An ordinance amending Chapter 60 of the Saint Paul Legislative Code pertaining to zoning for the City of
Saint Paul and the zorung maps thereof:
WHEREAS, Pursuant to Minnesota Statutes §462357 and §64.400 of the Legislative Code,
METROPOLITAN STATE UNIVERSITY duly petirioned to rezone 4XX MARIA AVENLTE, being legally
described as the southerly 5 feet of Lot 2 and all of Lot 3, Auditor's Subdivision #73, from P-1 to B-2 to
a11ow construction of a greenhouse facility for a joint educational progrun with the Minnesota Department of
Agriculhue, the petition having been certified by the Placuiing Division on May 9, 1997, as having been
consented to by at least 67 percent of the owners of the azea of the property to be rezoned, and fiirther having
been consented to by at least two-thirds of the owners of the ptoperty situated within l OQ feet of the total
contiguous property within one year proceeding the date of the petition; and
14 WHEREAS, The Zoning Committee of the Planning Commission held a public hearing on June 5, 1997, for
15 the purpose of considering the rezoning petition, and pursuant to §107.03 of the Administrative Code,
16 submitted its recommendation to the Planning Commission that the petition be granted; and

WI3EREAS, The Plamiiug Commission considered the rezoning petition at its meeting held on June 13, 1997,
and recommended that the City Council approve the petition; and
WHEREAS, notice of public hearing before the City Council on the said rezoning petifion was duly
published in the official newspaper of the City on June 20, 1997, and notices were duly mailed to each owner
of affected property and properry situated wholly or partly wiflvn 350 feet of the property sought to be
rezoned;and
WfIEREAS, a public hearing before the City Council having been conducted on July 2, 1997, where all
interested parties were heazd, the Council having considered all the facts and recommendations concerning
the petition; now, therefore
THE COUNCIL OF THE CITY OF SA1NT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul, Sheet Nuxnber 14, as incorporated by reference in §60301 of
the Saint Paul Legislative Code, as amended, is hereby further amended as follows:

METROPOLITAN STATE UIVIVERSITY submitted a petition to rezone property at 4XX MARIA
AVENUE. The Zoning Committee of the Planning Commission held a public heazing on the proposed
rezoning on June 5, 1997. The applicant addressed the committee. At the close of the public heazing, the
committee voted 8-0 to recommend approval to rezone to B-2. The Planning Commission upheld the
Zoning Committee's recommendation for approval on a unanimous vote on June 13, 1997.
This proposed rezoning is scheduled to be heard by the City Council on July 2, 1997. Please notify me if
any member of the City Council wishes to have slides of the site presented at the public heazing.

WHEREAS, METROPOLITAN STATE IJNIVERSITY file #97-117 has petitioned to rezone
4XX MARIA AVENUE, situated on the southwesterly side between 7th and 8th Streets, from
P-1 to B-2 to allow construction of a greenhouse facility for a joint educational program with the
Minnesota Department of Agricuiture; and
WHEREAS, the Zoning Committee of the Planning Commission held a public hearing on
June 5, 1997, at which all persons present were given an opportunity to be heazd pursuant to said
application in accordance with the requirements of Section 64.400 of the Saint Paul Legislative
Code; and
WHEREAS, the Saint Paul Pianning Commission, based on the evidence presented to its Zoning
Committee at the public hearing, as substantiaily reflected in the minutes, made the foilowing
findings of fact:
• 1. Metropolitan State University (MSU) owns the property and intends to lease it to the
Minnesota Department of Agriculture (MDA). MDA pians to construct a greenhouse and
intends to grow the types of plants that can support desirable pests in order to control
undesirable pests. MDA states that adequate greenhouse facilities are essential in order to
grow the appropriate plant material to support populations of plant pests and biological
control agents and maintain conditions experienced by indoor plants. The term biological
control refers to the use of living organisms (in this case insects or mites) to control other
harmful or less desirable pests. For example biological efforts have succeeded in controlling
piant pests in several public buiidings and private settings including Como Park
Conservatory, Minnesota Landscape Arboretum, Mall of America, Rosedale Mall, and
Hennepin County Hospital.
The MDA and MSU will be cooperating in the greenhouse project to raise biological control
agents. The greenhouse will have five sections and a head house. Each of the sections wili
house one set of beneficiaUpest orgazusms. The head house will serve as a prep room as well
as a reception azea for up to 20 visitors. One fuli time employee will be present Monday
through Friday and on some weekends. School groups already visit MDA's biocontrol
labaratory without a greenhouse. The proposed greenhouse will provide hands on experience

to students, homeowners, and small businesses who can then use the information in their
homes and offices. MDA anticipates 2-3 visits frotn school groups per week. MSU has
agreed to allow pazking of buses in their parking lot to avoid any congestion on Maria
Avenue.
2. The rezoning is in conformance with the comprehensive plan. One of the development
strategies of the Lower Dayton's Bluff Small Area Plan states, "azea social service agencies
and schools should coordinate their efforts to address the human service, education, and
employment needs of neighborhood households and promote community stability." #26,
p.13 In addition,.one of the policies of the Economic Development Strategy states, "the City
should periodically review its zoning regulations and amend them as necessary to keep
current with technological and economic changes affecting the nature of business activity."

3. The rezoning is consistent and compatible with the way the azea has developed and will not
have an adverse impact on the surrounding azea The rezoning wi11 allow the property which
is owned by the university to be developed for university/state purposes. B-2 zoning is a
more appropriate for this site than B-3 zoning because it is the same zoning as the rest of the
developed portion of the university property. .
4. The appiicant submitted a sufficient petition signed by two-thirds of the property owners
within one hundred (100) feet of the property to be rezoned (44 pazcels eligible, 30 needed,
and 31 pazcels signed).
NOW, THERF.FORE, BE IT RESOLVED, by the Saint Paul Planning Commission that the
petition of METROPOLITAN STATE UNIVERSITY to rezone properry at 4XX MARIA
AVENiTE, more particularly described as southerly 5 feet of Lot 2 and all of Lot 3, Auditor's
Subdivision #73, from a P-1 zoning classification to a B-2 zoning classification is consistent with
the Comprehensive Plan for the City; and
BE IT FURTHER RESOLVED, that the Saint Paul Planning Commission does hereby
recommend to the Couacil of the City of Saint Paul that property located at 4XX MARIA
AVENUE be rezoned from P-1 to B-2 in accordance with the petition for rezoning on file with

Commissioner Fie(d told of the fascinating discussion that took place at the Zoning
Committee meeting. They are going to be raising "friendly bugs" that are used in lieu of
pesticides to chase away unfriendly bugs.
Commissioner Vaught said that these bugs are accurately called "biological control agents."

Kady Dadlez, Zoning Office of PED staff, reviewed the staff report and
presented slides. Staff recommended approval of the petition to rezone the
property from P-1 to B-2, based on findings 1 through 4 of the staff report. �
One letter of opposition was received.
The Dayton's Bluff Center for Civic Life voted to support the rezoning
petition.
Dan Kirk, Associate Vice President for Administration and Finance for Metro
State, the applicant, introduced Dr. Dharma Sreenivasam, ➢epartment of
Agriculture, who could speak to information related to the program. Mr. Kirk
indicated that trie request is supported by the immediate neighbors, including
the church, church school, and the home adjacent to the property.
Commissioner Kramer asked how long the greenhouse is projected to be at that
location. Mr. Kirk responded that Metro State rias not yet completed the lease
agreement with the Department of Administration for Agriculture, but
anticipates it to be a 20-30 year lease, with the understanding that if the
Department of Aariculture were to discontinue the program that Metro State
would have the option to discontinue the greenhouse.
Commissioner Kramer referenced the letter of opposition received from Patricia
Johnson, 700 East Sixth Street, regarding parking concerns. Mr. Kirk
confirmed that the proposed site is not currently being used for parking, so
no parking would be lost as a result of the proposed use.
Commissioner Faricy asked what the greenhouse would be constructed of.
Dr. Sreenivasam, Department of Agriculture, Biological Coatrol Program,
responded that the greenhouse will be a polycarbonate double-wall insulated �
material which does not require paint.

Commissioner Wencl questioned whetrier the bugs proposed would be ones the
neighbors would appreciate as they would kill pests that they have.
Dr. Sreenivasm responded that the purpose of the program is to generate enosgh
good bugs to combat the bad bugs, but more importantly to use them in home
situations where there are enclosed gpaces, and interior plantscapes, whereas,
currently infestation is controlled by spraying which is inhaled by occupants
in an enclosed atmosphere. This program is an attempt to educate homeowzers
of alternative methods. He pointed out triat the Mall of America is prohibited
from the use of chemicals inside the mall because of the presence of live
animals. The biological control work done there have become self-sustaining
populations that balance each other. He noted in response to an inquiry that
bugs can be recycled.
Commissioner Chavez asked about securiCy and questioned what measures would be
taken i£ bugs were released due to vandalism. Mr. Kirk responded that the
university has on-site patrols, a security service and electronic security
which is a 24-hour system. Dr. Sreenivasm pointed out that because the
greenhouse is made of poly-carbonate that it would not shatter. However, in
the case of a break and insects were released that all insects are such found
in all our backyards and wouldn't be dangerous, but would congregate in
neighboring plants. Metro East will address the issue of vandalism to the
extent possible.
No one spoke either in support or opposition. The public hearing was closed.
Commissioner Kramer moved approval of the peti.tion to rezone the property from
P-1 to S-2. Commissioner Gurney seconded the moCion. The motion carried on a
unanimous voice vote of 8 to 0.

F. HISTORY/DISCIISSION: There are no previous zoning caSes conCerning this
property. The vniversity acquired the property about one year ago. They
plan to develop the proposed greenhouse on Maria Avenue this year. `I`he

and west call for a community/university library and parking facility.

report was drafted.

3. The rezoning is consistent and compatible with the way the area has
developed and will not have an adverse impact on the surrounding area,
The rezoning will allow the property which is owned by the university to
be developed for university/state purposes. B-2 zoning is a more
appropriate for this site than B-3 zoning because it is the same zoning
as the rest of the developed portion of the university property.
4. The applicant submitted a sufficient petition signed by two-thirds of
the property owners within one hundred (100) feet of the property to be
rezoned (44 parcels eligible, 30 needed, and 31 parcels signed).

An ordinance amending Chapter 60 of the Saint Paul Legislative Code pertaining to zoning for the City of
Saint Paul and the zorung maps thereof:
WHEREAS, Pursuant to Minnesota Statutes §462357 and §64.400 of the Legislative Code,
METROPOLITAN STATE UNIVERSITY duly petirioned to rezone 4XX MARIA AVENLTE, being legally
described as the southerly 5 feet of Lot 2 and all of Lot 3, Auditor's Subdivision #73, from P-1 to B-2 to
a11ow construction of a greenhouse facility for a joint educational progrun with the Minnesota Department of
Agriculhue, the petition having been certified by the Placuiing Division on May 9, 1997, as having been
consented to by at least 67 percent of the owners of the azea of the property to be rezoned, and fiirther having
been consented to by at least two-thirds of the owners of the ptoperty situated within l OQ feet of the total
contiguous property within one year proceeding the date of the petition; and

and recommended that the City Council approve the petition; and
WHEREAS, notice of public hearing before the City Council on the said rezoning petifion was duly
published in the official newspaper of the City on June 20, 1997, and notices were duly mailed to each owner
of affected property and properry situated wholly or partly wiflvn 350 feet of the property sought to be
rezoned;and
WfIEREAS, a public hearing before the City Council having been conducted on July 2, 1997, where all
interested parties were heazd, the Council having considered all the facts and recommendations concerning
the petition; now, therefore

METROPOLITAN STATE UIVIVERSITY submitted a petition to rezone property at 4XX MARIA
AVENUE. The Zoning Committee of the Planning Commission held a public heazing on the proposed
rezoning on June 5, 1997. The applicant addressed the committee. At the close of the public heazing, the
committee voted 8-0 to recommend approval to rezone to B-2. The Planning Commission upheld the
Zoning Committee's recommendation for approval on a unanimous vote on June 13, 1997.
This proposed rezoning is scheduled to be heard by the City Council on July 2, 1997. Please notify me if

WHEREAS, METROPOLITAN STATE IJNIVERSITY file #97-117 has petitioned to rezone
4XX MARIA AVENUE, situated on the southwesterly side between 7th and 8th Streets, from
P-1 to B-2 to allow construction of a greenhouse facility for a joint educational program with the
Minnesota Department of Agricuiture; and
WHEREAS, the Zoning Committee of the Planning Commission held a public hearing on
June 5, 1997, at which all persons present were given an opportunity to be heazd pursuant to said
application in accordance with the requirements of Section 64.400 of the Saint Paul Legislative
Code; and
WHEREAS, the Saint Paul Pianning Commission, based on the evidence presented to its Zoning
Committee at the public hearing, as substantiaily reflected in the minutes, made the foilowing
findings of fact:
• 1. Metropolitan State University (MSU) owns the property and intends to lease it to the
Minnesota Department of Agriculture (MDA). MDA pians to construct a greenhouse and
intends to grow the types of plants that can support desirable pests in order to control
undesirable pests. MDA states that adequate greenhouse facilities are essential in order to
grow the appropriate plant material to support populations of plant pests and biological
control agents and maintain conditions experienced by indoor plants. The term biological
control refers to the use of living organisms (in this case insects or mites) to control other
harmful or less desirable pests. For example biological efforts have succeeded in controlling
piant pests in several public buiidings and private settings including Como Park
Conservatory, Minnesota Landscape Arboretum, Mall of America, Rosedale Mall, and
Hennepin County Hospital.
The MDA and MSU will be cooperating in the greenhouse project to raise biological control
agents. The greenhouse will have five sections and a head house. Each of the sections wili
house one set of beneficiaUpest orgazusms. The head house will serve as a prep room as well
as a reception azea for up to 20 visitors. One fuli time employee will be present Monday
through Friday and on some weekends. School groups already visit MDA's biocontrol
labaratory without a greenhouse. The proposed greenhouse will provide hands on experience

to students, homeowners, and small businesses who can then use the information in their
homes and offices. MDA anticipates 2-3 visits frotn school groups per week. MSU has
agreed to allow pazking of buses in their parking lot to avoid any congestion on Maria
Avenue.
2. The rezoning is in conformance with the comprehensive plan. One of the development
strategies of the Lower Dayton's Bluff Small Area Plan states, "azea social service agencies
and schools should coordinate their efforts to address the human service, education, and
employment needs of neighborhood households and promote community stability." #26,
p.13 In addition,.one of the policies of the Economic Development Strategy states, "the City
should periodically review its zoning regulations and amend them as necessary to keep
current with technological and economic changes affecting the nature of business activity."

3. The rezoning is consistent and compatible with the way the azea has developed and will not
have an adverse impact on the surrounding azea The rezoning wi11 allow the property which
is owned by the university to be developed for university/state purposes. B-2 zoning is a
more appropriate for this site than B-3 zoning because it is the same zoning as the rest of the
developed portion of the university property. .
4. The appiicant submitted a sufficient petition signed by two-thirds of the property owners
within one hundred (100) feet of the property to be rezoned (44 pazcels eligible, 30 needed,
and 31 pazcels signed).
NOW, THERF.FORE, BE IT RESOLVED, by the Saint Paul Planning Commission that the
petition of METROPOLITAN STATE UNIVERSITY to rezone properry at 4XX MARIA
AVENiTE, more particularly described as southerly 5 feet of Lot 2 and all of Lot 3, Auditor's
Subdivision #73, from a P-1 zoning classification to a B-2 zoning classification is consistent with
the Comprehensive Plan for the City; and
BE IT FURTHER RESOLVED, that the Saint Paul Planning Commission does hereby

Committee meeting. They are going to be raising "friendly bugs" that are used in lieu of
pesticides to chase away unfriendly bugs.
Commissioner Vaught said that these bugs are accurately called "biological control agents."

Kady Dadlez, Zoning Office of PED staff, reviewed the staff report and
presented slides. Staff recommended approval of the petition to rezone the
property from P-1 to B-2, based on findings 1 through 4 of the staff report. �
One letter of opposition was received.
The Dayton's Bluff Center for Civic Life voted to support the rezoning
petition.
Dan Kirk, Associate Vice President for Administration and Finance for Metro
State, the applicant, introduced Dr. Dharma Sreenivasam, ➢epartment of
Agriculture, who could speak to information related to the program. Mr. Kirk
indicated that trie request is supported by the immediate neighbors, including
the church, church school, and the home adjacent to the property.
Commissioner Kramer asked how long the greenhouse is projected to be at that
location. Mr. Kirk responded that Metro State rias not yet completed the lease
agreement with the Department of Administration for Agriculture, but
anticipates it to be a 20-30 year lease, with the understanding that if the
Department of Aariculture were to discontinue the program that Metro State
would have the option to discontinue the greenhouse.
Commissioner Kramer referenced the letter of opposition received from Patricia
Johnson, 700 East Sixth Street, regarding parking concerns. Mr. Kirk
confirmed that the proposed site is not currently being used for parking, so
no parking would be lost as a result of the proposed use.
Commissioner Faricy asked what the greenhouse would be constructed of.
Dr. Sreenivasam, Department of Agriculture, Biological Coatrol Program,
responded that the greenhouse will be a polycarbonate double-wall insulated �
material which does not require paint.

Commissioner Wencl questioned whetrier the bugs proposed would be ones the
neighbors would appreciate as they would kill pests that they have.
Dr. Sreenivasm responded that the purpose of the program is to generate enosgh
good bugs to combat the bad bugs, but more importantly to use them in home
situations where there are enclosed gpaces, and interior plantscapes, whereas,
currently infestation is controlled by spraying which is inhaled by occupants
in an enclosed atmosphere. This program is an attempt to educate homeowzers
of alternative methods. He pointed out triat the Mall of America is prohibited
from the use of chemicals inside the mall because of the presence of live
animals. The biological control work done there have become self-sustaining
populations that balance each other. He noted in response to an inquiry that
bugs can be recycled.
Commissioner Chavez asked about securiCy and questioned what measures would be
taken i£ bugs were released due to vandalism. Mr. Kirk responded that the
university has on-site patrols, a security service and electronic security
which is a 24-hour system. Dr. Sreenivasm pointed out that because the
greenhouse is made of poly-carbonate that it would not shatter. However, in
the case of a break and insects were released that all insects are such found
in all our backyards and wouldn't be dangerous, but would congregate in
neighboring plants. Metro East will address the issue of vandalism to the
extent possible.
No one spoke either in support or opposition. The public hearing was closed.
Commissioner Kramer moved approval of the peti.tion to rezone the property from
P-1 to S-2. Commissioner Gurney seconded the moCion. The motion carried on a
unanimous voice vote of 8 to 0.

E. ZONING CODS CITATION: Section 64.400(a) of the zoning code states, "the
council may, from time to time, amend, supplement or change the district
boundaries or the regulations herein, or subsequently established herein
pursuant to the provisions of Minnesota Statutes Section 462.357 and
amendments thereto as may be made from time to time. The planning
commission may, from time to time, review district boundary lines to
determine i£, pursuant to state laws, such district boundary lines should
be changed."
Section 64.400(b) states in part that "an amendment to the zoning code may
be initiated by the council, the planning commission or by petition of the
owners of sixty-seven {67) percent of the area of the property to be
rezoned."

F. HISTORY/DISCIISSION: There are no previous zoning caSes conCerning this
property. The vniversity acquired the property about one year ago. They
plan to develop the proposed greenhouse on Maria Avenue this year. `I`he
ti long tez'm Yedevelopment plans for their property to the south
and west call for a community/university library and parking facility.
G. DISTRICT COIINCIL R&CO�NDATION: The Dayton'S Bluff Center for Civic Life
had not taken a position on the rezoning petition at the time the staff
report was drafted.
fi. FINDINGS
i. Metropolitan State University (MSU) owns the property and intends to
lease it to the Minnesota Department of Agriculture (NIDA). t�IDA plans
to construct a greenhouse and intends to grow the types of plants that
can support desirable pests in order to control undesirable pests. NIDA
states that adequate greenhouse facilities are essential in order to
grow the appropriate plant material to support populations of plant
pests and biological control agents and maintain conditions erperienced
by indoor plants. The term biological control refers to the use of
living organisms (in this case insects or mites) to control other
harmful or less desirable pests. For example biological efforts have
succeeded in controlling plant pests in several public buildings and
private settings including Como Park Conservatory, Minnesota Landscape
Arboretum, Mall of America, Rosedale Mall, and Hennepin County Hospital.
The I�IDA and MSU will be cooperating in the greenhouse project to raise
biological control agents. The greenhouse will have five sections and a
head house. Each of Che secCions will house one set of beneficial/pest
organisms. The head house will serve as a prep room as well as a
reception area for up to 20 visitors. One full time employee will be
present Monday through Friday and on some weekends. School groups
already visit NIDA's biocontrol laboratory without a greenhouse. The
proposed greenhouse will provide hands on experience to students,
homeowners, and small businesses who can then use the information in
their homes and offices. I+IDA anticipates 2-3 visits from school groups
per week. MSU has agreed to a11ow parking of buses in their parking lot
to avoid any congestion on Maria Avenue.
Photographs of the pests to control and the biological agents are
attached to this report along with a detailed description of each.

2. The rezoning is in conformance with the comprehensive plan. One of the
development strategies of the Lower Dayton�s Bluff Small Area Plan
states, "area social service agencies and schools should aoordinate
their efforts to address the human service, education, and employment
needs of neighborhood households and promote community stability." #z6,
p.13 In addition, one of the policies of the Economic Development
Strategy states, "the City should periodically review its zoning
regulations and amend them as necessary to keep current with
technological and economic changes affecting the nature of business

activity." #28, p.17
3. The rezoning is consistent and compatible with the way the area has
developed and will not have an adverse impact on the surrounding area,
The rezoning will allow the property which is owned by the university to
be developed for university/state purposes. B-2 zoning is a more
appropriate for this site than B-3 zoning because it is the same zoning
as the rest of the developed portion of the university property.
4. The applicant submitted a sufficient petition signed by two-thirds of
the property owners within one hundred (100) feet of the property to be
rezoned (44 parcels eligible, 30 needed, and 31 parcels signed).
I. STAFF RECONASENDATION: Based on findings 1 through 4 staff recommends
approval of the petition to rezone the property from P-1 to B-2.

An ordinance amending Chapter 60 of the Saint Paul Legislative Code pertaining to zoning for the City of
Saint Paul and the zorung maps thereof:
WHEREAS, Pursuant to Minnesota Statutes §462357 and §64.400 of the Legislative Code,
METROPOLITAN STATE UNIVERSITY duly petirioned to rezone 4XX MARIA AVENLTE, being legally
described as the southerly 5 feet of Lot 2 and all of Lot 3, Auditor's Subdivision #73, from P-1 to B-2 to
a11ow construction of a greenhouse facility for a joint educational progrun with the Minnesota Department of
Agriculhue, the petition having been certified by the Placuiing Division on May 9, 1997, as having been
consented to by at least 67 percent of the owners of the azea of the property to be rezoned, and fiirther having
been consented to by at least two-thirds of the owners of the ptoperty situated within l OQ feet of the total
contiguous property within one year proceeding the date of the petition; and

and recommended that the City Council approve the petition; and
WHEREAS, notice of public hearing before the City Council on the said rezoning petifion was duly
published in the official newspaper of the City on June 20, 1997, and notices were duly mailed to each owner
of affected property and properry situated wholly or partly wiflvn 350 feet of the property sought to be
rezoned;and
WfIEREAS, a public hearing before the City Council having been conducted on July 2, 1997, where all
interested parties were heazd, the Council having considered all the facts and recommendations concerning

METROPOLITAN STATE UIVIVERSITY submitted a petition to rezone property at 4XX MARIA
AVENUE. The Zoning Committee of the Planning Commission held a public heazing on the proposed
rezoning on June 5, 1997. The applicant addressed the committee. At the close of the public heazing, the
committee voted 8-0 to recommend approval to rezone to B-2. The Planning Commission upheld the
Zoning Committee's recommendation for approval on a unanimous vote on June 13, 1997.
This proposed rezoning is scheduled to be heard by the City Council on July 2, 1997. Please notify me if

WHEREAS, METROPOLITAN STATE IJNIVERSITY file #97-117 has petitioned to rezone
4XX MARIA AVENUE, situated on the southwesterly side between 7th and 8th Streets, from
P-1 to B-2 to allow construction of a greenhouse facility for a joint educational program with the
Minnesota Department of Agricuiture; and
WHEREAS, the Zoning Committee of the Planning Commission held a public hearing on
June 5, 1997, at which all persons present were given an opportunity to be heazd pursuant to said
application in accordance with the requirements of Section 64.400 of the Saint Paul Legislative
Code; and
WHEREAS, the Saint Paul Pianning Commission, based on the evidence presented to its Zoning
Committee at the public hearing, as substantiaily reflected in the minutes, made the foilowing
findings of fact:
• 1. Metropolitan State University (MSU) owns the property and intends to lease it to the
Minnesota Department of Agriculture (MDA). MDA pians to construct a greenhouse and
intends to grow the types of plants that can support desirable pests in order to control
undesirable pests. MDA states that adequate greenhouse facilities are essential in order to
grow the appropriate plant material to support populations of plant pests and biological
control agents and maintain conditions experienced by indoor plants. The term biological
control refers to the use of living organisms (in this case insects or mites) to control other
harmful or less desirable pests. For example biological efforts have succeeded in controlling
piant pests in several public buiidings and private settings including Como Park
Conservatory, Minnesota Landscape Arboretum, Mall of America, Rosedale Mall, and
Hennepin County Hospital.
The MDA and MSU will be cooperating in the greenhouse project to raise biological control
agents. The greenhouse will have five sections and a head house. Each of the sections wili
house one set of beneficiaUpest orgazusms. The head house will serve as a prep room as well
as a reception azea for up to 20 visitors. One fuli time employee will be present Monday
through Friday and on some weekends. School groups already visit MDA's biocontrol
labaratory without a greenhouse. The proposed greenhouse will provide hands on experience

to students, homeowners, and small businesses who can then use the information in their
homes and offices. MDA anticipates 2-3 visits frotn school groups per week. MSU has
agreed to allow pazking of buses in their parking lot to avoid any congestion on Maria
Avenue.
2. The rezoning is in conformance with the comprehensive plan. One of the development
strategies of the Lower Dayton's Bluff Small Area Plan states, "azea social service agencies
and schools should coordinate their efforts to address the human service, education, and
employment needs of neighborhood households and promote community stability." #26,
p.13 In addition,.one of the policies of the Economic Development Strategy states, "the City
should periodically review its zoning regulations and amend them as necessary to keep
current with technological and economic changes affecting the nature of business activity."

3. The rezoning is consistent and compatible with the way the azea has developed and will not
have an adverse impact on the surrounding azea The rezoning wi11 allow the property which
is owned by the university to be developed for university/state purposes. B-2 zoning is a
more appropriate for this site than B-3 zoning because it is the same zoning as the rest of the
developed portion of the university property. .
4. The appiicant submitted a sufficient petition signed by two-thirds of the property owners
within one hundred (100) feet of the property to be rezoned (44 pazcels eligible, 30 needed,
and 31 pazcels signed).
NOW, THERF.FORE, BE IT RESOLVED, by the Saint Paul Planning Commission that the
petition of METROPOLITAN STATE UNIVERSITY to rezone properry at 4XX MARIA
AVENiTE, more particularly described as southerly 5 feet of Lot 2 and all of Lot 3, Auditor's
Subdivision #73, from a P-1 zoning classification to a B-2 zoning classification is consistent with
the Comprehensive Plan for the City; and
BE IT FURTHER RESOLVED, that the Saint Paul Planning Commission does hereby
recommend to the Couacil of the City of Saint Paul that property located at 4XX MARIA

Kady Dadlez, Zoning Office of PED staff, reviewed the staff report and
presented slides. Staff recommended approval of the petition to rezone the
property from P-1 to B-2, based on findings 1 through 4 of the staff report. �
One letter of opposition was received.
The Dayton's Bluff Center for Civic Life voted to support the rezoning
petition.
Dan Kirk, Associate Vice President for Administration and Finance for Metro
State, the applicant, introduced Dr. Dharma Sreenivasam, ➢epartment of
Agriculture, who could speak to information related to the program. Mr. Kirk
indicated that trie request is supported by the immediate neighbors, including
the church, church school, and the home adjacent to the property.
Commissioner Kramer asked how long the greenhouse is projected to be at that
location. Mr. Kirk responded that Metro State rias not yet completed the lease
agreement with the Department of Administration for Agriculture, but
anticipates it to be a 20-30 year lease, with the understanding that if the
Department of Aariculture were to discontinue the program that Metro State
would have the option to discontinue the greenhouse.
Commissioner Kramer referenced the letter of opposition received from Patricia
Johnson, 700 East Sixth Street, regarding parking concerns. Mr. Kirk
confirmed that the proposed site is not currently being used for parking, so
no parking would be lost as a result of the proposed use.
Commissioner Faricy asked what the greenhouse would be constructed of.
Dr. Sreenivasam, Department of Agriculture, Biological Coatrol Program,
responded that the greenhouse will be a polycarbonate double-wall insulated �
material which does not require paint.

Commissioner Wencl questioned whetrier the bugs proposed would be ones the
neighbors would appreciate as they would kill pests that they have.
Dr. Sreenivasm responded that the purpose of the program is to generate enosgh
good bugs to combat the bad bugs, but more importantly to use them in home
situations where there are enclosed gpaces, and interior plantscapes, whereas,
currently infestation is controlled by spraying which is inhaled by occupants
in an enclosed atmosphere. This program is an attempt to educate homeowzers
of alternative methods. He pointed out triat the Mall of America is prohibited
from the use of chemicals inside the mall because of the presence of live
animals. The biological control work done there have become self-sustaining
populations that balance each other. He noted in response to an inquiry that
bugs can be recycled.
Commissioner Chavez asked about securiCy and questioned what measures would be
taken i£ bugs were released due to vandalism. Mr. Kirk responded that the
university has on-site patrols, a security service and electronic security
which is a 24-hour system. Dr. Sreenivasm pointed out that because the
greenhouse is made of poly-carbonate that it would not shatter. However, in
the case of a break and insects were released that all insects are such found
in all our backyards and wouldn't be dangerous, but would congregate in
neighboring plants. Metro East will address the issue of vandalism to the
extent possible.
No one spoke either in support or opposition. The public hearing was closed.
Commissioner Kramer moved approval of the peti.tion to rezone the property from
P-1 to S-2. Commissioner Gurney seconded the moCion. The motion carried on a
unanimous voice vote of 8 to 0.

F. HISTORY/DISCIISSION: There are no previous zoning caSes conCerning this
property. The vniversity acquired the property about one year ago. They
plan to develop the proposed greenhouse on Maria Avenue this year. `I`he
ti long tez'm Yedevelopment plans for their property to the south
and west call for a community/university library and parking facility.
G. DISTRICT COIINCIL R&CO�NDATION: The Dayton'S Bluff Center for Civic Life
had not taken a position on the rezoning petition at the time the staff
report was drafted.
fi. FINDINGS
i. Metropolitan State University (MSU) owns the property and intends to
lease it to the Minnesota Department of Agriculture (NIDA). t�IDA plans
to construct a greenhouse and intends to grow the types of plants that
can support desirable pests in order to control undesirable pests. NIDA
states that adequate greenhouse facilities are essential in order to
grow the appropriate plant material to support populations of plant
pests and biological control agents and maintain conditions erperienced
by indoor plants. The term biological control refers to the use of
living organisms (in this case insects or mites) to control other
harmful or less desirable pests. For example biological efforts have
succeeded in controlling plant pests in several public buildings and
private settings including Como Park Conservatory, Minnesota Landscape
Arboretum, Mall of America, Rosedale Mall, and Hennepin County Hospital.
The I�IDA and MSU will be cooperating in the greenhouse project to raise
biological control agents. The greenhouse will have five sections and a
head house. Each of Che secCions will house one set of beneficial/pest
organisms. The head house will serve as a prep room as well as a
reception area for up to 20 visitors. One full time employee will be
present Monday through Friday and on some weekends. School groups
already visit NIDA's biocontrol laboratory without a greenhouse. The
proposed greenhouse will provide hands on experience to students,
homeowners, and small businesses who can then use the information in
their homes and offices. I+IDA anticipates 2-3 visits from school groups
per week. MSU has agreed to a11ow parking of buses in their parking lot
to avoid any congestion on Maria Avenue.
Photographs of the pests to control and the biological agents are
attached to this report along with a detailed description of each.

2. The rezoning is in conformance with the comprehensive plan. One of the
development strategies of the Lower Dayton�s Bluff Small Area Plan
states, "area social service agencies and schools should aoordinate
their efforts to address the human service, education, and employment
needs of neighborhood households and promote community stability." #z6,
p.13 In addition, one of the policies of the Economic Development
Strategy states, "the City should periodically review its zoning
regulations and amend them as necessary to keep current with
technological and economic changes affecting the nature of business

activity." #28, p.17
3. The rezoning is consistent and compatible with the way the area has
developed and will not have an adverse impact on the surrounding area,
The rezoning will allow the property which is owned by the university to
be developed for university/state purposes. B-2 zoning is a more
appropriate for this site than B-3 zoning because it is the same zoning
as the rest of the developed portion of the university property.
4. The applicant submitted a sufficient petition signed by two-thirds of
the property owners within one hundred (100) feet of the property to be
rezoned (44 parcels eligible, 30 needed, and 31 parcels signed).
I. STAFF RECONASENDATION: Based on findings 1 through 4 staff recommends
approval of the petition to rezone the property from P-1 to B-2.

� for several years and remember ���hen the St. John's Hospital people came thru with a similar
petition to be signed; at that time it was for rezoning to construct the parking lot which corners
the block between East Sixth Street to East Seventh Street ON nlaria Avenue. They gave a son�
and dance story of how this �i�as eoin� to relieve the parking congestion of the on street parking
that was so ove�iled with the (at that tiine) hospital ��isitors vehicles.
