Definitions. 18 Chapter 417. Parking Lots and Parking Garages �rra�rcuen �fAY 1 1999 19 Except where otherwise expressly stated, the following terms, wherever used in this chapter, shall have tfie meanings 20respectively ascribed to them in this section: 21 22'Parking loY' or "parking lot or building" means and includes any premises where ten (10) or more motor vehicPes 23 are parked, stored or ailowed to remain, and where the owner or person storing or parking such vehicle is charged a 24 fee therefor. "Parking lot" excludes any parking area other than a pazking gazage that is exclusively used by or leased 25 to occupants of a residence on the same or other premises for use only in connection with and as accessory to the 26 occupancy of such residence. 27 28 "Parking garage" means a building or structure, or part thereof, in which a siructural level (a level with space below 29 the pazking area that can be occupied) is used for puking, storing, or maintaining motor vehicles. 30 31 "Government roarkinggarage" means any gara¢e owned bv a�overnmental unit where the owner or �erson storin�or 32 parkine such vehicle is not chazged a fee. 33 34"Private parking,gara�e" means any parkin�garage which is exclusivelv used by or leased to occupants of a 35 residence or business on the same ar other premise for use onlv in connecfion with and as accessorv to the 36 occupancv of such residence or business. and where the owner or person storine or roarking such vehicle is not 1 chareed a fee. '�(G(�(�,(,(,� g�� Z�3 3"Light color" means any surface color with a minimum light reflective value of seventy-five (75) percent or more as 4 indicated by standazd paint color charts. 5 6"I'ype I structurai condition survey" means visual observations of all structural components including but not 7 limited to, the top and bottom side of all structural floors, hellxes, and all supporting beams, columns, or walls. 8 9"Type II structural condition survey" means visual observarions plus nondeshuctive tests such as, but not lunited to, 10 chloride ion concentration tests, concrete relarive compression strength tests, half cell testing, pachometer reading, ll tapping and chain dragging. 12 13 "Type III structural condition survey" means visual observations and nondestructive tests, plus deshuctive tests such 14 as, but not Innited to, the physical removal of concrete for the purpose of exposing reinforcing steel, prestressin� or 15 post-tensioned tendons, post tensioning anchors (to doctunent the amount of corrosion at the grippers, in the strand, 16 and on the unstressed face of the anchor), expansion or contraction joints, or any other buried steel. Concrete core 17 samples might, be used to document compression strengths. 18 19 Section 2 20 21 Section 417.Q4 of the Saint Paul Legislative Code is hereby amended to read as Follows:' 22 23 Sec. 417.04. Fees. 24 25 The license fees for such parking lots or pazking garages shall be as set forth in section 310.09(b) and 310.18 of the 26Saint Paul Leeislative Code. £eHedas: 27 28 > 29 30 31 , 32 33 34 � 35 36 37 38 � 39 40 41 , 42 43 b � 44 45 46 47 Section 3 48 Section 417.05 of the Saint Paul Legislative Code is amended to read as follows: :T � qq-�.� 2 Sec, 417.05. d,icensing requirements. 4(a) Application. Any person desirin� a license to operate a parking lot or pazking garages shall deposit with the 5 inspector the axnount of the license fee herein provided, and the inspector shall thereupon take the application upon 6 forms provided by him, which forms shall afford information relative to the owner, address, size of such pazking lot 7 or parking gazages and the number of cars proposed to be pazked thereon, together with any other information 8 deemed necessary by such inspector. The inspector shali refer such applicarion to the director of the department of 9 police and the director of the depamnent of fire and safety services. It is hereby made the duty of the director of the 1 Q depariment of police to inquire into the chuacter of the applicant and report the result of such inquiry to the 11 inspector, together with his opinion whether such applicant is a proper person to receive such a license. It is hereby 12 made the duty of the director of the department of fire and safety services to inspect and examine, or to have 13 inspected and examined, the premises described in the application, and report the result of such inspection to the 14 inspector, together with his opinion whether the premises are proper for the conduct of such a business. Upon receipt 15 of such report and opuuons, the inspectar shall transmit the same, together with his own opinion of the premises and 16 applicant, to the city council for its consideration, and the city council shall then, by resolution, grant or deny the 17 application. 18 19 (b) Plans; building; zoning. Applicants for licenses are hereby required to futnish to the inspector plans containing ZO a general description of the security system to be provided, the layout showing driveways of the proposed lot or 21 parking gazage and the legal description of the property. All plans for new parking lots or pazking garages shail be 22 referred by the inspector to the planning division of the department of planning and economic development far "site 23 plan" review and approval priar to the issuance of any license. The plans will be reviewed for compliance with 24 sections 417.07 and 62.104 of the Saint Paul Legislarive Code as well as any other applicable city standards, 25 including the struchual review requirement of the certificate of occupancy and of section 417.07(10). 26 27 (c) Enclosure. Except for places of entrance and exit, every such pazking lot ar pazldng gazages shall be completely 28 enclosed in the manner hereinafter specified: Said enclosures shall be constructed and maintained so as to withstand 29 the shocks and stresses to which they will normally be subjected and be such as to ensare that no portion of any 30vehicle parked on said parking lot shall project beyond the property line of said loY. Where such motor vehicle 31 pazking lot abuts a building, such enclosure shall be so placed tFiat it will prevent motor velucles from strildng such 32 building. 33 34 Said enclosure may be posts and rails eighteen (18) inches high which will engage tfie bumper of any motor velric�e 35parked in said lot, or it may be concrete wheel stops conforming to the following: 36 37 (1) 3$ 39 40 (2) 41 42 Precast concrete units shall be a minimum of eight (8) inches high and shall be securely fastened in place in a manner approved by the building official. Cast-in-place monolithic concrete curbs shall extend at least six (6) inches above the finished grade of the lot and shall be of a design approved by the building official. 43 Said enclosure may be of a standazd type as designated by the building official or any otfier type approved by him 44 following subxnission of plans and specifications thereof. The type and arrangement of the enclosure shall be such as 45 to ensure that the vehicles pazked on said lot shall not project over the property line or strike any building abutting 46 such parking lot and shall be specifically approved by the building official for each location. 47 48 A permit for the construction or erection of every such enclosure shall be obtained from the director of the 1 department of comxnunity services in accordance with the procedures of the building code. C� .'�.33 2 3 Every such parking lot shall be suitably surfaced with a dustless surface approved by the � 4 Director of the Office of License. Parking Lots and Parking Garages �rra�rcuen �fAY 1 1999 19 Except where otherwise expressly stated, the following terms, wherever used in this chapter, shall have tfie meanings 20respectively ascribed to them in this section: 21 22'Parking loY' or "parking lot or building" means and includes any premises where ten (10) or more motor vehicPes 23 are parked, stored or ailowed to remain, and where the owner or person storing or parking such vehicle is charged a 24 fee therefor. "Parking lot" excludes any parking area other than a pazking gazage that is exclusively used by or leased 25 to occupants of a residence on the same or other premises for use only in connection with and as accessory to the 26 occupancy of such residence. 27 28 "Parking garage" means a building or structure, or part thereof, in which a siructural level (a level with space below 29 the pazking area that can be occupied) is used for puking, storing, or maintaining motor vehicles. 30 31 "Government roarkinggarage" means any gara¢e owned bv a�overnmental unit where the owner or �erson storin�or 32 parkine such vehicle is not chazged a fee. 33 34"Private parking,gara�e" means any parkin�garage which is exclusivelv used by or leased to occupants of a 35 residence or business on the same ar other premise for use onlv in connecfion with and as accessorv to the 36 occupancv of such residence or business. and where the owner or person storine or roarking such vehicle is not 1 chareed a fee. '�(G(�(�,(,(,� g�� Z�3 3"Light color" means any surface color with a minimum light reflective value of seventy-five (75) percent or more as 4 indicated by standazd paint color charts. 5 6"I'ype I structurai condition survey" means visual observations of all structural components including but not 7 limited to, the top and bottom side of all structural floors, hellxes, and all supporting beams, columns, or walls. 8 9"Type II structural condition survey" means visual observarions plus nondeshuctive tests such as, but not lunited to, 10 chloride ion concentration tests, concrete relarive compression strength tests, half cell testing, pachometer reading, ll tapping and chain dragging. 12 13 "Type III structural condition survey" means visual observations and nondestructive tests, plus deshuctive tests such 14 as, but not Innited to, the physical removal of concrete for the purpose of exposing reinforcing steel, prestressin� or 15 post-tensioned tendons, post tensioning anchors (to doctunent the amount of corrosion at the grippers, in the strand, 16 and on the unstressed face of the anchor), expansion or contraction joints, or any other buried steel. Concrete core 17 samples might, be used to document compression strengths. 18 19 Section 2 20 21 Section 417.Q4 of the Saint Paul Legislative Code is hereby amended to read as Follows:' 22 23 Sec. 417.04. Fees. 24 25 The license fees for such parking lots or pazking garages shall be as set forth in section 310.09(b) and 310.18 of the 26Saint Paul Leeislative Code. £eHedas: 27 28 > 29 30 31 , 32 33 34 � 35 36 37 38 � 39 40 41 , 42 43 b � 44 45 46 47 Section 3 48 Section 417.05 of the Saint Paul Legislative Code is amended to read as follows: :T � qq-�.� 2 Sec, 417.05. d,icensing requirements. 4(a) Application. Any person desirin� a license to operate a parking lot or pazking garages shall deposit with the 5 inspector the axnount of the license fee herein provided, and the inspector shall thereupon take the application upon 6 forms provided by him, which forms shall afford information relative to the owner, address, size of such pazking lot 7 or parking gazages and the number of cars proposed to be pazked thereon, together with any other information 8 deemed necessary by such inspector. The inspector shali refer such applicarion to the director of the department of 9 police and the director of the depamnent of fire and safety services. It is hereby made the duty of the director of the 1 Q depariment of police to inquire into the chuacter of the applicant and report the result of such inquiry to the 11 inspector, together with his opinion whether such applicant is a proper person to receive such a license. It is hereby 12 made the duty of the director of the department of fire and safety services to inspect and examine, or to have 13 inspected and examined, the premises described in the application, and report the result of such inspection to the 14 inspector, together with his opinion whether the premises are proper for the conduct of such a business. Upon receipt 15 of such report and opuuons, the inspectar shall transmit the same, together with his own opinion of the premises and 16 applicant, to the city council for its consideration, and the city council shall then, by resolution, grant or deny the 17 application. 18 19 (b) Plans; building; zoning. Applicants for licenses are hereby required to futnish to the inspector plans containing ZO a general description of the security system to be provided, the layout showing driveways of the proposed lot or 21 parking gazage and the legal description of the property. All plans for new parking lots or pazking garages shail be 22 referred by the inspector to the planning division of the department of planning and economic development far "site 23 plan" review and approval priar to the issuance of any license. The plans will be reviewed for compliance with 24 sections 417.07 and 62.104 of the Saint Paul Legislarive Code as well as any other applicable city standards, 25 including the struchual review requirement of the certificate of occupancy and of section 417.07(10). 26 27 (c) Enclosure. Except for places of entrance and exit, every such pazking lot ar pazldng gazages shall be completely 28 enclosed in the manner hereinafter specified: Said enclosures shall be constructed and maintained so as to withstand 29 the shocks and stresses to which they will normally be subjected and be such as to ensare that no portion of any 30vehicle parked on said parking lot shall project beyond the property line of said loY. Where such motor vehicle 31 pazking lot abuts a building, such enclosure shall be so placed tFiat it will prevent motor velucles from strildng such 32 building. 33 34 Said enclosure may be posts and rails eighteen (18) inches high which will engage tfie bumper of any motor velric�e 35parked in said lot, or it may be concrete wheel stops conforming to the following: 36 37 (1) 3$ 39 40 (2) 41 42 Precast concrete units shall be a minimum of eight (8) inches high and shall be securely fastened in place in a manner approved by the building official. Cast-in-place monolithic concrete curbs shall extend at least six (6) inches above the finished grade of the lot and shall be of a design approved by the building official. 43 Said enclosure may be of a standazd type as designated by the building official or any otfier type approved by him 44 following subxnission of plans and specifications thereof. The type and arrangement of the enclosure shall be such as 45 to ensure that the vehicles pazked on said lot shall not project over the property line or strike any building abutting 46 such parking lot and shall be specifically approved by the building official for each location. 47 48 A permit for the construction or erection of every such enclosure shall be obtained from the director of the 1 department of comxnunity services in accordance with the procedures of the building code. C� .'�.33 2 3 Every such parking lot shall be suitably surfaced with a dustless surface approved by the � 4 Director of the Office of License. Inspections and Environmental Protection or lus or her 5 designee, who shall cause regular inspections to be made of all such parking lots to detemune that all condirions 6 contained in this chapter or special conditions specified by the city council under the provisions of the zoning code 7 shall have been complied with. �-Fe The Airector shall report to the inspector and the city council any and all 8 violations or failures to so comply. 10 All plans and specifications for enclosures shall be approved by the building officiaL 11 12 13 Section 4 14 This ordinance shall take effect and be in full force thiriy (30) days following its passage, approval and publication.
