An ordinance repealing Saint Paul Legislative Code Chapter 220,
pertaining to dumping on private property
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1
Chapter 220 of the Saint Paul Legislative Code shall be and hereby is repealed in its entirety.
Section 2
This ordinance shall take effect and be in force thirty (30) days following its passage,
approval and publication.

INITIATING PROBLEM, ISSUE, OPPORTUNITY (Who, What, When, Where, Why):
Currently Chapter 220 gives certain auChority to the Dept. of Public Works for
issuing permits to deposit clean £ill on private property. Chapter 33 of the
Leg. Code authorizes the Building Official in LIEP to issue grading permits
for land filling activities in conjunction with construotion. LIEP also
enforces erosion/sediment control practices associated with land filling
activities. Having two permitting authorities presented enforcement problems
for staff and confusion for the public. Per and agreement with Public Works in
1994, the Building Inspection Section of ZIEP took over responsibilities for
issuing fill permits. The proposed amendments to the ordinance would legally
recognize this a reement and provide the necessary enablin language.
VANTAGES IF APPROVED:
1)Provides one place for the public to obtain a permit.
2)Eliminates historical en£orcement problem by making one agency responsible
for compliance monitoring.
3)LIEP's business is issuing permits and licenses on private property. Sinoe
ost of these land filling activities occur on private property the shift of
this responsibility from Public Works to LIEP is appropriate.
ISADVANTAGES IF APPROVED:

ISADVANTAGES IF NOT APPROVED:
Continuing the dual permitting function in both Public Works and LIEP is an
inefficient delivery of services to the publie and is inconsistent with
current state and county rules.

RE: Changes to Legisfative Code for Permitting Dumping of Fiil on Private Property.
This memo confirms the voice-mail I received from you on May 20th indicating your
approval of the proposed changes to Chapter 220. and Chapter 33, concerning the above.
Regarding the definition of "clean fili", this is the terminology used in the Ramsey County
Solid Waste Ordinance. Since the County regulates the dumping of materiais not meeting
the clean fill specifications, it is appropriate to use the same definitions for consistency of
enforcement between the two jurisdictions. Also, the maximum 10% allowance for clean
fill to consist of concrete, giass, brick or similar inert material is a recognition that you may
have some of this type of material mixed with natural soils. As long as the size of the
material doesn't present a compaction issue this would not present any problems.
I am sending these ordinance changes to the City Attorney's Office for review and then on
to the City Council for their consideration.
