An ardinance to amend Chapter 410 of the Saint
Paul Legislative Code regarding temporary on-sale beer
licenses to reflect changes made by the state
legislature in the 19961egislative session.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1
Section 410.1 Q of the Saint Pau1 Legilsative Code is hereby amended to read as foliows:
"Sec. 410.10. Temporary on-sale beer license.
(a) Temporary license; fee. Notwithstanding any other provision of this chapter to the contrary,
a club or charitable, teligious or other nonprofit organization in e�stence for at least three (3) years, or
a political committee registered under Minnesota Statutes, Section l0A.14, may obtain a temporary on-
sale license to sa11 nonintoxicating malt liquot on the premises specified in the license, including
playgrounds, school grounds and school buildings. The fee for such license shall be established by
ordinance as provided in section 310.09(b) of the Legislative Code, and shall be paid prior to issuance
of the license.
(b) Application. Application far such licenses shall be made on forms provided by the inspector
and sha11 contain the following:

The name, address and purpose of the organization, together with the names and
addresses of its officers.
The purpose for which the temporary license is sought, together with the place, dates
and hours during which the nonintoxicating mait liquor will be sold.
Consent of the owner or manager of the premises, or person or group with lawful
responsibility for the premises, including city, county, or school district property.
Evidence that the manager or director has received alcohol awazeness training provided
by a bona fide instructor or the city.
(c) Conditions. A temporary license shail be issued subject to the following conditions:

19 (d) Applicability of other provisions of this chapter. No other provisions of this chapter shall
20 apply to licenses granted under this section, except section 410.03(a) through (e); section 410.04(a), (b)
21 and (c); sections 410.05, 410.06, A10.07, 410.09 and 410.10.

23 (e) Music, etc. An organization licensed under this secrion may provide instrumental music with
24 dancing, singing or vaudeville entertainment in connection with said license without regazd to the
25 requirements of Chapter 411 concemang entertainment.

27 (fl CZass II Zicense. Notwithstanding any other provision of law to the contrary, the temporary
28 on-sale beer license pirovided for in this section shall be administered as a Class II license and subject
29 to the provisions of these chapters governing Class II licenses. The inspector shall make all referrals as
30 provided by section 31 Q.Q3, but the director may require the inspectar to issue such license before
31 receiving any recommendations on the application therefor if necessary to issue such license on a
