An ordinance amending Chapter 60 of the Saint Paul Legislative Code pertaining to zoning for the City of
Saint Paul and the zoning maps thereof:
WF3EREAS, Pursuant to Minnesota Statutes {462357 and 64.400 of the Legislative Code, LEE, N H. duly
petitioned to rezone 1567 7TH ST W being legally described as Lots 24 tluu 30, Block 9, Birmingham's
Fourth Addition from RM-2 (residential mulfiple-family) to OS-1 (office-service) to allow a new single story
office building, the petition having been certified by the Planning Division on 11/19/97 as hauing been
consented to by at least 67% of the owners of the azea of the property to be rezoned, and fiirther having been
consented to by at least two-thirds of the owners of the properiy situated witivn 100 feet of the total
contiguous properiy within one year proceeding the date of the petition; and
WHEREAS, The Zoning Committee of the Planning Commission on 12l29(97, held a public hearing for the
purpose of considering the rezoning perition, and pursuant to { 107.03 of the Admiuistrative Code, submitted
its recommendation to the Planning Commission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning petition at its meeting held on 1/91/98 and
recommended that the City Council approve the petition; and
WHEREAS, notice of public hearing before the City Council on the said rezoning petition was duly
published in the official newspaper of the City on 1/24/98 and notices were duly mailed to each owner of
affected property and property situated wholly or partly witlun 350 feet of the property sought to be rezoned;
and
WIIEREAS, a public hearing before the City Council having been conducted on 2/4/98, where all interested
parties were heard, the Council having considered all the facts and recommendations concerning the petition;
now, therefore
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul, Sheet Number 35, as incorporated by reference in {60301
of the Saint Paul Legislative Code, as amended, is hereby fiuther amended as follows:

Planning Commission held a pub(ic hearing on the proposed rezoning on December 29, 1997. The
deueloper addressed the committee. At the close of the public hearing, the commiitee voted 6-0 to
recommend approval to rezone to OS-1. The Planning Commission upheld the Zoning Committee`s
recommendation for approval on a unanimous vote on Jannary 9, 1998.
This proposed rezoning is scheduled to be heard by the City Council on February 4,1998. Please notify

�VHEREAS, LEE, N H. file # 97-310 has petitioned to rezone 1567 7TH ST W situated on the
northwesterly comer of West 7th Street and Rogers Street for the purpose of rezoning the
property from RM-2 (residential multiple-family) to OS-1 (office-service) to allow a new single
story office building.; and
WHEREAS, the Zoning Committee of the Planning Commission on 12/29/97, held a public
hearing at which all persons present were given an opportunity to be heard pursuant to said
application in accordance with the requirements of Section 64.400 of the Saint Paul Legislative
Code; and
WHEREAS, Saint Paul Planning Commission, based on the evidence presented to its Zoning
Committee at the public hearing as substantially reflected in the minutes, made the following
findings of fact:
� 1. The Buchmeier Agency Inc has an option to purchase the property contingent on
getting the property rezoned. If the property is rezoned, Buchmeier Agency Inc. intends
to construct a single story professional office building of approximately 4,000 squaze feet
to house the Buchmeier Insurance Agency. Preliminary site plans show there would be
16 pazking spaces on site. Hours of operation would be 9:00 a.m. to 5:00 p.m., Monday
through Friday.
The Buchmeier Agency Inc has secured a copy of the Fort Road Design Guidelines.
However, in its attempt to save as many oak trees as possible, the siting of the building
will not follow the front zero lot line setbacks recommended for commercial buildings.

2. The rezoning is, on balance, consistent with the comprehensive plan. The

Objectives of the District 9 plan include: 1) "Gear new construction to increasing
housin�, public, or commercial serc�ices, or emplo} ment opportunities for �,Vest Seventh
residents, but do so without disrupting existing residential development". P.1. 2) " Some
mix of different kinds of housing and commercial is healthy for all azeas of �Uest
Seventh". P.S. Objectives of the Brewery/Ran-View Small Area Plan include: On West
Seventh Street, 1) continue to encourage the construction or rehabilitation ofpedestrian
scale buildings built at the property line to maintain the existing pattern."
3. The rezonin� is consistent and compatible with the way the area has developed.
This portion of West Seventh is interspersed with commercial and residential uses.
Across the sireet to the southwest is the entrance to the new Crosby Lake Industrial Pazk.
Approximately 11,100 vehicles travel this stretch of West Seventh each day.
4. The rezoning will not have an adverse impact on the surrounding area. The site
plan submitted by Buchmeier Agency Inc. demonstrates its attempt to preserve the oak
trees and much of the site in its natural state. If sita p1an changes aze necessary to mitigate
. any Impact on sturounding I�nd uses, the property is lazge enough to accommodate any
modificataons.
5. The proposed development will require site plan review approval. This review has
been delegated from the Planning Commission to the Planning Administrator. It appears
the standards for site plan approval can be met.
6. The applicant submitted a sufficient petition of two-thirds of the property owners
within one hundred (100) feet of the property stating support for the rezoning (24 pazceis
eligible, 16 parcels required, and 19 parcels signed).

Jim Zdon, PED, Southwest Quadrant, reviewed the staff report and presented
slides. Staff recommended approval o£ the rezoning petition based on £indings
1 through 6 0£ the staff report.
The West Seventh/Fort Road Federation did not intend to take a position on the
rezoning application.
Mr. Zdon reported that he'd received a phone call from Mr. Benkler, a neighbor
across the street from the proposed property, who was opposed and expressed
• concern.that he had not seen the final site plan and construction plans. .
Greg Hudalla, President, Buchmeier Agency, Inc., the applicant, spoke. Mr.
Hudalla reviewed that they have been in the neighborhood since 1902, have been
displaced with the sale of their office building and wish to remain in Che
area and build a new building at the proposed location. He reviewed that they
have received no opposition from any of the neighbors to the rezoning, however
noted that Mr. Benkler refused to sign their petition.
Mr. Hudalla, in response to a question £rom Commissioner Gordon, noted that
the building will be a multi-tenant building.
Commissioner Gordon asked how many of the 27 oak trees would be preserved.
:.' Mr. Hudalla said that they are attempting to preserve the f'ront 30 £eet'of oak
. trees with a 30 foot setback from the sidewalk, which wi11 result in 35 feet
.. £rom the front property line, which includes the sidewalk. Some interior
trees will be lost, and some o£ those are diseased aad would be removed
zegardless.
Commissioner Vaught moved approval of the rezoning petition. Commissioner
Wenc1 secanded the motion. The motion carried with a unanimous voice vote
of 6 to 0.

4. The rezoning will not have an adverse impact on the surrounding
area. The site plan submitted by Buchmeier Agency Inc. demonstrates iCs
attempt to preserve the oak trees and much of the site in its natural
state. If site plan changes are necessary to mitigate any impact on
surrounding land uses, the property is large enough to accommodate any
modifications.
5. The proposed development will require site plan review approval.
This review has been delegated from the Planning Commission to the
Planning Administrator. It appears the standards for site plan approval
can be met.
6. The applicant submitted a sufficient petition of two-thirds of the

WF3EREAS, Pursuant to Minnesota Statutes {462357 and 64.400 of the Legislative Code, LEE, N H. duly

WHEREAS, The Zoning Committee of the Planning Commission on 12l29(97, held a public hearing for the
purpose of considering the rezoning perition, and pursuant to { 107.03 of the Admiuistrative Code, submitted
its recommendation to the Planning Commission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning petition at its meeting held on 1/91/98 and
recommended that the City Council approve the petition; and
WHEREAS, notice of public hearing before the City Council on the said rezoning petition was duly
published in the official newspaper of the City on 1/24/98 and notices were duly mailed to each owner of

deueloper addressed the committee. At the close of the public hearing, the commiitee voted 6-0 to
recommend approval to rezone to OS-1. The Planning Commission upheld the Zoning Committee`s
recommendation for approval on a unanimous vote on Jannary 9, 1998.
This proposed rezoning is scheduled to be heard by the City Council on February 4,1998. Please notify

�VHEREAS, LEE, N H. file # 97-310 has petitioned to rezone 1567 7TH ST W situated on the
northwesterly comer of West 7th Street and Rogers Street for the purpose of rezoning the
property from RM-2 (residential multiple-family) to OS-1 (office-service) to allow a new single
story office building.; and
WHEREAS, the Zoning Committee of the Planning Commission on 12/29/97, held a public
hearing at which all persons present were given an opportunity to be heard pursuant to said
application in accordance with the requirements of Section 64.400 of the Saint Paul Legislative
Code; and
WHEREAS, Saint Paul Planning Commission, based on the evidence presented to its Zoning
Committee at the public hearing as substantially reflected in the minutes, made the following
findings of fact:
� 1. The Buchmeier Agency Inc has an option to purchase the property contingent on
getting the property rezoned. If the property is rezoned, Buchmeier Agency Inc. intends
to construct a single story professional office building of approximately 4,000 squaze feet
to house the Buchmeier Insurance Agency. Preliminary site plans show there would be
16 pazking spaces on site. Hours of operation would be 9:00 a.m. to 5:00 p.m., Monday
through Friday.
The Buchmeier Agency Inc has secured a copy of the Fort Road Design Guidelines.
However, in its attempt to save as many oak trees as possible, the siting of the building
will not follow the front zero lot line setbacks recommended for commercial buildings.

Seventh Street, 1) continue to encourage the construction or rehabilitation ofpedestrian
scale buildings built at the property line to maintain the existing pattern."
3. The rezonin� is consistent and compatible with the way the area has developed.
This portion of West Seventh is interspersed with commercial and residential uses.
Across the sireet to the southwest is the entrance to the new Crosby Lake Industrial Pazk.
Approximately 11,100 vehicles travel this stretch of West Seventh each day.
4. The rezoning will not have an adverse impact on the surrounding area. The site
plan submitted by Buchmeier Agency Inc. demonstrates its attempt to preserve the oak
trees and much of the site in its natural state. If sita p1an changes aze necessary to mitigate
. any Impact on sturounding I�nd uses, the property is lazge enough to accommodate any
modificataons.
5. The proposed development will require site plan review approval. This review has
been delegated from the Planning Commission to the Planning Administrator. It appears
the standards for site plan approval can be met.
6. The applicant submitted a sufficient petition of two-thirds of the property owners
within one hundred (100) feet of the property stating support for the rezoning (24 pazceis
eligible, 16 parcels required, and 19 parcels signed).

slides. Staff recommended approval o£ the rezoning petition based on £indings
1 through 6 0£ the staff report.
The West Seventh/Fort Road Federation did not intend to take a position on the
rezoning application.
Mr. Zdon reported that he'd received a phone call from Mr. Benkler, a neighbor
across the street from the proposed property, who was opposed and expressed
• concern.that he had not seen the final site plan and construction plans. .
Greg Hudalla, President, Buchmeier Agency, Inc., the applicant, spoke. Mr.
Hudalla reviewed that they have been in the neighborhood since 1902, have been
displaced with the sale of their office building and wish to remain in Che
area and build a new building at the proposed location. He reviewed that they
have received no opposition from any of the neighbors to the rezoning, however
noted that Mr. Benkler refused to sign their petition.
Mr. Hudalla, in response to a question £rom Commissioner Gordon, noted that
the building will be a multi-tenant building.
Commissioner Gordon asked how many of the 27 oak trees would be preserved.
:.' Mr. Hudalla said that they are attempting to preserve the f'ront 30 £eet'of oak
. trees with a 30 foot setback from the sidewalk, which wi11 result in 35 feet
.. £rom the front property line, which includes the sidewalk. Some interior
trees will be lost, and some o£ those are diseased aad would be removed
zegardless.
Commissioner Vaught moved approval of the rezoning petition. Commissioner
Wenc1 secanded the motion. The motion carried with a unanimous voice vote
of 6 to 0.

An ordinance amending Chapter 60 of the Saint Paul Legislative Code pertaining to zoning for the City of
Saint Paul and the zoning maps thereof:
WF3EREAS, Pursuant to Minnesota Statutes {462357 and 64.400 of the Legislative Code, LEE, N H. duly
petitioned to rezone 1567 7TH ST W being legally described as Lots 24 tluu 30, Block 9, Birmingham's
Fourth Addition from RM-2 (residential mulfiple-family) to OS-1 (office-service) to allow a new single story
office building, the petition having been certified by the Planning Division on 11/19/97 as hauing been
consented to by at least 67% of the owners of the azea of the property to be rezoned, and fiirther having been
consented to by at least two-thirds of the owners of the properiy situated witivn 100 feet of the total
contiguous properiy within one year proceeding the date of the petition; and
WHEREAS, The Zoning Committee of the Planning Commission on 12l29(97, held a public hearing for the
purpose of considering the rezoning perition, and pursuant to { 107.03 of the Admiuistrative Code, submitted
its recommendation to the Planning Commission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning petition at its meeting held on 1/91/98 and
recommended that the City Council approve the petition; and
WHEREAS, notice of public hearing before the City Council on the said rezoning petition was duly
published in the official newspaper of the City on 1/24/98 and notices were duly mailed to each owner of
affected property and property situated wholly or partly witlun 350 feet of the property sought to be rezoned;
and
WIIEREAS, a public hearing before the City Council having been conducted on 2/4/98, where all interested
parties were heard, the Council having considered all the facts and recommendations concerning the petition;

Planning Commission held a pub(ic hearing on the proposed rezoning on December 29, 1997. The
deueloper addressed the committee. At the close of the public hearing, the commiitee voted 6-0 to
recommend approval to rezone to OS-1. The Planning Commission upheld the Zoning Committee`s
recommendation for approval on a unanimous vote on Jannary 9, 1998.
This proposed rezoning is scheduled to be heard by the City Council on February 4,1998. Please notify

�VHEREAS, LEE, N H. file # 97-310 has petitioned to rezone 1567 7TH ST W situated on the
northwesterly comer of West 7th Street and Rogers Street for the purpose of rezoning the
property from RM-2 (residential multiple-family) to OS-1 (office-service) to allow a new single
story office building.; and
WHEREAS, the Zoning Committee of the Planning Commission on 12/29/97, held a public
hearing at which all persons present were given an opportunity to be heard pursuant to said
application in accordance with the requirements of Section 64.400 of the Saint Paul Legislative
Code; and
WHEREAS, Saint Paul Planning Commission, based on the evidence presented to its Zoning
Committee at the public hearing as substantially reflected in the minutes, made the following
findings of fact:
� 1. The Buchmeier Agency Inc has an option to purchase the property contingent on
getting the property rezoned. If the property is rezoned, Buchmeier Agency Inc. intends
to construct a single story professional office building of approximately 4,000 squaze feet
to house the Buchmeier Insurance Agency. Preliminary site plans show there would be
16 pazking spaces on site. Hours of operation would be 9:00 a.m. to 5:00 p.m., Monday
through Friday.
The Buchmeier Agency Inc has secured a copy of the Fort Road Design Guidelines.
However, in its attempt to save as many oak trees as possible, the siting of the building
will not follow the front zero lot line setbacks recommended for commercial buildings.

scale buildings built at the property line to maintain the existing pattern."
3. The rezonin� is consistent and compatible with the way the area has developed.
This portion of West Seventh is interspersed with commercial and residential uses.
Across the sireet to the southwest is the entrance to the new Crosby Lake Industrial Pazk.
Approximately 11,100 vehicles travel this stretch of West Seventh each day.
4. The rezoning will not have an adverse impact on the surrounding area. The site
plan submitted by Buchmeier Agency Inc. demonstrates its attempt to preserve the oak
trees and much of the site in its natural state. If sita p1an changes aze necessary to mitigate
. any Impact on sturounding I�nd uses, the property is lazge enough to accommodate any
modificataons.
5. The proposed development will require site plan review approval. This review has
been delegated from the Planning Commission to the Planning Administrator. It appears
the standards for site plan approval can be met.

within one hundred (100) feet of the property stating support for the rezoning (24 pazceis

slides. Staff recommended approval o£ the rezoning petition based on £indings
1 through 6 0£ the staff report.
The West Seventh/Fort Road Federation did not intend to take a position on the
rezoning application.
Mr. Zdon reported that he'd received a phone call from Mr. Benkler, a neighbor
across the street from the proposed property, who was opposed and expressed
• concern.that he had not seen the final site plan and construction plans. .
Greg Hudalla, President, Buchmeier Agency, Inc., the applicant, spoke. Mr.
Hudalla reviewed that they have been in the neighborhood since 1902, have been
displaced with the sale of their office building and wish to remain in Che
area and build a new building at the proposed location. He reviewed that they
have received no opposition from any of the neighbors to the rezoning, however
noted that Mr. Benkler refused to sign their petition.
Mr. Hudalla, in response to a question £rom Commissioner Gordon, noted that
the building will be a multi-tenant building.
Commissioner Gordon asked how many of the 27 oak trees would be preserved.
:.' Mr. Hudalla said that they are attempting to preserve the f'ront 30 £eet'of oak
. trees with a 30 foot setback from the sidewalk, which wi11 result in 35 feet
.. £rom the front property line, which includes the sidewalk. Some interior
trees will be lost, and some o£ those are diseased aad would be removed
zegardless.
Commissioner Vaught moved approval of the rezoning petition. Commissioner
Wenc1 secanded the motion. The motion carried with a unanimous voice vote

Our office buildin� that we currently occupy at 1100 West Seventh has been sold. We
would like to stay in the area and build a new building. We believe the undeveloped site
on the Northwest corner of West Seventh & Rogers Avenue in St. Paul would be an
excellent location for a new professional office building that wil] fit with the surrounding
residences.
It is my intention to build a single story Professional Office building with approximately
4000 square feet to house the $uchmeier Insurance Agency. There would also be parking
for 15 vehicles on site.
The property is currently zoned RM-2 apartment residential five stories or less and I wish
