This aency was first established as one of the pioneer aencies representin The St. Paul Companies. Since that time, many quality insurance companies have joined force with our aency. Toether we use the latest in technology to offer our customers the finest service. Direct electronic interface with the companies' mainframe and 24-hour claim response service render outstanding policy manaement. Our agency has over 50 years underwriting experience. Clients feel at ease knowing that this experience enables us find many overlooked exposures and close the loopholes that these present. Our office buildin that we currently occupy at 1100 West Seventh has been sold. We would like to stay in the area and build a new building. We believe the undeveloped site on the Northwest corner of West Seventh & Rogers Avenue in St. Paul would be an excellent location for a new professional office building that wil] fit with the surrounding residences. It is my intention to build a single story Professional Office building with approximately 4000 square feet to house the $uchmeier Insurance Agency. There would also be parking for 15 vehicles on site. The property is currently zoned RM-2 apartment residential five stories or less and I wish to re-zone this property to OS-1 executive office. I respectfully request your consent in favor of this zonin chane. Please review this rezoning application with careful consideration. Sincerely, i ` i + i'"""". The Buchmeier Agency Inc has an option to purchase the property contingent on getting the property rezoned. If the property is rezoned, Buchmeier Agency Inc. intends to construct a single story professional office building of approximately 4,000 squaze feet to house the Buchmeier Insurance Agency. Preliminary site plans show there would be 16 pazking spaces on site. Hours of operation would be 9:00 a.m. to 5:00 p.m., Monday through Friday. The Buchmeier Agency Inc has secured a copy of the Fort Road Design Guidelines. However, in its attempt to save as many oak trees as possible, the siting of the building will not follow the front zero lot line setbacks recommended for commercial buildings. The proposed` setbacks correspond to adyacent commercial bnildings east aiid south of the ' site. _ .. 2. The rezoning is, on balance, consistent with the comprehensive plan. The Economic Development Strategy includes: 1) Objective 6, "ensure sufficient land for future business growth"; 2} Policy #25. Objectives of the Brewery/Ran-View Small Area Plan include: On West Seventh Street, 1) continue to encourage the construction or rehabilitation ofpedestrian scale buildings built at the property line to maintain the existing pattern." 3. The rezonin is consistent and compatible with the way the area has developed. This portion of West Seventh is interspersed with commercial and residential uses. Across the sireet to the southwest is the entrance to the new Crosby Lake Industrial Pazk. Approximately 11,100 vehicles travel this stretch of West Seventh each day. 4. The rezoning will not have an adverse impact on the surrounding area. The site plan submitted by Buchmeier Agency Inc. demonstrates its attempt to preserve the oak trees and much of the site in its natural state. If sita p1an changes aze necessary to mitigate . any Impact on sturounding Ind uses, the property is lazge enough to accommodate any modificataons. 5. The proposed development will require site plan review approval. This review has been delegated from the Planning Commission to the Planning Administrator. Rezone the property from RM-2 (residsential multiple-family) to OS-1 (o£fice-service) to allow a new single office building. Jim Zdon, PED, Southwest Quadrant, reviewed the staff report and presented slides. Staff recommended approval o£ the rezoning petition based on £indings 1 through 6 0£ the staff report. The West Seventh/Fort Road Federation did not intend to take a position on the rezoning application. Mr. Zdon reported that he'd received a phone call from Mr. Benkler, a neighbor across the street from the proposed property, who was opposed and expressed • concern.that he had not seen the final site plan and construction plans. . Greg Hudalla, President, Buchmeier Agency, Inc., the applicant, spoke. Mr. Hudalla reviewed that they have been in the neighborhood since 1902, have been displaced with the sale of their office building and wish to remain in Che area and build a new building at the proposed location. He reviewed that they have received no opposition from any of the neighbors to the rezoning, however noted that Mr. Benkler refused to sign their petition. Mr. Hudalla, in response to a question £rom Commissioner Gordon, noted that the building will be a multi-tenant building. Commissioner Gordon asked how many of the 27 oak trees would be preserved. :.' Mr. Hudalla said that they are attempting to preserve the f'ront 30 £eet'of oak . trees with a 30 foot setback from the sidewalk, which wi11 result in 35 feet .. £rom the front property line, which includes the sidewalk. Some interior trees will be lost, and some o£ those are diseased aad would be removed zegardless. Commissioner Vaught moved approval of the rezoning petition. Commissioner Wenc1 secanded the motion. "The city's land usaplan should provide adequate land for industrial and commercial development and expansion in orfler to ° moved by Field secoried by Unanimous c31C1St t -\rq • increase the proportion of commercial/industrial tax base'; 3) Policy #29, "the city should periodically reviec its zoning regulation and amend them as necessary to keep cuent with technological and economic changes affectin the nature of business activity (pP.17-18) Objectives of the District 9 plan include: 1) "Gear new construction to increasing housin, public, or commercial sercices, or emplo} ment opportunities for ,Vest Seventh residents, but do so without disrupting existing residential development". P.1. 2) " Some mix of different kinds of housing and commercial is healthy for all azeas of Uest Seventh". P.S. It appears the standards for site plan approval can be met. 6. The motion carried with a unanimous voice vote of 6 to 0. Drafted by: Submi d by: Approve b. --So..tr • Donna Sanders . F. HISTORY/DISCIISSION: In 1976 the Planning Commission and City Council both voted to deny an application to rezone the property from RM-2 to B- 3. The rezoning application was for the purpose o£ constructing a Sambo's restaurant. G DISTRICT COIINCIL RECO2+AfENDAT20N: The West Seventh/FOrt Rpad Federation will not be formally reviewing this re2oning case. H FINDINGS: 1. The Buchmeier Agency Inc has an option to purchase the property contingent on getting the property rezoned. If the property is rezoned, Buchmeier Agency Inc. intends to construct a single story professional office building of approximately 4,000 square feet to house the Buchmeier Insurance Agency. Preliminary site plans show there would be 16 parking spaces on site. However, the proposed setbacks correspond to adjacent commercial buildings east and south of the site. 2. The rezoning is, on balance, consistent with the comprehensive plan. The Economic Development Strategy includes: 1) Objective 6, "ensure sufficient land for future business growth"; 2) Policy #25. "The city's land use plan should provide adequate land for industrial and commercial development and expansion in order to increase the proportion of commercial/industrial tax base'; 3) Policy #29, "the city should periodically review its zoning regulation and amend them as necessary to keep current with technological and economic changes affectim3 the nature of business activity" (pp.17-18) Objectives of the District 9 plan include: 1) "Gear new construction to increasing housing, public, or commercial services, or employment opportunities for West Seventh residents, but do so without disrupting existing residential development". P.1. 2) " Some mix of different kinds of and commercial is healthy for all areas of West Seventh". P_5. Objectives of the Brewery/Ran-View Small Area Plan include: On West Seventh Street, 1) continue to encourage the construction or rehabilitation of pedestrian scale buildings built at the property line to maintain the existing pattern." • 3. The rezoning is consistent and compatible with the way the area has developed. This portion of West Seventh is interspersed with commercial and residential uses. Across the street to the southwest is 2-1 , .. • the enCrance to the new Crosby Lake Zndustrial Park. Approximately 11,100 vehicles travel this stretch of West Seventh each day. 4. The rezoning will not have an adverse impact on the surrounding area. The site plan submitted by Buchmeier Agency Inc. demonstrates iCs attempt to preserve the oak trees and much of the site in its natural state. If site plan changes are necessary to mitigate any impact on surrounding land uses, the property is large enough to accommodate any modifications. 5. The proposed development will require site plan review approval. This review has been delegated from the Planning Commission to the Planning Administrator. It appears the standards for site plan approval can be met. 6. The applicant submitted a sufficient petition of two-thirds of the property owners within one hundred (100) feet of the property stating support for the rezoning (24 parcels eligible, 16 parcels required, and 19 paraels signed). I. STAFF RECOD41&NDATION: Based on findings 1 through 6 staff recommends approval of the rezoning petition. s 2` C J • • PETITION TO AMEND THE ZONIN6 CODE Aepatment of Planning and Economic Development Zoning Section IZ00 City Hall Annex 25 West Fourth Streef Saint Paul, M1V SSIO2 266-6589 APPLICANT Property Owner Ju H.
