THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1 Section 369.06 of the Saint Paul Legislarive Code is hereby amended to read as follows: Chapter 369. Building Trades Business Licenses Sec. 369.01. Procedures; definitions. PIIRitSUCn � �Ut 2� 1998 The provisions of Chapter 310 of the St. Paul Legislative Code, entitled, "Uniform License Procedures;' shall, where appropriate, be applicable to this chapter, except that certain terms shall be defined as follows: Building o�ciaL Wherever the term "building official" is used in Chapter 310 and in this chapter, it shall be held to mean the head of the division of housing and building code enforc°ament of the departrnent of community services of the City of Saint Paul. Diviszon. Wherever the term "division" is used in Chapter 310 and in this chapter, it shall be held to mean the division of housing and building code enforcement of the department of community services of the City of Saint Paul. Inspector. Wherever the term "inspector" is used in Chapter 310, it shali be held to mean the building official or his designee. Sec. 369.02. License required. Any person, firm or corporation desiring to engage in the business of consiruction, alteration, repair, installation or servicing of any building, shucture or part or accessory thereof, as listed below, shall first obtain a license to engage in such business. Concrete mason and cement finisher. Concrete mason. Cement finisher. (2) Fuel burner equipment and systems installarion and repair: a. Gas: 1. 2. b. Oil: 1. 2. Class A (unlimited capacity) Class B(1,000,000 Btu capacity or less) Note: No new Class B licenses shall be issued; only those persons now holding Class B licenses may renew the Class B license. Class A (unlimited capacity) Class B(1,000,000 Btu capacity or less) Note: No new Class B licenses shall be issued; only those persons now holding Class B licenses may renew the Class B license. c. Fuels other than gas and oil. (3) Plastering (includes lathing and spray-on fireproofing). (4) Plumbing. (5) Refrigeration equipment installation and repair: a. � Class A (unlimited capacity). Class B(60,000 Btu capacity or less). Note: No new Class B licenses shall be issued; only those persons now holding Class B licenses may renew the Class B license. (6) Steamfitting and piping system installation and repair: e� � Class A--Hi-Lo. Class B--Hi-Lo. z 9�-ys9 Note: No new Ciass B licenses shall be issued; only those persons now holding Class B licenses may renew the Class B license. ��) �$) (9) Wann air heating installarion and repair. Venrilation installation and repair. Fire sprinkler installation and repair. Sec. 369.03. Fee. The fee required is one hundred twenty dollars ($120.00), which includes an application processing charge. Sec. 369.04. Licensing requfrements. (a) Application; review; approval. Each applicant shall make application to the building official on such forms and containing such information as the building official shall require, and the requisite fee shall accompany the application. Compliance with the provisions of section 310A2(b) will not be required for the issuance of tius license. The application when completed shall be reviewed by the building official and either approved or rejected. All applicarions shall be kept on file by the division for five (5) yeazs. (b) Certifzcate of competency. Except as hereinafter otherwise provided, an appropriate master's building trades certificate of competency shall be a prerequisite to the issuance of all licenses enumerated 'an section 369.02. Any applicant for such license shall submit the name of the responsible certificate holder to be entered upon the license. Where a license is desired by a partnership, firm or corporation, the certificate holder shall be a responsible full-time employee or a full-time member of the applying firm, parinership or corporation. Failure to maintain a current certificate of competency or the disassociation of the holder from the licensed business shall void the license. (c) Temporary license. Where a certificate of competency is a prerequisite for issuance of a license, the building official may approve the issuance of a temporary license until the time of the next certificate of competency examination, provided: (1) �Z) A determination of the qualifications of the applicant is made; and All other requirements of this chapter aze complied with. Where state licenses aze required, no temporary license shall be issued unless the applicant holds a state license. (d) Insurance requirements. No license granted under this chapter shall become effective until the licensee shall have filed evidence of comprehensive general liability insurance approved as to form by the city attorney, with a combined single limit of liability for bodily injury and property damage of five hundred thousand dollars ($500,000.00). Said policy shall contain a clause that the insurer cannot cancel or change the insurance without first giving the building official thirty (30) days priar notice. It is a misdemeanor violation for anyone to operate a business under a license issued pursuant to this chapter unless such insurance requirements have been complied with. 98-v�s9 1 (e) Reciprocity, warm air heating installafion and repair. Whenever the applicant for a license for 2 wazm air heating installation and repair is licensed or authori in any other municipality of this s tate to __ _ --- 3 engage in sai�business; the ap�canf sTialT6e issuecI a license to engage in that business in the City of Saint 4 Paul upon payment of the requisite fees, provided such municipality has requirements for a license and a 5 certificate of competency equai to those of the CiTy of Saint Paul, as shall be detennined by the building 6 official, and said applicant shall have complied with section 370.15(a) of this Code. 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 Where a licensee operating under the reciprocal arrangement fails to make required corrections after being duly notified by the division where work has been done, such failure or lack of compliance will then be recorded and informarion relative thereto will be forwarded to the locality where the license is held. No license holder shall allow or authorize any employee or other person to do work for which a building trade certificate of competency is required pursuant to Chapter 370 of the St. Paul Legislative Code unless such employee or other person holds the appropriate certificate of competency as required by that chapter or is a registered apprentice as defined in section 370.17. (g) Reciprocity, oil, gas, plumbing, refrigeration, fzre sprinkler and steamfitting. Any applicant for an oil, gas, plumbing, refrigerafion, fire sprinkler or steamfitting license presently holding a valid Minneapolis building trade business license which meets Saint Paul standards for such license, as shall be determined by the boazd of examiuers of both Mimieapolis and Saint Paul, may carry on that busittess in the City o£ Saint Paul upon registration of that license, compliance with section 370.15 of this Code, and payment of the registration fee pursuant to section 369.03 of this chapter; provided, that Minneapolis reciprocates by accepfing the applicable Saint Paul license. If the division requires corrections for work that has been done by a licensee operating under this reciprocal arrangement and the licensee fails to make the required corrections, such failure or lack of compliance may be acted upon by the building official and all information relative thereto may be forwarded to the City of Minneapolis building official. 28 Bxcept as specifically indicated in tYris section, all other provisions of this chapter shall be applicable to 29 licensees operating under this reciprocal arrangement. 30 31 32 33 34 35 36 37 38 39 40 41 42 Sec. 369.05. Speciai situat►ons. (a) Air conditioning. To engage in the business of air conditioning installation, repair or alteration, a bnsiness shaIl be licensed pursuant to the provisions of this chapter for each type of work being performed. (b) Electrical. Although not required by this chapter Yo obtain a building tracles business license, any person, firm or corporation desiring to engage in the business of electrical contracting in the City of Saint Paul shall first obtain an electrical contractor's license from the state board of electricity in accordance with Section 326.242, subdivision 6 of Minnesota Statutes. In order to secure pernuts and perform electrical work in the City of Saint Paul, the electrical contractor shall register with the division and file a certified copy of his Minnesota contractar's license and his Class A electrician license. 43 Sec. 369.06. Expiration and renewal of license. 44 45 46 47 48 49 (a) Ezpiration. All licenses issued under the provisions of this chapter shall expire on the �ast-day �� ��"_ q`� -'�� of the calendar year of issuance unless sooner revoked or forfeited . If a license granted � .. �� _ ��. hereunder is not renewed previous to its eapiration, then all rights granted by such license shall cease. Any person performing work after the �piration of the license is guilty of a misdemeanor. 1 (b) RenewaL Persons, firms and corporations who wish to renew their licenses after the expiration date 2 shall be charged the fixll annual license fee. No pro-rated license fee shall be allowed. 9�_ ys�' � 4 Sec. 369.07. Revocation or suspension of license. 5 6 In addition to those grounds set forth in secrion 310.06(b), the license of any person licensed under the 7 provisions of this chapter shall be zevoked or suspended if his work is found to be improper or defective or so 8 unsafe as to jeopardize life or property. Action to revoke or suspend any such license may be initiated by the 9 building official, and such action shall be carried out in accordance with the procedures outlined in section 10 310.05. 11 12 Sec. 369.08. False representation of being licensed. 13 14 No person shall in any manner advertise, state to or hold out to the public that such person is a licensed 15 elechical contractor, or licensed as a business in any of the building trades as provided in this chapter, unless 16 such person has been licensed under and pursuant to the applicable provisions of this Code. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1 Section 369.06 of the Saint Paul Legislarive Code is hereby amended to read as follows: Chapter 369. Building Trades Business Licenses Sec. 369.01. Procedures; definitions. PIIRitSUCn � �Ut 2� 1998 The provisions of Chapter 310 of the St. Paul Legislative Code, entitled, "Uniform License Procedures;' shall, where appropriate, be applicable to this chapter, except that certain terms shall be defined as follows: Building o�ciaL Wherever the term "building official" is used in Chapter 310 and in this chapter, it shall be held to mean the head of the division of housing and building code enforc°ament of the departrnent of community services of the City of Saint Paul. Diviszon. Wherever the term "division" is used in Chapter 310 and in this chapter, it shall be held to mean the division of housing and building code enforcement of the department of community services of the City of Saint Paul. Inspector. Wherever the term "inspector" is used in Chapter 310, it shali be held to mean the building official or his designee. Sec. 369.02. License required. Any person, firm or corporation desiring to engage in the business of consiruction, alteration, repair, installation or servicing of any building, shucture or part or accessory thereof, as listed below, shall first obtain a license to engage in such business. Class B(60,000 Btu capacity or less). Note: No new Class B licenses shall be issued; only those persons now holding Class B licenses may renew the Class B license. (6) Steamfitting and piping system installation and repair: e� � Class A--Hi-Lo. Venrilation installation and repair. Fire sprinkler installation and repair. Sec. 369.03. Fee. The fee required is one hundred twenty dollars ($120.00), which includes an application processing charge. Sec. 369.04. Licensing requfrements. (a) Application; review; approval. Each applicant shall make application to the building official on such forms and containing such information as the building official shall require, and the requisite fee shall accompany the application. Compliance with the provisions of section 310A2(b) will not be required for the issuance of tius license. The application when completed shall be reviewed by the building official and either approved or rejected. All applicarions shall be kept on file by the division for five (5) yeazs. (b) Certifzcate of competency. Except as hereinafter otherwise provided, an appropriate master's building trades certificate of competency shall be a prerequisite to the issuance of all licenses enumerated 'an section 369.02. Any applicant for such license shall submit the name of the responsible certificate holder to be entered upon the license. Where a license is desired by a partnership, firm or corporation, the certificate holder shall be a responsible full-time employee or a full-time member of the applying firm, parinership or corporation. Failure to maintain a current certificate of competency or the disassociation of the holder from the licensed business shall void the license. (c) Temporary license. Where a certificate of competency is a prerequisite for issuance of a license, the building official may approve the issuance of a temporary license until the time of the next certificate of competency examination, provided: (1) �Z) A determination of the qualifications of the applicant is made; and All other requirements of this chapter aze complied with. Where state licenses aze required, no temporary license shall be issued unless the applicant holds a state license. (d) Insurance requirements. No license granted under this chapter shall become effective until the licensee shall have filed evidence of comprehensive general liability insurance approved as to form by the city attorney, with a combined single limit of liability for bodily injury and property damage of five hundred thousand dollars ($500,000.00). Said policy shall contain a clause that the insurer cannot cancel or change the insurance without first giving the building official thirty (30) days priar notice. It is a misdemeanor violation for anyone to operate a business under a license issued pursuant to this chapter unless such insurance requirements have been complied with. 98-v�s9 1 (e) Reciprocity, warm air heating installafion and repair. Whenever the applicant for a license for 2 wazm air heating installation and repair is licensed or authori in any other municipality of this s tate to __ _ --- 3 engage in sai�business; the ap�canf sTialT6e issuecI a license to engage in that business in the City of Saint 4 Paul upon payment of the requisite fees, provided such municipality has requirements for a license and a 5 certificate of competency equai to those of the CiTy of Saint Paul, as shall be detennined by the building 6 official, and said applicant shall have complied with section 370.15(a) of this Code. 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 Where a licensee operating under the reciprocal arrangement fails to make required corrections after being duly notified by the division where work has been done, such failure or lack of compliance will then be recorded and informarion relative thereto will be forwarded to the locality where the license is held. No license holder shall allow or authorize any employee or other person to do work for which a building trade certificate of competency is required pursuant to Chapter 370 of the St. Paul Legislative Code unless such employee or other person holds the appropriate certificate of competency as required by that chapter or is a registered apprentice as defined in section 370.17. (g) Reciprocity, oil, gas, plumbing, refrigeration, fzre sprinkler and steamfitting. Any applicant for an oil, gas, plumbing, refrigerafion, fire sprinkler or steamfitting license presently holding a valid Minneapolis building trade business license which meets Saint Paul standards for such license, as shall be determined by the boazd of examiuers of both Mimieapolis and Saint Paul, may carry on that busittess in the City o£ Saint Paul upon registration of that license, compliance with section 370.15 of this Code, and payment of the registration fee pursuant to section 369.03 of this chapter; provided, that Minneapolis reciprocates by accepfing the applicable Saint Paul license. If the division requires corrections for work that has been done by a licensee operating under this reciprocal arrangement and the licensee fails to make the required corrections, such failure or lack of compliance may be acted upon by the building official and all information relative thereto may be forwarded to the City of Minneapolis building official. 28 Bxcept as specifically indicated in tYris section, all other provisions of this chapter shall be applicable to 29 licensees operating under this reciprocal arrangement. 30 31 32 33 34 35 36 37 38 39 40 41 42 Sec. 369.05. Speciai situat►ons. (a) Air conditioning. To engage in the business of air conditioning installation, repair or alteration, a bnsiness shaIl be licensed pursuant to the provisions of this chapter for each type of work being performed. (b) Electrical. Although not required by this chapter Yo obtain a building tracles business license, any person, firm or corporation desiring to engage in the business of electrical contracting in the City of Saint Paul shall first obtain an electrical contractor's license from the state board of electricity in accordance with Section 326.242, subdivision 6 of Minnesota Statutes. In order to secure pernuts and perform electrical work in the City of Saint Paul, the electrical contractor shall register with the division and file a certified copy of his Minnesota contractar's license and his Class A electrician license. 43 Sec. 369.06. Expiration and renewal of license. 44 45 46 47 48 49 (a) Ezpiration. All licenses issued under the provisions of this chapter shall expire on the �ast-day �� ��"_ q`� -'�� of the calendar year of issuance unless sooner revoked or forfeited . If a license granted � .. �� _ ��. hereunder is not renewed previous to its eapiration, then all rights granted by such license shall cease. Any person performing work after the �piration of the license is guilty of a misdemeanor. 1 (b) RenewaL Persons, firms and corporations who wish to renew their licenses after the expiration date 2 shall be charged the fixll annual license fee. No pro-rated license fee shall be allowed. 9�_ ys�' � 4 Sec. 369.07. Revocation or suspension of license. 5 6 In addition to those grounds set forth in secrion 310.06(b), the license of any person licensed under the 7 provisions of this chapter shall be zevoked or suspended if his work is found to be improper or defective or so 8 unsafe as to jeopardize life or property. Action to revoke or suspend any such license may be initiated by the 9 building official, and such action shall be carried out in accordance with the procedures outlined in section 10 310.05. 11 12 Sec. 369.08. False representation of being licensed. 13 14 No person shall in any manner advertise, state to or hold out to the public that such person is a licensed 15 elechical contractor, or licensed as a business in any of the building trades as provided in this chapter, unless 16 such person has been licensed under and pursuant to the applicable provisions of this Code.
