9 Chapter 347 of the Saint Paul Legislative Code is hereby amended to read as follows:

17Pet shop means and includes every place kept or maintained for the care, e�ibi6on for sale, sale or purchase of live
18 dogs, cats, rabbits or other small animals, or any birds, reptiles or fish, but shall not include veterinary hospitals or
19 persons or places selling only frogs, fish, worms or reptiles for use as live bait for fiskung. Pet sfiop licensees shall be
20 exempY from obtaining a dog and cat grooming license pursuant to Chapter 382 of the Legislative Code. In addrtion,
21 such dog and cat grooming facilities shall be exempt from obtaining a pet shop license.

23 Pet shop facility means any facility engaged in the operation of pet shops.

25 Animal facilitv includes every place which is en¢aqed in the operation of apet shop but not a retail pet shop or
26 veterinary hospital.

30 Section 347.05 of the Saint Paul Legislative Code is hereby amended to read as follows:

34 (a) Premises. Every person keeping or maintaining a pet shop shall do so entirely wiUun a closed building, shall not
35 keep or maintain any outside kennel service, and shall be subject to and shall comply with all of the rules and
36 regulations of the Office of License, Inspections and Environmental Protecfion.

1(b) Exotic animals. No pet shop shall maintain, keep or harbor any skuuk, whether captured in the wild or raised
2 domestically, descented or not descented, vaccinated against raUies or not vaccinated against rabies. No pet shop
3 shall maintain, keep, hazbor or sell any red-eared turtle (Pseudemys scriptaelegans) with a shell length of less than
4 four (4) inches.

6(c) Permit required. Every licensee shall affix in a prominent position to the exterior of the cage, pen, enclosure, or
7 tank housing of any animal requiring a permit to keep within the city, a tag or notice with the words "Saint Paul
8 permit required."

10 (d) Rules and regulations. The director of environmental protection may upon norice and hearing promulgate such
11 rules as he or she deems necessary to cany out the provisions and purposes of this chapter, to provide for the proper
12 caze of animals and to provide for the cleanliness and proper sanitation in such facilities. Notice of the promulgation
13 of such rules and the hearing date shall be given to all licensees, and notice of the hearing date published once in the
141ega1 newspaper. The notice shall advise that at the hearing written or oral comments on proposed rules will be
15 received, and how a copy of the proposed rules can be obtained. Such rules shall be effective after such hearing when
16 filed in the office of the city clerk. Violations of such rules shall be sufficient grounds for adverse acfion against
171icenses issued under this chapter.

19 (e) Records. Every licensee shall keep a book in which shall clearly be entered, in ink, at the time of each purchase
20 or sale, an accurate account in the English language of any such live auiinal so purchased or sold, including the name
21 and address of the person by or to whom such purchase or sale is made.

23 (� Reporting. Every licensee shall inform the person by or to whom such purchase or sale is made for any animal
24requiring a permit in order to keep it within the city of the guidelines for obtaining a keeping-of-animal permit.

26 (g) Inspection. The record herein required to be kept, as well as the premises of each licensee, shall at all reasonable
27 times be open to inspection and examination by the license and health inspectors of the City of Saint Paul.

There are businesses in Saint Paul which operate in a similar fashion to that
of a pet shop without being either a retail pet shop or a veterinary hospital.
This legislation enables these businesses to be licensed, thus giving them the
opportunity to be dog Iicense vendors.
VANTAGES IF APPROVED:
more accurate class of license will give businesses an opportunity to become
dog license vendors and generate revenue for their businesses.
ISADVANTAGES IF APPROVED:
one apparent. �
