The Council of the City of Saint Paul does ordain that Saint Paul Legislative Code Chapter 45 shall be
amended to read as follows:
SECTION 1
Section 45.10. Abatement procedure.
d. A statement that the oxder may be appealed and a hearing before the ei�yeatmeit-Leeislative Hearin¢
Officer obtained by filing a written request with the city clerk before the appeal deadline which shall be
the abatement deadline designated in the order or seven (7) calendar days after the date of the order,
whichever comes first; and
(4a) . � ,
a�sueh Leeislative Hearin� Officer. The le�islative hearin� officer appointed bv the Citv
Council president shall convene a Public Hearing at which time the appellant shall have an o�portunitv to
present evidence and testimony to supnort the appeal of the abatement order The Leeislative Hearine
Officer ma�receive evidence and testimonv from the Enforcement Officer and other narties who wish to be
heard Upon receiving the evidence and testimony the Legislative Hearin� Officer shall make a written
recommendation to the Citv Council which mav confirm, modify, revoke, alter or cancel the order of the
Enforcement Officer.

Hearine The City Council shall review the recommendations of the Leeislative Hearin� Officer and may
confum modify or approve the order of the Enforcement Officer If the council determination requires
abatement the City Council shall in the resolution fix a time within which the nuisance must be abated
and shall provide that if the nuisance is not eliminated within the tune specified, the Citv may abate the
nuisance and assess the costs of the abatement to the subject xeal estate as a special assessment.

SECTION 2
That this ordinance shall be effective thirty (30) days after passage, approval and publication.
