9 That permission and authority are hereby granted to the Port Authority of the City of Saint and/or
10 its successors in interest to operate and maintain a railroad track across Ridder Circle adjacent
1 1 to Outlots A and B, in Riverview industrial Park No. 12, the location being more accurately
12 described as: Gommencing at the center line intersection of Ridder Gircle and Fillmore Avenue,
13 thence proceeding a distance of 590 feet northeasterly along the center line of Ridder Circle to a
14 point on the center line of said track crossing.

SECTION 2
That the Director of Public Works is hereby authorized to issue a permit to the Port Authority of
the City of Saint Paul andJor its successors in interest for the operation and maintenance of said
railroad track across Ridder Circle, upon and subject to the following provisions, terms, and
conditions.
a. That said permittee andlor its successors in interest expressly agrees and undertakes to fully
indemnify and hold harmless the City of Saint Paul, its agents, officers and employees from any
and all damages, claims, losses, judgments, suits and expenses arising out of the
reconstruction, operation, maintenance andJor removal of said irack authorized by this permit.
b. That the successors in interest of said permittee shall furnish and defiver onto the City of Saint
Paul a Surety Bond in the amount of $10,000.00 for said track, made and executed by said
successors in interest, as Principal and Corporate Surety Company duly authorized to transact
business in the State ofi Minnesota as Surety, to and in favor of the City of Saint Paul as obligee,
so conditioned that, upon the successors in interest failure to maintain or repair
track crossing to a reasonable standard of safety, the City may undertake the maintenance,
repair or removal thereof and may recover its reasonable costs incurred thereby from a said
Surety, which Surety Bond shall remain in force and effect as long as said track or any part
thereof remain in Ridder Circle right-of-way. The Surety Bond shall be in such form as shall be
approved by the City Attorney and shall have such Surety as shaN be approved by the Director
of Finance and Managemeni Services;

c. That said permittee and/or its successors in interest shall, to the satisfaction of the Director of
Public Works, maintain the space lying between the rails of said track and a space of at least
four feet outside of each rail of said track;
d. That said permittee and/or its successors in interest shall register with the Saint Paul
Department of Public Works for use of the right-of-way in accordance with Chaper 116 of the
Saint Paul Legislaive Code and adhere to and fulfill all requirements oE said Chapter 116;
e. That the Council of the City of Saint Paul reserves the right to order the removal of said track
and restoration of the area by the perrnittee or its successors in interest at the sole cost and
expense of the permittee or its successors in interest;
f. That said permittee shaN, within thirry (30) days after the passage of this ordinance, file with the
city clerk its written acceptance thereof.
SECTION 3
This ordinance shall take effect and be in force thirty (30j days from and after its passage,
approval and publication,
