An ordinance amending chapters 87, 89, 90, 92 and 94 of the Saint Paul
Legislative Code pertaining to the rules and regulations of the Saint Paul
Regional Water Services as xecommended by the Boazd of Water

The Council of the City of Saint Paul Does Ordain:

That the following section 87 of the Saint Paul Legislative Code is hereby amended as �-
follows:
Chapter 87. Water Code-Water Service Connections
Sec. 87.03. Installation, maintenance and guarantee.
(b) Limits of installation and maintenance. The water utility shall instali all street service
connections from existing street mains to the ro�perry line, and shall maintain them in the

(c) Authorized material-existing street service connections. If an existing street service
connection extends to a property on which a new building is proposed, application for use of the
street service connection to serve said building sha11 not be acce_pted if the existin� street service
new application for water service must be made and paid for by the owner.
Sec. 87.14. Charges for af street service connections.
(a) Charges for street service connections sha11 be in accordance with the following Table
I and the following:
Actual costs, including labor, equipment, materials and overhead, shall be charged for
street service connections in the following categories:

1. All connections in the downtown area. The downtown azea shall be defined as
follows: An area bounded by and including University Avenue on the north,
Lafayette Road and State Trunk Highway 3 on the east, Shepazd and Warner
Roads on the south and Chesmut Street to Sntmnit Avenue to John Ireland
Boulevazd to Rice Street on the west.

Sec. 89.01. Fire services, annual charges.

(b) The annual charges shali be made in accordance with the following schedule based
upon the size of the service connection, and such charges shall cover the cost of the special
service rendered; the cost of a11 water used exclusively for fire extinguishing purposes; water
used for testing the fire equipment; testing and inspecfions by the water utility; maintenance
provided by the water utility on the street portion of the fire service; and interest and investment
costs of the board to render this special service.

Chapter 90. Water Code--Fire Hydrants
Sec. 90.03. Cash deposit required.
Appiicants to whom permits are granted shall be required to make a cash deposit of three'
�z#e,;hundred dollars ($36A:66j (��Qff {i()) in advance. The deposit is for the purpose of
guaranteeing payment for water used and to cover any breakage or damage to the fire hydrant or
meter. Upon return of the equipment issued to the permittee by the utility, said deposit, less
chazges against the permittee's account, will be returned to the permittee.

That the following section 92 of the Saint Paul Legislative Code is hereby amended as
follows:

That the following section 94 of the Saint Paul Legislative Code is hereby amended as
follows:
Chapter 94. Water Code--Interior Work
Sec. 94.18. Backflow preventers.
Installation, maintenance and testing of backflow preventers shall be according to the State
of Minnesota Plumbing Code. Annual testing of reduced pressure zone backflow preventers is
required. Upon receipt of notice for annual testing from the water utility, properry owners shall
have thirry (30) days in which to have backflow preventer testing accomplished by a licensed
pluxnber with backflow testing certification or by permanent non-contract staff who possess
backflow testing certification and are registered with the water utiliry; Test results sha11 be
furnished to the utility. The utility's annual fee for administering the backflow preventer testing
program shall be;;as follows:

Summary of revisions:

Sec. 87.03. Installation, maintenance and guarantee.
(b) Limits of installation and maintenance
Add "...and section 89.10." at the end of (b) because reference to maintenance also
appears in that section.
(c) Authorized material-existing street service
Add "Application for use of six-inch (6") and smaller cast iron street service
connection shail likewise not be accepted."
Because of its inability to withstand stress without breaking, cast iron water main pipe is
no longer approved for new installations, and none has been installed in the system since
the mid 1970s. Cast iron pipe under 8-inch in particular has a high incident of breakage.
This revision proposes to catagorize 6-inch and smaller cast iron the same as lead and
galvanized iron; unauthorized for reuse in a new building.
Sec. 87.14. Charges for street service connections and fire services.
Table I:
Increase charges for 1-inch street service connections 7.5% in 2000 and
7.5% in 2001.
Charge actual cost for 1%z and 2-inch street service connections.
Schedule chazges are increased to better reflect the cost of installation.
Costs have steadily declined since 1996 but are still greater than the schedule charges.
The revised chazges aze expected to match costs by the year 2001, and thereafter both
should increase at roughly the rate of inflation.
It should be noted that the 1998 average cost of $1,406 is $432 (24%) less than the
$1,838 average price plumbers charge for lead replacement in private property.
1%2 and 2-inch connections will now be charged actual cost because they are frequently
requested in commercial areas where each instailation is unique, making it difficult to
develop an accurate schedule of charges. The fact that there are on average of only 7 per
year also added to the problem.

Revised language concerning the charge for City of Saint Paul right-of-way permits
so that current and future charges, as revised by the Public Works Department, can
be collected.
Chapter 89. Water Code—Fire Supplies
Sec. 89.01 Fire services, annual charges
Except for 3-inch and smaller fire services, all annual charges to be raised 20%.
This fee is a stand by charge intended to compensate the Board for the additional capacity
it must provide to meet the needs of private fire services. It has not been revised since the
mid 1970s when it was cut approximately in half.
Chapter 90. Water Code—Fire Hydrants
Sec. 90.03. Cash deposit required.
Raise fire hydrant permit cash deposit from $300 to $500 to cover the actual cost of
the meter if it is damaged or lost. Deposit is returned in full if ineter is rehuned
undamaged and all water use charges are paid.
Chapter 92. Water Code—Plumbing
Sec. 92.06. Permit fees, penalty
Raise fees between 25% and 33%.
Plumbing permit fees are increased to better reflect the actual cost of performing
inspections.

Appiicants to whom permits are granted shall be required to make a cash deposit of three'

guaranteeing payment for water used and to cover any breakage or damage to the fire hydrant or
meter. Upon return of the equipment issued to the permittee by the utility, said deposit, less

Sec. 94.18. Backflow preventers.
Installation, maintenance and testing of backflow preventers shall be according to the State
of Minnesota Plumbing Code. Annual testing of reduced pressure zone backflow preventers is
required. Upon receipt of notice for annual testing from the water utility, properry owners shall
have thirry (30) days in which to have backflow preventer testing accomplished by a licensed
pluxnber with backflow testing certification or by permanent non-contract staff who possess
backflow testing certification and are registered with the water utiliry; Test results sha11 be
furnished to the utility. The utility's annual fee for administering the backflow preventer testing
program shall be;;as follows:

Summary of revisions:
Chapter 87. Water Code—Water service Connections
Sec. 87.03. Installation, maintenance and guarantee.
(b) Limits of installation and maintenance
Add "...and section 89.10." at the end of (b) because reference to maintenance also
appears in that section.
(c) Authorized material-existing street service
Add "Application for use of six-inch (6") and smaller cast iron street service
connection shail likewise not be accepted."
Because of its inability to withstand stress without breaking, cast iron water main pipe is
no longer approved for new installations, and none has been installed in the system since
the mid 1970s. Cast iron pipe under 8-inch in particular has a high incident of breakage.
This revision proposes to catagorize 6-inch and smaller cast iron the same as lead and
galvanized iron; unauthorized for reuse in a new building.
Sec. 87.14. Charges for street service connections and fire services.
Table I:
Increase charges for 1-inch street service connections 7.5% in 2000 and
7.5% in 2001.
Charge actual cost for 1%z and 2-inch street service connections.
Schedule chazges are increased to better reflect the cost of installation.
Costs have steadily declined since 1996 but are still greater than the schedule charges.
The revised chazges aze expected to match costs by the year 2001, and thereafter both
should increase at roughly the rate of inflation.
It should be noted that the 1998 average cost of $1,406 is $432 (24%) less than the
$1,838 average price plumbers charge for lead replacement in private property.
1%2 and 2-inch connections will now be charged actual cost because they are frequently
requested in commercial areas where each instailation is unique, making it difficult to
develop an accurate schedule of charges. The fact that there are on average of only 7 per
year also added to the problem.

so that current and future charges, as revised by the Public Works Department, can
be collected.
Chapter 89. Water Code—Fire Supplies
Sec. 89.01 Fire services, annual charges
Except for 3-inch and smaller fire services, all annual charges to be raised 20%.
This fee is a stand by charge intended to compensate the Board for the additional capacity
it must provide to meet the needs of private fire services. It has not been revised since the
mid 1970s when it was cut approximately in half.
Chapter 90. Water Code—Fire Hydrants
Sec. 90.03. Cash deposit required.
Raise fire hydrant permit cash deposit from $300 to $500 to cover the actual cost of
the meter if it is damaged or lost. Deposit is returned in full if ineter is rehuned
undamaged and all water use charges are paid.
Chapter 92. Water Code—Plumbing
Sec. 92.06. Permit fees, penalty
Raise fees between 25% and 33%.
Plumbing permit fees are increased to better reflect the actual cost of performing
inspections.

Summary of revisions:
Chapter 87. Water Code—Water service Connections
Sec. 87.03. Installation, maintenance and guarantee.
(b) Limits of installation and maintenance
Add "...and section 89.10." at the end of (b) because reference to maintenance also
appears in that section.
(c) Authorized material-existing street service
Add "Application for use of six-inch (6") and smaller cast iron street service
connection shail likewise not be accepted."
Because of its inability to withstand stress without breaking, cast iron water main pipe is
no longer approved for new installations, and none has been installed in the system since
the mid 1970s. Cast iron pipe under 8-inch in particular has a high incident of breakage.
This revision proposes to catagorize 6-inch and smaller cast iron the same as lead and
galvanized iron; unauthorized for reuse in a new building.
Sec. 87.14. Charges for street service connections and fire services.
Table I:
Increase charges for 1-inch street service connections 7.5% in 2000 and
7.5% in 2001.
Charge actual cost for 1%z and 2-inch street service connections.
Schedule chazges are increased to better reflect the cost of installation.
Costs have steadily declined since 1996 but are still greater than the schedule charges.
The revised chazges aze expected to match costs by the year 2001, and thereafter both
should increase at roughly the rate of inflation.
It should be noted that the 1998 average cost of $1,406 is $432 (24%) less than the
$1,838 average price plumbers charge for lead replacement in private property.
1%2 and 2-inch connections will now be charged actual cost because they are frequently
requested in commercial areas where each instailation is unique, making it difficult to
develop an accurate schedule of charges. The fact that there are on average of only 7 per
year also added to the problem.

Revised frost charge language so that frost charges apply to only 1-inch street
service connecrions (1 'h and 2-inch will now be actual cost).
Revised language concerning the charge for City of Saint Paul right-of-way permits
so that current and future charges, as revised by the Public Works Department, can
be collected.
Chapter 89. Water Code—Fire Supplies
Sec. 89.01 Fire services, annual charges
Except for 3-inch and smaller fire services, all annual charges to be raised 20%.
This fee is a stand by charge intended to compensate the Board for the additional capacity
it must provide to meet the needs of private fire services. It has not been revised since the
mid 1970s when it was cut approximately in half.
Chapter 90. Water Code—Fire Hydrants
Sec. 90.03. Cash deposit required.
Raise fire hydrant permit cash deposit from $300 to $500 to cover the actual cost of
the meter if it is damaged or lost. Deposit is returned in full if ineter is rehuned
undamaged and all water use charges are paid.
Chapter 92. Water Code—Plumbing
Sec. 92.06. Permit fees, penalty
Raise fees between 25% and 33%.
Plumbing permit fees are increased to better reflect the actual cost of performing
inspections.

To ensure better enforcement of the backflow preventer program and thereby better
protect the public's health, tlte Board of Water Commissioners directed that a third
plumbing inspector be added in1948. That additional cost added to the need to raise fees.

W�REAS, Boazd of Water Commissioners ("$oazd") staff recommends tfiat Chapters 87, 89,
90, 92 and 94 of the Saint Paul Legislative Code ("Code") be amended so that certain fees for
services more closely reflect the cost to the Board of providing those services; and
Wf3EREAS, Boazd stafF also recommends amendments to the Code which cIarify
miscellaneous procedures and provisions; and
WI�REAS, Board staff has prepazed a proposed St. Paui City Council Ordinance
("Ordinance") which amends the Code, and the Ordinance has been reviewed and recommended
for approval by the St. PauI Regional Water Services General Manager, and the form has been
approved by the Assistant City Attomey, and a copy of the Ordinance is aitached hereto and
incorporated herein; now, therefore, be it
RESOLVED, That the Board of Water Commissioners does hereby approve the attached
