An ordinance amending Chapter 60 of the Saint Paul Legislarive Code pertaining to zoning for the City
of Saint Paul and the zoning maps thereof:
WI�REAS, Pursuant to Minnesota Statutes §462.35� and §64.400 of the Legislative Code, the SAINT
PAUL PORT AUTHORITY duly petitioned to rezone 110 SYCAMORE STREET WEST, being legally
described as except the West 25 feet, Lots 16 and 17; East 75 feet of Lots 18, 19, 20 and 21, Block 1;
Greene's Addifion, from B-3 to I-1 to remedy a split zoning classification of the property, the petition hauing
been certified by the Planning Division on October 25, 1996 as having been consented to by at least 67
percent of the owners of the area of the properiy to be rezoned, and fiuther having been consented to by at
least two-thirds of the owners af the property situated within 160 feet of the total contiguous property within
one year proceeding the date of the petition; and
WI�EIZEAS, The Zonin$ Committee of the Planning Commission held a public heazing on November 25,
1996 for the purpose of considering the rezoning pefition, and pursuant to § 107.03 of the Administrative
Code, submitted its recommendation to the Planning Commission that the petition be granted; and
WFIEREAS, The Planning Commission considered the rezoning petition at its meeting held on December 6,
1996 and recommended that the City Council approve the petifion; and
WIIEREAS, notice of public hearing before the City Council on the said rezoning petition was duly
published in the official newspaper of the City on December 14, 1996 and notices were duly mailed to each
owner of affected property and properiy situated wholly or partly within 350 feet of the property sought to be
rezoned; and
b WHEREAS, a public hearing before the City Council having been conducted on January 22, 1997, where a11
7 interested parties were heard, the Councii having considered all the facts and recommendations concerning
the petiiion; now, therefore

THE SAINT PAIJL PORT AUTHORITY submitted a petition to rezone property at 110 WEST
SYCAMORE STkEET. The Zoning Committee of the Planning Commission held a public hearing on
the proposed rezoning on November 25, 1996. The applicant addressed the committee. At the close of
the public hearing, the committee voted 5-0 to recommend approval to rezone to I-I. The Planning
Commission upheld the Zoning Committee's recommendation for approval on a unanimous vote on
December 6, 1996.
This proposed rezoning is scheduled to be heard by the City Councii on 3anuary 22, 1997. Please notify
me if any member of the City Council wishes to have siides of the site presented at the public hearing.

slides. Staff recommended approval of the petition to rezone to I-1 based an
findings 1 through a outlined in the staff report.
The Aistrict 6 Planning Council had not taken a position on the rezoning
petition at the time the sta£f report was drafted.
Rick Gierdahl, Saint Paul Port Authority, was available to respond to
questions.
No one was present to speak either in support or against the rezoning
petition.
Commissioner Gurney maved approval of the petition to rezone to Z-1 baaed on

PIIRPOSE: Rezone property from B-3 to I-1 to remedy a split zoning
classification of the property.
PARCEL SIZE: The property has 63.66 feet of frontage on Sycamore Street
and is 150.07 feet in depth for a total lot area of 12,558 square feet.
EXSSTING LAND USE: A single story manufacturing building and associated
off-street parking for Northwest Sheet Metal currently is currently under
construction at the site.
D. SURROUNDING LAND USE:
North: Low density residential uses and a radiator repair shop in RT-1
and I-1 zoning districts.
East: Northwest Sheet Metal's new building and Warner Stellian's
Headquarters in an I-1 zoning district.
South: Industrial uses in I-1 and I-2 zoning districts.
West: Vacant land and Dairy Queen restaurant in a B-3 zone.
E. ZONING CODfi CITATION: Section 64.400(a) of the zoning code states in
part, "the council may, from time to time, amend, supplement or change
the district boundaries or the regulations herein, or subsequently .
established herein pursuant to the provisions of Minnesota Statutes
Section 462.357 and amendments thereto as may be made from time to time.
The planning commission may, from time to time, review district boundary
lines to determine if, pursuant to state laws, such district boundary
lines should be changed."
Section 64.4Q0{b) states in gart, "an amendment to the zoning code may be
initiated by the council, the planning commission or by petition of the
owners of sixty-seven (67) percent of the area of the property to be
rezoned."
F. HISTORY/DISCtTSS20N: There are no previous zoning cases ooncerning this
property. The property immediately to the east of the subject site was
rezoned in 1991 as part of the redevelopment of the site as a light
industrial park.

rezone it to remedy a split-zone classification on the development
site. The property is being developed for a fabricator o£ heating
systems called Northwest Sheet Metal. The company's current
development plans do not include use of the progerty to be rezoned for
anything other than open space. fihe rezoning will make the zoning of
the development parcel consistent with the rest of the site and allow
the company to expand or provide additional parking in the future.
The Port Authority intends to se11 the property to the company once
development of the site is complete and the property is rezoned.
The rezoning is consistent with the comprehensive plan. The property
immediately to the south and east is zoned I-1. The property to the
north is zoned I-1 and RT-1. Objectives of the Land Use Plan for
industrial land includes: "encourage the retention and development of
labor intensive light industries"; "assist industries who desire to
expand or relocate within Saint Paul'" and "encourage conditions which
allow the mixing of appropriate light industry with housing and
commercial activities°. #1, #2, #3, p.l.

Policies of the Economic Development Strategy include: "The City's
land use plan should provide adequate land for industrial and
commercial development and expansion in order to increase the �
proportion of commercialJindustrial tax base" and "The City should
periodically review its zoning regulations and amend them as necessary
to keep current with technologic and economic changes affecting the
nature of business activity" #25 , pp, 17 and 18.
Finally, goals and objectives of the District 6 Plan include: "To
encourage and participate in the formulation of appropriate
development of vacant land'� and "To improve the tax base through
better uCilization of the land and appropriate development of vacant
land" #2 and #5, p.6.
The rezoning is consistent and compatible with the way the area has
developed and will not have an adverse impact on surrounding property.
The rezoning will eliminate a split zone classification of Che
development parcel and allow the expansion o£ the business or parking
in the future.
The applicant submitted a sufficient petition signed by two-thirds of
the property owners within one hundred (160) feet of the property to
be rezoning consenting to the rezoning (17 parcels eligible, 12
parcels needed, and 13 parcels signed).
STAP'F RECONB28NDATION: Based on findings 1 through 4 staff recommends
approval o£ the petition to rezone to I-1.

An ordinance amending Chapter 60 of the Saint Paul Legislarive Code pertaining to zoning for the City
of Saint Paul and the zoning maps thereof:
WI�REAS, Pursuant to Minnesota Statutes §462.35� and §64.400 of the Legislative Code, the SAINT
PAUL PORT AUTHORITY duly petitioned to rezone 110 SYCAMORE STREET WEST, being legally
described as except the West 25 feet, Lots 16 and 17; East 75 feet of Lots 18, 19, 20 and 21, Block 1;
Greene's Addifion, from B-3 to I-1 to remedy a split zoning classification of the property, the petition hauing
been certified by the Planning Division on October 25, 1996 as having been consented to by at least 67
percent of the owners of the area of the properiy to be rezoned, and fiuther having been consented to by at
least two-thirds of the owners af the property situated within 160 feet of the total contiguous property within
one year proceeding the date of the petition; and
WI�EIZEAS, The Zonin$ Committee of the Planning Commission held a public heazing on November 25,
1996 for the purpose of considering the rezoning pefition, and pursuant to § 107.03 of the Administrative
Code, submitted its recommendation to the Planning Commission that the petition be granted; and
WFIEREAS, The Planning Commission considered the rezoning petition at its meeting held on December 6,
1996 and recommended that the City Council approve the petifion; and
WIIEREAS, notice of public hearing before the City Council on the said rezoning petition was duly
published in the official newspaper of the City on December 14, 1996 and notices were duly mailed to each
owner of affected property and properiy situated wholly or partly within 350 feet of the property sought to be
rezoned; and
b WHEREAS, a public hearing before the City Council having been conducted on January 22, 1997, where a11
7 interested parties were heard, the Councii having considered all the facts and recommendations concerning
the petiiion; now, therefore

THE SAINT PAIJL PORT AUTHORITY submitted a petition to rezone property at 110 WEST
SYCAMORE STkEET. The Zoning Committee of the Planning Commission held a public hearing on
the proposed rezoning on November 25, 1996. The applicant addressed the committee. At the close of
the public hearing, the committee voted 5-0 to recommend approval to rezone to I-I. The Planning
Commission upheld the Zoning Committee's recommendation for approval on a unanimous vote on
December 6, 1996.
This proposed rezoning is scheduled to be heard by the City Councii on 3anuary 22, 1997. Please notify
me if any member of the City Council wishes to have siides of the site presented at the public hearing.

The Aistrict 6 Planning Council had not taken a position on the rezoning

Rick Gierdahl, Saint Paul Port Authority, was available to respond to
questions.
No one was present to speak either in support or against the rezoning
petition.

PIIRPOSE: Rezone property from B-3 to I-1 to remedy a split zoning
classification of the property.
PARCEL SIZE: The property has 63.66 feet of frontage on Sycamore Street
and is 150.07 feet in depth for a total lot area of 12,558 square feet.
EXSSTING LAND USE: A single story manufacturing building and associated
off-street parking for Northwest Sheet Metal currently is currently under
construction at the site.
D. SURROUNDING LAND USE:
North: Low density residential uses and a radiator repair shop in RT-1
and I-1 zoning districts.
East: Northwest Sheet Metal's new building and Warner Stellian's
Headquarters in an I-1 zoning district.
South: Industrial uses in I-1 and I-2 zoning districts.
West: Vacant land and Dairy Queen restaurant in a B-3 zone.
E. ZONING CODfi CITATION: Section 64.400(a) of the zoning code states in
part, "the council may, from time to time, amend, supplement or change
the district boundaries or the regulations herein, or subsequently .
established herein pursuant to the provisions of Minnesota Statutes
Section 462.357 and amendments thereto as may be made from time to time.
The planning commission may, from time to time, review district boundary
lines to determine if, pursuant to state laws, such district boundary
lines should be changed."
Section 64.4Q0{b) states in gart, "an amendment to the zoning code may be
initiated by the council, the planning commission or by petition of the
owners of sixty-seven (67) percent of the area of the property to be
rezoned."
F. HISTORY/DISCtTSS20N: There are no previous zoning cases ooncerning this
property. The property immediately to the east of the subject site was
rezoned in 1991 as part of the redevelopment of the site as a light
industrial park.

DISTRICT COI747CIL RBCO�NDATION: The District 6 Planning Council had not
taken a position on the rezoning petition at the time the staff report
was drafted.
A. FINDINGS•
The Saint Paul Port Authority owns the progerty and is petitioning to
rezone it to remedy a split-zone classification on the development
site. The property is being developed for a fabricator o£ heating
systems called Northwest Sheet Metal. The company's current
development plans do not include use of the progerty to be rezoned for
anything other than open space. fihe rezoning will make the zoning of
the development parcel consistent with the rest of the site and allow
the company to expand or provide additional parking in the future.
The Port Authority intends to se11 the property to the company once
development of the site is complete and the property is rezoned.
The rezoning is consistent with the comprehensive plan. The property
immediately to the south and east is zoned I-1. The property to the
north is zoned I-1 and RT-1. Objectives of the Land Use Plan for
industrial land includes: "encourage the retention and development of
labor intensive light industries"; "assist industries who desire to
expand or relocate within Saint Paul'" and "encourage conditions which
allow the mixing of appropriate light industry with housing and

developed and will not have an adverse impact on surrounding property.
The rezoning will eliminate a split zone classification of Che
development parcel and allow the expansion o£ the business or parking
in the future.
The applicant submitted a sufficient petition signed by two-thirds of
the property owners within one hundred (160) feet of the property to
be rezoning consenting to the rezoning (17 parcels eligible, 12
parcels needed, and 13 parcels signed).

An ordinance amending Chapter 60 of the Saint Paul Legislarive Code pertaining to zoning for the City
of Saint Paul and the zoning maps thereof:
WI�REAS, Pursuant to Minnesota Statutes §462.35� and §64.400 of the Legislative Code, the SAINT
PAUL PORT AUTHORITY duly petitioned to rezone 110 SYCAMORE STREET WEST, being legally
described as except the West 25 feet, Lots 16 and 17; East 75 feet of Lots 18, 19, 20 and 21, Block 1;
Greene's Addifion, from B-3 to I-1 to remedy a split zoning classification of the property, the petition hauing
been certified by the Planning Division on October 25, 1996 as having been consented to by at least 67
percent of the owners of the area of the properiy to be rezoned, and fiuther having been consented to by at
least two-thirds of the owners af the property situated within 160 feet of the total contiguous property within
one year proceeding the date of the petition; and
WI�EIZEAS, The Zonin$ Committee of the Planning Commission held a public heazing on November 25,
1996 for the purpose of considering the rezoning pefition, and pursuant to § 107.03 of the Administrative
Code, submitted its recommendation to the Planning Commission that the petition be granted; and
WFIEREAS, The Planning Commission considered the rezoning petition at its meeting held on December 6,
1996 and recommended that the City Council approve the petifion; and
WIIEREAS, notice of public hearing before the City Council on the said rezoning petition was duly
published in the official newspaper of the City on December 14, 1996 and notices were duly mailed to each
owner of affected property and properiy situated wholly or partly within 350 feet of the property sought to be
rezoned; and
b WHEREAS, a public hearing before the City Council having been conducted on January 22, 1997, where a11
7 interested parties were heard, the Councii having considered all the facts and recommendations concerning
the petiiion; now, therefore
1 THE COUNCIL OF THE CITY OF SAINT PALIL DOES ORDAIN:

That the zoning map of the City of Saint Paul, Sheet Nuxnber 12, as incorporated by reference in §60.301
of the Saint Paul Legislative Code, as amended, is hereby further amended as follows:

THE SAINT PAIJL PORT AUTHORITY submitted a petition to rezone property at 110 WEST
SYCAMORE STkEET. The Zoning Committee of the Planning Commission held a public hearing on
the proposed rezoning on November 25, 1996. The applicant addressed the committee. At the close of
the public hearing, the committee voted 5-0 to recommend approval to rezone to I-I. The Planning
Commission upheld the Zoning Committee's recommendation for approval on a unanimous vote on
December 6, 1996.
This proposed rezoning is scheduled to be heard by the City Councii on 3anuary 22, 1997. Please notify
me if any member of the City Council wishes to have siides of the site presented at the public hearing.

Rick Gierdahl, Saint Paul Port Authority, was available to respond to
questions.
No one was present to speak either in support or against the rezoning
petition.

PIIRPOSE: Rezone property from B-3 to I-1 to remedy a split zoning
classification of the property.
PARCEL SIZE: The property has 63.66 feet of frontage on Sycamore Street
and is 150.07 feet in depth for a total lot area of 12,558 square feet.
EXSSTING LAND USE: A single story manufacturing building and associated
off-street parking for Northwest Sheet Metal currently is currently under
construction at the site.
D. SURROUNDING LAND USE:
North: Low density residential uses and a radiator repair shop in RT-1
and I-1 zoning districts.
East: Northwest Sheet Metal's new building and Warner Stellian's
Headquarters in an I-1 zoning district.
South: Industrial uses in I-1 and I-2 zoning districts.
West: Vacant land and Dairy Queen restaurant in a B-3 zone.
E. ZONING CODfi CITATION: Section 64.400(a) of the zoning code states in
part, "the council may, from time to time, amend, supplement or change
the district boundaries or the regulations herein, or subsequently .
established herein pursuant to the provisions of Minnesota Statutes
Section 462.357 and amendments thereto as may be made from time to time.

property. The property immediately to the east of the subject site was
rezoned in 1991 as part of the redevelopment of the site as a light

taken a position on the rezoning petition at the time the staff report
was drafted.
A. FINDINGS•
The Saint Paul Port Authority owns the progerty and is petitioning to
rezone it to remedy a split-zone classification on the development
site. The property is being developed for a fabricator o£ heating
systems called Northwest Sheet Metal. The company's current
development plans do not include use of the progerty to be rezoned for
anything other than open space. fihe rezoning will make the zoning of
the development parcel consistent with the rest of the site and allow
the company to expand or provide additional parking in the future.
The Port Authority intends to se11 the property to the company once
development of the site is complete and the property is rezoned.
The rezoning is consistent with the comprehensive plan. The property
immediately to the south and east is zoned I-1. The property to the
north is zoned I-1 and RT-1. Objectives of the Land Use Plan for
industrial land includes: "encourage the retention and development of
labor intensive light industries"; "assist industries who desire to
