WHEREAS, Pursuant to Minnesota Statutes §462357 and §64.400 of the Legislative Code, MARK FL3I-IR
duly petitioned to rezone 399 RUTH STREET being legally described as Lot 1 and the East 150 ft. of Lot 2,
Block 8, Hudson Road Gazdens from P-1 to B-3, and from OS-1 to B-3 and RM-2, for the purpose of
permitting construction of an Amoco Certicaze auto repair station, the petition having been certified by the
Planning Division on July 20, 1998, as having been consented to by at least 67% of the owners of the area of
the property to be rezoned, and fiirther having been consented to by at least two-thirds of the owners of the
property situated within 100 feet of the total contiguous properry within one year proceeding the date of the
perition; and
14 WHEREAS, The Zoning Committee of the Planning Commission held a public hearing on August 20, 1998,
15 far the purpose of considering the rezoning petition, and pursuant to § 107.03 of the Administrative Code,

WHEREAS, The Planning Commission considered the rezoning petition at its meeting held on August 28,
1998, and recommended that the City Council approve the petition; and
WHEREAS, notice of public hearing before the City Council on the said rezoning petition was duly
published in the official newspaper of the City on October 3, 199�, and notices were duly mailed to each
owner of affected property and property situated wholly or partly within 350 feet of the property sought to be
rezoned;and
WIIEREAS, a public hearing before the City Council having been conducted on October 14, 1998, where all
interested parties were heazd, and the Council having considered all the facts and recommendations
concerning the petition; now, therefore

MARK FUHR submitted a petition to rezone property at 399 RUTH STREET. The Zoning Committee
of the Planning Commission held a public hearing on the proposed rezoning on August 20, 1998. The
applicant addressed the committee. At the close of the public hearing, the committee voted 6-0 to
recommend approva( of the proposed rezoning to B-3 and RM-2. The Planning Commission upheld the
Zoning Committee's recommendation for approval on a unanimous vote on Au�ust 28, 1998.
This proposed rezoning is scheduled to be heard by the City Council on October 14, 1998. Please notify

hearin� at which all persons present w�ere given an opportunity to be heard pursuant to said
application in accordance �vith the requirements of Section 64.400 of the Saint Paul Legislative
Code; and
WHEREAS, the Saint Paul Planning Commission, based on the evidence presented to its Zonin�
Committee at the public hearing as substantially reflected in the minutes, made the followin�
findin�s of fact:

The applicant intends to construct and operate an Amoco Certicare auto repair station on �
the eastem 150 feet of the property that fronts on Ruth Street, for which he is requestin�
B-3 zonin�. The existing auto repair facility across Ruth Street at Sunray Amoco will be
moved into this facility. The auto repair space in the Sunray Amoco station will be
converted to an auto convenience market.
There is a lazge grade change down to the westem part of the site along Wilson-Avenue,
for which the applicant is requestin� RM-2 zoning. The RiVI-2 zonin� is consistent with
the adjacent RM-2 zoning. The applicant is proposing to divide this area into tu�o lots,
�chich would provide for possible future construction of two duplexes.
Section 60.544 (18) of the Zoning Code permits automobile repair facilities as permitted
uses subject to special conditions under B-3 zoning, subject to the following conditions:
(a) the minimum lot area shall be fifreen thousand (15,000) square feet; (b) a ten-foot
landscaped buffer with screed planting and an obscuring fence shall be required along an}
properry line adjoinin� an existing residence or adjoining land zoned residential; (c) all
repair w shall be done within an enclosed building; and (d) there shall be no outside
storage. The proposed site has the potential of ineeting all of the required conditions, and
the applicant intends to meet all of the required conditions.

� 4. The rezoning is consistent with the comprehensive plan. The Economic Development
Strategy (pp. 17-18) includes: 1) Objective #6, "ensure sufficient land for future business
grow 2) Policy #25, "the city's land use plan should provide adequate land for
industrial and commercial development and expansion in order to increase the proportion
of commercial/industrial tax base;" and 3) Policy �29, "the city should periodically
review its zonina regulations and amend them as necessary to keep current �aith
technological and economic chan�es affzcting the nature of business activity."
The proposed rezoning is consistent and compatible w�ith the «•ay the area has developed.
The proposed Ri�f-2 zoning of the por[ion of the property belo�v the hiil along Wilson
Avenue is consistent with the R iVI-2 zoning of adjacent property. The proposed Bv
zonin� of the portion of the propert}' at the top of the hill along Ruth Street is consistent
with the B-3 zonin� of adjacent property�. Across Ruth Street to the east of the site is the
back side of a long gazage structure servine a lazge apartment complex.
In addition, there is a significant amount of traffic in the azea. With free�vay entrance and
exit ramps just south of the site, Ruth Street carries 862� vehicles per day, and I-94
carries about 108,000 vehicles per day. A business located on this site w�ould have good
access and visibility.
� 6. The rezoning will not have an adverse impact on adjacent property. There is a si�nificant
grade chan�e bet�ti•een the commercial part of the site along Ruth Street and adjacent
residential property to the west, and the proposed auto repair station w�ill be required to
have appropriate landscaping and screenin�.
The applicant submitted a sufficient petition of two-thirds of the property owners within
one hundred (100) feet of the property to be rezoned stating support for the rezoning
(11 parcels eligible, 8 pazcels required, and 8 parcels signed).
NO`d, THEREFORE, BE IT RESOLVED, by the Saint Pau1 Plannin� Commission that the
petition of MARK FUHR to rezone propertv at 399 RUTH STREET, at the southwest comer of
Ruth Street and �/ilson Avenue, from a P-1 zonin� classification to a B-3 zoning classification
and from an OS-1 zonine classification to a B-3 and an RM-2 zoning classification is consistent

2, from P-1 (Vehicular Parking) to B-3 (General Business).
MARK FUHR - Zoning File 98 - 189 - Special Condition Use Permit to allow operation of an auto
repair station.
Allan Torstenson, PED, gave a sfide presentation and reviewed the staff report. Mr. Torstenson
explained that the discussion would be on both cases, however file 98-188, the zoning issue would
be the only one voted upon. Upon City Council approval of the necessary rezoning, the Special
Condition Use Permit appiication will be handled administratively as delegated by Planning
Commission resolution #84-23 to avoid duplicative hearings "in all cases where public hearings
recommended and the City Council has approved a rezoning specifically for a Special Condition
Use.
Upon question of Commissioner Morton, Mr. Torstenson stated that the applicant, Mr. Fuhr would
be agreeable to RT-2 zoning for the portion of Lot 1 to be rezoned residential. Mr. Torstenson had
recommended RM-2 because it is consisfent wifh adjacenf zoning and allows for reasonable
options.
The applicant, Mark Fuhr of 2353 Rice Street, Suite 103, Roseville, appeared.
No one appeared in opposition, and the public hearing was closed.
Commissioner Morton moved approval of the staff recommendation and the motion was seconded
by Cammissioner Wencl.
There was no further discussion, and the motion was calfed recommending approval.

A. PURPOSE: Rezoning From OS-1 to B-3 and RM-2, and from P-1 to B-3 to allow
construction and operation of an auto repair station,
B. PARCEL SIZE: This L-shaped parcel has 240' of frontaoe along Ruth Street, 297' of
frontage along Wilson Avenue, and a total area of 53,677 sq. feet. The portion to be
rezoned to B-3 has 240' of frontage along Ruth St., 150' of frontage along Wilson Ave.,
and a total area of 36,000 sq. feet. The portion of the parcel to be rezoned RM-2 has 147'
of frontage along Wilson Ave., is 120 feet deep, and has an area of 17,677 sq. feet.
C. EXISTING LAND USE: The 18,000 sq. foot P-1 portion of the property with 120' of
frontage along Ruth Street is paved, fenced and used for pazking for the existing auto
repair business at the Amoco station across the street at the NW comer of Ruth Street and
Old Hudson Road. The 35,677 sq. foot OS-1 portion of the property with 120' of
fronta�e along Ruth Street and 297 feet of frontage along Wilson Avenue is vacant.
D. SURROUNDING LAND USE:
North: Single-family homes (R-3)
East: Apartment complex gara�es (RVI-2)

E. ZONING CODE CITATION: Section 64.400 (a) states in part that "the council may, �
from time to time, amend, supplement of change the district boundazies of the regulations
herein, or subsequently established herein pursuant to the pro��isions of Minnesota
Statutes Section 462.357 and amendments thereto as may be made from time to time.
The ptanning commission may, from time to time, review district boundary lines to
determine if, pursuant to state laws, such district boundary lines should be changed."
Section 64.400 (b) states in part that "an amendment to the zoning code may be initiated
by the council, the planning commission or by petition of the owners of sixty-seven (67)
percent of the area of the property to be rezoned."

WHEREAS, Pursuant to Minnesota Statutes §462357 and §64.400 of the Legislative Code, MARK FL3I-IR
duly petitioned to rezone 399 RUTH STREET being legally described as Lot 1 and the East 150 ft. of Lot 2,
Block 8, Hudson Road Gazdens from P-1 to B-3, and from OS-1 to B-3 and RM-2, for the purpose of
permitting construction of an Amoco Certicaze auto repair station, the petition having been certified by the
Planning Division on July 20, 1998, as having been consented to by at least 67% of the owners of the area of
the property to be rezoned, and fiirther having been consented to by at least two-thirds of the owners of the
property situated within 100 feet of the total contiguous properry within one year proceeding the date of the
perition; and

WHEREAS, The Planning Commission considered the rezoning petition at its meeting held on August 28,
1998, and recommended that the City Council approve the petition; and
WHEREAS, notice of public hearing before the City Council on the said rezoning petition was duly
published in the official newspaper of the City on October 3, 199�, and notices were duly mailed to each
owner of affected property and property situated wholly or partly within 350 feet of the property sought to be
rezoned;and
WIIEREAS, a public hearing before the City Council having been conducted on October 14, 1998, where all
interested parties were heazd, and the Council having considered all the facts and recommendations
concerning the petition; now, therefore

of the Planning Commission held a public hearing on the proposed rezoning on August 20, 1998. The
applicant addressed the committee. At the close of the public hearing, the committee voted 6-0 to
recommend approva( of the proposed rezoning to B-3 and RM-2. The Planning Commission upheld the
Zoning Committee's recommendation for approval on a unanimous vote on Au�ust 28, 1998.
This proposed rezoning is scheduled to be heard by the City Council on October 14, 1998. Please notify

hearin� at which all persons present w�ere given an opportunity to be heard pursuant to said
application in accordance �vith the requirements of Section 64.400 of the Saint Paul Legislative
Code; and
WHEREAS, the Saint Paul Planning Commission, based on the evidence presented to its Zonin�
Committee at the public hearing as substantially reflected in the minutes, made the followin�
findin�s of fact:

The applicant intends to construct and operate an Amoco Certicare auto repair station on �
the eastem 150 feet of the property that fronts on Ruth Street, for which he is requestin�
B-3 zonin�. The existing auto repair facility across Ruth Street at Sunray Amoco will be
moved into this facility. The auto repair space in the Sunray Amoco station will be
converted to an auto convenience market.
There is a lazge grade change down to the westem part of the site along Wilson-Avenue,
for which the applicant is requestin� RM-2 zoning. The RiVI-2 zonin� is consistent with
the adjacent RM-2 zoning. The applicant is proposing to divide this area into tu�o lots,
�chich would provide for possible future construction of two duplexes.
Section 60.544 (18) of the Zoning Code permits automobile repair facilities as permitted
uses subject to special conditions under B-3 zoning, subject to the following conditions:
(a) the minimum lot area shall be fifreen thousand (15,000) square feet; (b) a ten-foot
landscaped buffer with screed planting and an obscuring fence shall be required along an}
properry line adjoinin� an existing residence or adjoining land zoned residential; (c) all
repair w shall be done within an enclosed building; and (d) there shall be no outside
storage. The proposed site has the potential of ineeting all of the required conditions, and
the applicant intends to meet all of the required conditions.

� 4. The rezoning is consistent with the comprehensive plan. The Economic Development
Strategy (pp. 17-18) includes: 1) Objective #6, "ensure sufficient land for future business
grow 2) Policy #25, "the city's land use plan should provide adequate land for
industrial and commercial development and expansion in order to increase the proportion
of commercial/industrial tax base;" and 3) Policy �29, "the city should periodically
review its zonina regulations and amend them as necessary to keep current �aith
technological and economic chan�es affzcting the nature of business activity."
The proposed rezoning is consistent and compatible w�ith the «•ay the area has developed.
The proposed Ri�f-2 zoning of the por[ion of the property belo�v the hiil along Wilson
Avenue is consistent with the R iVI-2 zoning of adjacent property. The proposed Bv
zonin� of the portion of the propert}' at the top of the hill along Ruth Street is consistent
with the B-3 zonin� of adjacent property�. Across Ruth Street to the east of the site is the
back side of a long gazage structure servine a lazge apartment complex.
In addition, there is a significant amount of traffic in the azea. With free�vay entrance and
exit ramps just south of the site, Ruth Street carries 862� vehicles per day, and I-94
carries about 108,000 vehicles per day. A business located on this site w�ould have good
access and visibility.
� 6. The rezoning will not have an adverse impact on adjacent property. There is a si�nificant
grade chan�e bet�ti•een the commercial part of the site along Ruth Street and adjacent
residential property to the west, and the proposed auto repair station w�ill be required to
have appropriate landscaping and screenin�.
The applicant submitted a sufficient petition of two-thirds of the property owners within
one hundred (100) feet of the property to be rezoned stating support for the rezoning
(11 parcels eligible, 8 pazcels required, and 8 parcels signed).
NO`d, THEREFORE, BE IT RESOLVED, by the Saint Pau1 Plannin� Commission that the
petition of MARK FUHR to rezone propertv at 399 RUTH STREET, at the southwest comer of
Ruth Street and �/ilson Avenue, from a P-1 zonin� classification to a B-3 zoning classification
and from an OS-1 zonine classification to a B-3 and an RM-2 zoning classification is consistent
with the Comprehensive Pian for the City; and
BE IT FURTHER RESOLVED, that the Saint Paul Plannin� Commission does hereby
recommend to the Council of the City of Saint Paul that the east 150' of lot 2 be rezoned from
P-1 to B-3, the east 1�0' of lot I be rezoned from OS-1 to B-3, and the w�est 14731' of lot 1 be

MARK FUHR - Zoning File 98 - 189 - Special Condition Use Permit to allow operation of an auto
repair station.
Allan Torstenson, PED, gave a sfide presentation and reviewed the staff report. Mr. Torstenson
explained that the discussion would be on both cases, however file 98-188, the zoning issue would
be the only one voted upon. Upon City Council approval of the necessary rezoning, the Special
Condition Use Permit appiication will be handled administratively as delegated by Planning
Commission resolution #84-23 to avoid duplicative hearings "in all cases where public hearings
recommended and the City Council has approved a rezoning specifically for a Special Condition
Use.
Upon question of Commissioner Morton, Mr. Torstenson stated that the applicant, Mr. Fuhr would
be agreeable to RT-2 zoning for the portion of Lot 1 to be rezoned residential. Mr. Torstenson had
recommended RM-2 because it is consisfent wifh adjacenf zoning and allows for reasonable
options.
The applicant, Mark Fuhr of 2353 Rice Street, Suite 103, Roseville, appeared.
No one appeared in opposition, and the public hearing was closed.
Commissioner Morton moved approval of the staff recommendation and the motion was seconded
by Cammissioner Wencl.
There was no further discussion, and the motion was calfed recommending approval.

frontage along Wilson Avenue, and a total area of 53,677 sq. feet. The portion to be

E. ZONING CODE CITATION: Section 64.400 (a) states in part that "the council may, �
from time to time, amend, supplement of change the district boundazies of the regulations
herein, or subsequently established herein pursuant to the pro��isions of Minnesota
Statutes Section 462.357 and amendments thereto as may be made from time to time.
The ptanning commission may, from time to time, review district boundary lines to
determine if, pursuant to state laws, such district boundary lines should be changed."
Section 64.400 (b) states in part that "an amendment to the zoning code may be initiated
by the council, the planning commission or by petition of the owners of sixty-seven (67)
percent of the area of the property to be rezoned."
F. HISTORY/DISCUSSION: There are no previous zoning cases concerning this site.
G. DISTRICT COUNCIL RECOI�INIENDATION: None received as of the daie of this
staff report.
H. FINDINGS:
The applicant intends to construct and operate an Amoco Certicare auto repair
station on the eastem 150 feet of the property that fronts on Ruth Street, for �vhich
he is requesting B-3 zoning. The existing auto repair facility across Ruth Street at
Sunray Amoco will be moved into this facility. The auto repair space in the �
Sunray Amoco station will be converted to an auto convenience mazket.
2. There is a lazge grade change down to the westem part of the site along Wilson
Avenue, for which the applicant is requesting RM-2 Zoning. The RM-2 zoning is
consistent with the adjacent Puvl-2 zoning. The applicant is proposing to divide
this azea into two lots, which would provide for possible future construction of
two duplexes.
3. Section 60.544 (18) of the Zonin� Code permits automobile repair facilities as
permitted uses subject to special conditions under B-3 zoning, subject to the
fotlowing conditions: (a) the minimum lot area shall be ffreen thousand (15,000)
square feet; (b) a ten-foot landscaped buffer with screed planting and an obscuring
fence shall be required along any property line adjoining an existing residence or
adjoining land zoned residential; (c) all repair work shall be done within an
enclosed building; and (d) there shall be no outside storage. The proposed site has
the potential of ineeting all of the required conditions, and the applicant intends to
meet all of the required conditions.
4. The rezoning is consistent ���ith the comprehensive plan. The Economic
Development Strategy (pp. 17-18) includes: 1) Objective #6, "ensure sufficient
land for future business gro«th;" 2) Policy #25, "the city's land use plan should
provide adequate land for industrial and commercial development and expansion �
in order to increase the proportion of commercial/industrial tax base;" and 3)

� Policy #29, "the city should periodically review its zonin� regulations and amend
them as necessary to keep current with technological and economic changes
affecting the nature of business activity."
The proposed rezoning is consistent and compatible �r the way the area has
developed. The proposed RM-2 zoning of the portion of the property belo�v the
hill along Wilson Avenue is consistent with the RM-2 zoning of adjacent
property. The proposed B-3 zoning of the portion of the property at the top of the
hill along Ruth Street is consistent with the B-3 zoning of adjacent property.
Across Ruth Street to the east of the site is the back side of a long gara�e structure
ser� ing a large apartment complex.
In addition, there is a significant amount of traffic in the area. With freeway
entrance and exit ramps just south of the site, Ruth Street carries 8625 vehicles
per day, and I-94 carries about 108,000 vehicles per da}�. A business located on
this site ���ould have good access and visibility.
6. The rezoning wilt not have an adverse impact on adjacent property. There is a
sianificant grade change between the commercial part of the site alon� Ruth Street
and adjacent residential property to the west, and the proposed auto repair station
�aill be required to have appropriate landscaping and screening.
� 7. The applicant submitted a sufficient petition of two-thirds of the property owners
within one hundred (100) feet of the property to be rezoned stating support for the
rezoning (11 parcels eligible, 8 parcels required, and 8 parcels signed).
I. STAFF RECOMMENDATION: Based on the above findings, staff recommends
approval of the proposed rezoning from OS-1 to B-3 and RM-2, and from P-1 to B-3 to
allow construction and operation of an auto repair station at 399 Ruth Street at the SW
corner of Ruth Street and Wilson Avenue.

WHEREAS, Pursuant to Minnesota Statutes §462357 and §64.400 of the Legislative Code, MARK FL3I-IR
duly petitioned to rezone 399 RUTH STREET being legally described as Lot 1 and the East 150 ft. of Lot 2,
Block 8, Hudson Road Gazdens from P-1 to B-3, and from OS-1 to B-3 and RM-2, for the purpose of
permitting construction of an Amoco Certicaze auto repair station, the petition having been certified by the
Planning Division on July 20, 1998, as having been consented to by at least 67% of the owners of the area of
the property to be rezoned, and fiirther having been consented to by at least two-thirds of the owners of the
property situated within 100 feet of the total contiguous properry within one year proceeding the date of the
perition; and
14 WHEREAS, The Zoning Committee of the Planning Commission held a public hearing on August 20, 1998,
15 far the purpose of considering the rezoning petition, and pursuant to § 107.03 of the Administrative Code,
16 submitted its recommendation to the Planning Commission that the petition be granted; and

WHEREAS, The Planning Commission considered the rezoning petition at its meeting held on August 28,
1998, and recommended that the City Council approve the petition; and
WHEREAS, notice of public hearing before the City Council on the said rezoning petition was duly
published in the official newspaper of the City on October 3, 199�, and notices were duly mailed to each
owner of affected property and property situated wholly or partly within 350 feet of the property sought to be
rezoned;and
WIIEREAS, a public hearing before the City Council having been conducted on October 14, 1998, where all
interested parties were heazd, and the Council having considered all the facts and recommendations
concerning the petition; now, therefore
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:

of the Planning Commission held a public hearing on the proposed rezoning on August 20, 1998. The
applicant addressed the committee. At the close of the public hearing, the committee voted 6-0 to
recommend approva( of the proposed rezoning to B-3 and RM-2. The Planning Commission upheld the
Zoning Committee's recommendation for approval on a unanimous vote on Au�ust 28, 1998.

�L'HEREAS, the Zonin� Committee of the Planning Commission on 08/20/1998, held a public
hearin� at which all persons present w�ere given an opportunity to be heard pursuant to said
application in accordance �vith the requirements of Section 64.400 of the Saint Paul Legislative
Code; and
WHEREAS, the Saint Paul Planning Commission, based on the evidence presented to its Zonin�
Committee at the public hearing as substantially reflected in the minutes, made the followin�
findin�s of fact:

The applicant intends to construct and operate an Amoco Certicare auto repair station on �
the eastem 150 feet of the property that fronts on Ruth Street, for which he is requestin�
B-3 zonin�. The existing auto repair facility across Ruth Street at Sunray Amoco will be
moved into this facility. The auto repair space in the Sunray Amoco station will be
converted to an auto convenience market.
There is a lazge grade change down to the westem part of the site along Wilson-Avenue,
for which the applicant is requestin� RM-2 zoning. The RiVI-2 zonin� is consistent with
the adjacent RM-2 zoning. The applicant is proposing to divide this area into tu�o lots,
�chich would provide for possible future construction of two duplexes.
Section 60.544 (18) of the Zoning Code permits automobile repair facilities as permitted
uses subject to special conditions under B-3 zoning, subject to the following conditions:
(a) the minimum lot area shall be fifreen thousand (15,000) square feet; (b) a ten-foot
landscaped buffer with screed planting and an obscuring fence shall be required along an}
properry line adjoinin� an existing residence or adjoining land zoned residential; (c) all
repair w shall be done within an enclosed building; and (d) there shall be no outside
storage. The proposed site has the potential of ineeting all of the required conditions, and
the applicant intends to meet all of the required conditions.

� 4. The rezoning is consistent with the comprehensive plan. The Economic Development
Strategy (pp. 17-18) includes: 1) Objective #6, "ensure sufficient land for future business
grow 2) Policy #25, "the city's land use plan should provide adequate land for
industrial and commercial development and expansion in order to increase the proportion
of commercial/industrial tax base;" and 3) Policy �29, "the city should periodically
review its zonina regulations and amend them as necessary to keep current �aith
technological and economic chan�es affzcting the nature of business activity."
The proposed rezoning is consistent and compatible w�ith the «•ay the area has developed.
The proposed Ri�f-2 zoning of the por[ion of the property belo�v the hiil along Wilson
Avenue is consistent with the R iVI-2 zoning of adjacent property. The proposed Bv
zonin� of the portion of the propert}' at the top of the hill along Ruth Street is consistent
with the B-3 zonin� of adjacent property�. Across Ruth Street to the east of the site is the
back side of a long gazage structure servine a lazge apartment complex.

MARK FUHR - Zoning File 98 - 189 - Special Condition Use Permit to allow operation of an auto
repair station.
Allan Torstenson, PED, gave a sfide presentation and reviewed the staff report. Mr. Torstenson
explained that the discussion would be on both cases, however file 98-188, the zoning issue would
be the only one voted upon. Upon City Council approval of the necessary rezoning, the Special
Condition Use Permit appiication will be handled administratively as delegated by Planning
Commission resolution #84-23 to avoid duplicative hearings "in all cases where public hearings
recommended and the City Council has approved a rezoning specifically for a Special Condition
Use.
Upon question of Commissioner Morton, Mr. Torstenson stated that the applicant, Mr. Fuhr would
be agreeable to RT-2 zoning for the portion of Lot 1 to be rezoned residential. Mr. Torstenson had
recommended RM-2 because it is consisfent wifh adjacenf zoning and allows for reasonable
options.
The applicant, Mark Fuhr of 2353 Rice Street, Suite 103, Roseville, appeared.
No one appeared in opposition, and the public hearing was closed.
Commissioner Morton moved approval of the staff recommendation and the motion was seconded
by Cammissioner Wencl.
There was no further discussion, and the motion was calfed recommending approval.

B. PARCEL SIZE: This L-shaped parcel has 240' of frontaoe along Ruth Street, 297' of
frontage along Wilson Avenue, and a total area of 53,677 sq. feet. The portion to be
rezoned to B-3 has 240' of frontage along Ruth St., 150' of frontage along Wilson Ave.,
and a total area of 36,000 sq. feet. The portion of the parcel to be rezoned RM-2 has 147'
of frontage along Wilson Ave., is 120 feet deep, and has an area of 17,677 sq. feet.
C. EXISTING LAND USE: The 18,000 sq. foot P-1 portion of the property with 120' of
frontage along Ruth Street is paved, fenced and used for pazking for the existing auto
repair business at the Amoco station across the street at the NW comer of Ruth Street and
Old Hudson Road. The 35,677 sq. foot OS-1 portion of the property with 120' of

Section 64.400 (b) states in part that "an amendment to the zoning code may be initiated
by the council, the planning commission or by petition of the owners of sixty-seven (67)
percent of the area of the property to be rezoned."
F. HISTORY/DISCUSSION: There are no previous zoning cases concerning this site.
G. DISTRICT COUNCIL RECOI�INIENDATION: None received as of the daie of this
staff report.
H. FINDINGS:
The applicant intends to construct and operate an Amoco Certicare auto repair
station on the eastem 150 feet of the property that fronts on Ruth Street, for �vhich
he is requesting B-3 zoning. The existing auto repair facility across Ruth Street at
Sunray Amoco will be moved into this facility. The auto repair space in the �
Sunray Amoco station will be converted to an auto convenience mazket.
2. There is a lazge grade change down to the westem part of the site along Wilson
Avenue, for which the applicant is requesting RM-2 Zoning. The RM-2 zoning is
consistent with the adjacent Puvl-2 zoning. The applicant is proposing to divide
this azea into two lots, which would provide for possible future construction of
two duplexes.
3. Section 60.544 (18) of the Zonin� Code permits automobile repair facilities as
permitted uses subject to special conditions under B-3 zoning, subject to the
fotlowing conditions: (a) the minimum lot area shall be ffreen thousand (15,000)
square feet; (b) a ten-foot landscaped buffer with screed planting and an obscuring
fence shall be required along any property line adjoining an existing residence or
adjoining land zoned residential; (c) all repair work shall be done within an
enclosed building; and (d) there shall be no outside storage. The proposed site has
the potential of ineeting all of the required conditions, and the applicant intends to
meet all of the required conditions.
4. The rezoning is consistent ���ith the comprehensive plan. The Economic
Development Strategy (pp. 17-18) includes: 1) Objective #6, "ensure sufficient
land for future business gro«th;" 2) Policy #25, "the city's land use plan should
provide adequate land for industrial and commercial development and expansion �
in order to increase the proportion of commercial/industrial tax base;" and 3)

� Policy #29, "the city should periodically review its zonin� regulations and amend
them as necessary to keep current with technological and economic changes
affecting the nature of business activity."
The proposed rezoning is consistent and compatible �r the way the area has
developed. The proposed RM-2 zoning of the portion of the property belo�v the
hill along Wilson Avenue is consistent with the RM-2 zoning of adjacent
property. The proposed B-3 zoning of the portion of the property at the top of the
hill along Ruth Street is consistent with the B-3 zoning of adjacent property.
Across Ruth Street to the east of the site is the back side of a long gara�e structure
ser� ing a large apartment complex.
