in accordance with the. requirements of Section 64.400 of the Saint Paul
Legislative Code; and
WI-IEREAS, tlie Sainf Paul Planning Commission, based on the evidence presented to its Zoning
Committee at the public hearing as substantially reflected in the minutes, made the following
findings of fact:

1. Cayuga St. LLC is the owner ofthe properties at I99 and 20I Cayuga St. According to
the applicant's representative, Cayuga St. LLC is also in the process of purchasing the �
property immediately east of the subjecY property at 215-217 Cayuga St. for the purpose
of combining the properties and developing pazking that would be leased to the adjacent
Tilsner Carton Co. for overnight parking of semi-trailers. The rezoning is necessary to
allow use of the subj ect property for pazking. The 215-217 Cayuga property is vacant but
contains hazardous materials that the LLC proposes to clean up.
2. The rezoning is consistent with the Comprehensive Plan. The District 6 Plan
recommends industrial use for ffie area that includes this property (p. 8). The Economic
Development Strategy chapter recommends that the City provide adequate land for
industrial and commercial development and expansioa in order to iacrease the proportion
of commerciaUindustrial tax base (Policy 25, p. 17). The subject property is curtently
vacant and if developed for parking, would generate properry tax revenue as well as serve
the adjacent business.
3. The rezoning is consistent and compatible with the way the azea has developed. The
subject property is surrounded by industrial zoning on three sides. It is very unlikely that
the properry would be developed for residential use in the future.

4. The rewning will not have an adverse impact on adjacent property. Industrial use will be
compatible with the existing business to the west. The residential neighbozhood to the
south should not be adversely impacted, as it is buff'ered by Cayuga Pazk and the natival
topography of the site, which slopes down to the north.
5. The applicant has submitted a sufficient petition of two-thirds of the property owners
within one hundred (100) feet of the properry stating support for the rezoning (6 parcels
eligible, 4 required, 4 signed).
NOW, THEREFORE, BE IT RESOLVED, by the Saint Paul Planning Commission that the
petition of CAI'I3GA STREET, LLC to rezone property at 199 and 201 CAYiJGA STREET,

Chair Morton called attention to a letter she received from Brian Bates, Scenic Minnesota, that
was copied for each commissionec She added that she had also received a phone call from
John Manillo, president of Scenic Minnesota, who indicated that he had not seen Brian Bates'
letter before it had eone out. nor had anyone else in the organization.
Commissioner Field responded to the allegations made in the lettec A[ the committee level
and in the past_ Commissioner Fietd stated, that he has disclosed that his building has a
billboard which is o�vned b� Eller Advertising. and he has a 1/6 undivided interest in $2,500 -
$2.600 per year. Prior to sen ine on the task force, he consulted with Mr. Warner, City
Attornec�s Office and ccas advised that there was no conflict of interest for him to serve on
either the LeQislatice Ad� ison Task Force or the Plannin� Commission. He noted that he has
ab;tained from voting on ad� ertisins signs onh �ihen the} directl} im�olve an Eller sign, not o�
all adtiertisina signs. He �rent on to sa} that he finds Mr. Bates� comments to be inflammatory.

Commissioner Kramer said he thought there was a fundamental misunderstandinQ in Mc Bates •

Commissioner Vaught stated that he made the motion at Zoning Committee and he wrote the
• resolution. The sunset provision was put in at the suggestion of Commissioner Gordon.
Commissioner Vaught said that he didn't like it and would have voted for the original motion
�vithout the sunset provision in it because he thinks it is reasonably clear that this is a business
si�n and not an advertising sign. Commissioner Vaught thinks there are probably many ways
thatthis could be sliced and diced.

family residential) to I-1 (industrial) to aliow development of parking at the location of 199 and 201
Cayuga Street.
Donna Drummond gave a slide presentation and reviewed the staff report. Ms. Drummond stated
that staff recommends approval of the rezoning to allow the proposed development of surface
parking. Ms. Drummond said the District 6 Planning Council also recommends approval of the
rezoning application.
tn response to Commissioner Faricy, Ms. Drummond stated that the signature by the
Superintendent of Parks and Recreation was a standard signature on any rezoning petitions, to
indicate that they take no position on the subject petition.
John DeLanoy, 50 Prior Avenue South, appeared. Mr. DeLanoy stated the he is the attomey for,
and the officer of the applicant. He explained that this is part of a major expansion by Tiisner
Carton factory. Mr. DeLanoy further stated that fhey are tooking at adding 60,000 square feet of
factory space and about 60 jobs.
No one else spoke. The Public Hearing was closed.

An ordinance amending Chapter 60 of the Saint Paul Legislative Code pertaining to zoning for the City of
Saint Paul and the zoning maps thereof:
WHEREAS, Pursuant to Minnesota Statutes §462357 and §64.400 of the Legislative Code, CAYUGA
STREET, LLC duly petitioned to rezone 199 and 201 CAI'LJGA STREET being legally described as All that
part of Lot l O lying northwesterly of a line drawn parallel to and 15 feet southeasterly measured at right

WHEREAS, the Zoning Committee of the Planning Commission held a public hearing on December 10,

Donna Drummond gave a slide presentation and reviewed the staff report. Ms. Drummond stated
that staff recommends approval of the rezoning to allow the proposed development of surface
parking. Ms. Drummond said the District 6 Planning Council also recommends approval of the
rezoning application.
tn response to Commissioner Faricy, Ms. Drummond stated that the signature by the
Superintendent of Parks and Recreation was a standard signature on any rezoning petitions, to
indicate that they take no position on the subject petition.
John DeLanoy, 50 Prior Avenue South, appeared. Mr. DeLanoy stated the he is the attomey for,
and the officer of the applicant. He explained that this is part of a major expansion by Tiisner
Carton factory. Mr. DeLanoy further stated that fhey are tooking at adding 60,000 square feet of
factory space and about 60 jobs.
No one else spoke. The Public Hearing was closed.

201 Cayuga Street to Rezone these properties from RT-1 to I-1 which would allow them
to be used for parking.
� On Wednesday, November 24, 1998 the Land Use Task Force of the District 6
