Effective Mazch 15, 1991, no person sha11 drive a tasicab, nor shall any owner or 17 lessee of a taYicab allow any other person to drive a taxicab, witiun the City of Saint Paui unless that person has 18 first obtained and displayed a taxicab driver's license under the provisions of this Code. 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 (b) Drivers from other cities. Any driver licensed to operate a tasicab in another city may carry passengers from that city to any place within the City of Saint Paul and may freely enter and travel upon the streets for that purpose. In that case, it shall not be deemed necessary for the tasicab driver to obtain a Saint Paul license but the driver shall not be permitted to accept ar offer any passenger for hire in the City of Saint Paul, or otherwise operate a taYicab within the city without first obtaining a license under the provisions of this Code. While within the city the taxicab driver shall be required to observe all of the applicable regulations and conditions of this section and shall have in possession and display to any person upon demand the license certificate for the taYicab. (c) License appZication. Every applicant for a taxicab driver's license shall file an application with the license division. The application shall be made on a form provided by said division, containing such information as the license inspector may require, including, but not limited to, a complete employment history, to verify that the terms and conditions of this chapter have been met. The applicarion shall be signed and sworn to by the applicant. Prior to the issuance of the license, every licensee shall be photographed. The chief of police or his representative shall investigate each applicant and shall forward the results of the application to the license inspector. Any false statement on the application shall be grounds for denial, refusal to renew or revocation of a license. Eligibility to be licensed to operate a taxicab shall be as follows: (1) �2) (3) Possess a valid Minnesota driver's license; Be at least eighteen (18) yeazs old; Be a citizen of the Umted States, or an alien admitted for permanent residence, or who has otherwise obtained work authorization from the U.S. Tmmigration and Naturalization Service; (4) Shall have no felony convictions in the last five (5) years; shall have no nontraffic gross misdemeanar or misdemeanor convictions in the last three (3) years involving the use or threat of use of force, possession or sale of a controlled substance, prostitution or indecent conduct. The license inspector may grant, pursuant to state stahxte, an exception to the above provisions upon evidence that the offense is not related to the occupafion of taxicab driver; (5) Shall haue a driving record meeting the following standards: � No convictions in the last five (5) years for any of the following ofFenses involving injury or death; no conviction in the last three (3) years for any of the following offenses not involving injury or death: Leaving the scene of an accident; `� Driving under the influence of an alcoholic beverage or drug; Reckless or careless driving; or C� Refusal to take a breathalyzer test. 39 b. For original licensure: No more than four (4) moving violations within the last three (3) 40 years, and no more than two (2) moving violations in the last year. For renewal: no more 41 than four (4) moving violations withixi the last three (3) yeazs and no more than three (3) 42 moving violations in the last year. Moving violations shall mean for this subsection those 43 violations specified above in subsection (5)a., and any speeding violations. 44 45 46 47 c. Every new applicant shall have at least one (1) yeaz's driving experience as a licensed driver. Such prior driving experience shall be verified by an affidavit signed by a reputable person and submitted with the license application. � ii i �L�, -a�� 6 7 8 9 10 11 12 13 � 14 15 16 (6) ��) For any driver seekingoriginal licensure. or any driver whose taxi license has lapsed for more than one vear, or as deemed necessarv b�he license insnector: shall have successfullv comnleted the tasicab driver training course as set fourth in Section 376.17. d. Upon submission of proof of suitability and evidence of insurability, the license inspector may waive one (1) or more of the requirements listed above; provided, that any such waiver shall indicate the grounds for the inspector's decision and shall be approved by the director of the department of finance and management services. Have a demonstrated knowledge of the provisions of the taxicab ordinance relating to the conduct of taxicab drivers and the operation of a taxicab. Failure to apply for renewal of any taxicab operator's license within thirty (30) days after expiration shall be deemed an abandonment of the licensee's right to such renewal. 17 ( fl Dury to exhibit Zicense. Effective March 15, 1991, every taxicab driver while on duty shall display the 18 front of his or her t�icab driver's license on the dashboard of the vehicle in a location readily visible to 19 passengers, which license displays the driver's photograph and license number on the front in a manner 20 approved by the license inspector. In addition to any other penaities, a depuTy inspector or police officer may 21 order the licensee to discontinue operations until such time as the licensee has a license in possession. 22 23 (g) Issuance of license. Each taxicab driver's license shall have upon it a number by which the license 24 shall be designated, a photograph of the licensee, and such other information as the license inspector may 25 require. The license inspector may issue licenses for a term of less than one (1) yeaz for a prorated uutial fee in 26 order to evenly distribute license expiration dates throughout the year. 27 28 (h) Requirement of valid Minnesota driver's license. Any time that a licensee's Minnesota driver's license 29 is suspended, revoked or canceled, his or her tasicab driver's license shall likewise be immediately suspended, 30 revoked or canceled. No person shall operate a tasicab without a valid Minnesota driver's license. 31 32 (i) Renewals. A taxicab driver's license sha11 be issued annually. The license inspector may cause the 33 renewal of a tasicab driver's license from yeaz to year by appropriate endorsement upon the application for 34 renewal and payment of an annual fee of twenty dollazs ($20.00). The driver shall make such renewal 35 application upon a form to be fiiniished by the license division. The renewal form shall be filled out with the 36 full name and address of the applicant, together with the date and number of the originallicense. If a driver has 37 not been licensed in the previous license year, he or she shall be considered a new applicant. 38 39 (j) Suspension, revocation and nonrenewal. A ta�cicab driver's license may be revoked, suspended or not 4Q renewed by the license inspector at any time for cause pursuant to the provisions of this chapter and Chapter 310 41 of the Legislative Code. When a taxicab driver's license has been revoked or suspended, it sha11 immediately be 42 returned to the license division. If the city council stipulates that a licensee whose taxicab driver's license has 43 been revoked may reapply after a specific period of time has elapsed, that period of time sha11 not commence 44 until the tasicab driver s license has been returned to the license division. 45 46 47 48 49 (k) Revocation ofMinnesota driver's license; limited Zicenses; alcohol-related driving conviction: (1) Any person holding a taxicab driver's license whose Mimiesota driver's license is suspended, canceled or revoked for any reason shall immediately surrender his or her taxicab driver's license 5-�-49 � �,� -a3 � 1 to the license division. The tasicab driver's license shall be returned to the licensee upon 2 reinstatement of the Minnesota driver's license or issuance of a limited license authorizing 3 operation of a taxicab; provided, however, that suspension, cancellation or revocarion of a 4 Minnesota driver's license due to refusal to submit to a legally required blood alcohol test under 5 the state unplied consent statute shall be grounds for the revocation, nonissuance or nonrenewal 6 of the taxicab driver's license. 7 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 (2) Any licensed taxicab driver whose Minnesota driver's license has been revoked and who has been issued a i'united license autho*��'ng the operation of a taxicab shall unmediately notify the license division of the same. At that time, the licensee shall fiunish to the license inspector a copy of the limited license and a written statement containiug a schedule of the days and hours of each day during which he or she will be driving a taxicab during the term of the limited license. No deviation from the schedule shall be permitted. In addition, the licensee shall personally funush to the license inspector copies of all trip sheets for all shifts worked during the term of the limited license. (3) Any person holding a taxicab driver's license shall notify the Office of License, Inspections and Environmental Protection (LIEP) immediately whenever he or she is convicted of an alcohol- related driving offense, whether or not it involves the operation of a ta�cicab. (4) (5) Refusal to take and/or failure to pass a standazd breathalyzer test administered pursuant to Minn. Stat. § 169.123 while on duty shall be grounds for revocation of a taxicab driver's license. Failwe to comply with the provisions of this section shall be grounds for revocation of a taxicab driver's license. The license insnector shall establish a taxicab driver trainin� course �ursuant to the terms of this secrion. The course shall be desiened to enhance the proficiencv of drivers in all aspects of taxicab drivin¢, and may include tonics such as eg oera�hy of tke metropolitan azea traffic laws, vehicle safetY, taYicab licensin�aws and driver code of conduct, radio communicafions, cab stand and ca11 nrocedures. tasicab fares, vehicle cleanliness and maintenance_ customer relations. and courtesv. j� Component ofdriver traininQ. The driver training course may consist of components tau hg t bv City stafF, or components taught bv an educational institution under contract with the Citv, or by a combination of such components. � Prerequisite for licensure. Successful completion of the t�icab driver trainin¢ course shall be a prerec�uisite for obtaining a license for ail taxicab drivers not licensed on the effective date of this ordinance and all taxicab drivers whose license have lapsed for more than one vear. An applicant who has met all of the requirements for an original license except for the successful completion of taxicab driver training shall be authorized to operate as a provisional operator until the fust available opening in a trainine class. at which time the applicant must enroll in and successfuliv comQlete the class. U�on the successful compietion of the trainin¢ class, the applicant shall receive a license valid throu¢h the remainder of the one-veaz licensine period. Provisional operator status may be revoked for failure to enroll in the first available openine in the trainiug class, or failure to successfullv complete the class. The applicant shall be entitled to three days' written notice of a public hearing before the council at which time the licensee shall have an opporhmitv to be heard. For anv other basis protiosed for adverse action, an applicant shall be entitled to the hearing procedures of &310.05. An applicant failin¢ to satisfactorily complete the provisional period may reap�ly no sooner than twelve (121 months after the date of the original application. For original licensure: No more than four (4) moving violations within the last three (3) 40 years, and no more than two (2) moving violations in the last year. Effective March 15, 1991, every taxicab driver while on duty shall display the 18 front of his or her t�icab driver's license on the dashboard of the vehicle in a location readily visible to 19 passengers, which license displays the driver's photograph and license number on the front in a manner 20 approved by the license inspector. In addition to any other penaities, a depuTy inspector or police officer may 21 order the licensee to discontinue operations until such time as the licensee has a license in possession. 22 23 (g) Issuance of license. Each taxicab driver's license shall have upon it a number by which the license 24 shall be designated, a photograph of the licensee, and such other information as the license inspector may 25 require. The license inspector may issue licenses for a term of less than one (1) yeaz for a prorated uutial fee in 26 order to evenly distribute license expiration dates throughout the year. 27 28 (h) Requirement of valid Minnesota driver's license. Any time that a licensee's Minnesota driver's license 29 is suspended, revoked or canceled, his or her tasicab driver's license shall likewise be immediately suspended, 30 revoked or canceled. No person shall operate a tasicab without a valid Minnesota driver's license. 31 32 (i) Renewals. A taxicab driver's license sha11 be issued annually. The license inspector may cause the 33 renewal of a tasicab driver's license from yeaz to year by appropriate endorsement upon the application for 34 renewal and payment of an annual fee of twenty dollazs ($20.00). The driver shall make such renewal 35 application upon a form to be fiiniished by the license division. The renewal form shall be filled out with the 36 full name and address of the applicant, together with the date and number of the originallicense. If a driver has 37 not been licensed in the previous license year, he or she shall be considered a new applicant. 38 39 (j) Suspension, revocation and nonrenewal. A ta�cicab driver's license may be revoked, suspended or not 4Q renewed by the license inspector at any time for cause pursuant to the provisions of this chapter and Chapter 310 41 of the Legislative Code. We have not completed the change to Section 376.17 providing for a provisional t�icab driver's license until training can be completed. We ask that this matter be laid over one week. The other two issues brought up by Mr. Sammons, holding the class in Saint Paul, and establishing the fee will be addressed administratively: l. Classes will be held in Saint Paul 2.
