An ordinance amending chapters 87, 88, 89, 90, 91 and 93 of the Saint Paul
Legislative Code pertaining to the rules and regulations of the Saint Paul Water
Utility as recommended by the Boazd of Water Commissioners of the City af

The Council of the City of Saint Paul Does Ordain:
Section 1
That the following section 87 of the Saint Paul Legislative Code is hereby amended as
follows:
Chapter 87. Water Code--Water Service Connecfions
Sec. 87.03. Installation, maintenance and guarantee.
(a) Installation. The properiy owner or agent must distinctly stake, and mazk, the point �n
the property line where the street service connection is to enter the premises. Water service
connections sha11 be installed in accordance with water utility standards. The point where the
street service connection is to enter the property must be distinctly mazked, by a stake, by the
owner or agent before the street service connection is installed, and said stake sha11 be marked
"water" and shali be no closer to the house drain location than ten (10) feet horizontally.
(b) Limits of installation and maintenance. The water utility shall instail all �€

6 water service connection or fue service connection between the pLOperiy line and the meter shall
7 be installed and at all times maintained by the owner. Certain obstacles such as trees, utilities,
s retaining walls and other obstructions may make it advisable for the owner or the owner's
9 plumber to install a replacement water service connection from the meter to the stop valve in the
1 o boulevard. Such an installarion may be authorized by the water utility if, after review by the
11, utiliTy, it is deemed to be in the best interests of both parties. Service connection piping installed
12 by the owner's plumber between the properry line and the stop valve in the boulevard with water
13 utility approval shall be guaranteed as if it has been installed by the water ufility.

15 (c) Authorized material-existing street service connections. If an eacisting street service
16 connecfion eactends to a properry on which a new building is proposed, application for use of the
17 street service connection to serve said building shall not be accepted if the existing street service
18 connection is constructed of lead or galvanized 'aron. A new application for water service must
19 be made and paid for by the owner.

(d) Authorized material-repair. Service connections shall be replaced and not repaired if
conshucted of lead or galvanized 'uon.
(e) Street service connections; maintenance and guarantee.

33 shall be repaired and maintained by the properiy owner except as provided in section 87.03(b).

for the implementation of this replacement program.
Sec. 87.12. Cost of large street service connections.

Charges for street service connections in a cul-de-sac are to be based on a street width
equivalent to seventy-five (75) percent of the cul-de-sac diameter.
If a street has two (2) mains on opposite sides of the street, the schedule for a street of
one-half the width shall be utilized to establish the charge, but in no case shall the charge
be less than the charge for a sixty-foot street.

For a second pipe in same ditch, the charge shall be in accardance with Table I.
Where excavation and backfilling is provided by others, the charge shall be the schedule
for second pipe in same ditch in accordance with Table I, with the exception of the

2 9 a casing tube is required for the street service connection installation, the properry owner

Sec. 87.17. Service connections where property was not previously assessed.

18 Parcels of land not previously assessed for an existing abutting permanent water main and
19 desiring a connection with said permanent main shall be granted permission to connect such
2 0 pazcel of land after a payment shall haue been made to the board of water commissioners in the
21 amount of twen dollars ($�9�0-
22 � per assessable front foot of land to be served, or at the assessment rate as levied at the
2 3 time the permanent main was installed, whichever assessment rate is greater. For irregular shaped
24 pazcels of land, the assessable footage shall be determined by the city's real estate division.

2 6 Sec. 87.18. Thawing of frozen water service connections and fire services.

2 8 (a) The property owner shall protect from freezing that part of the water service
2 9 connection and fire service within private property. If either type of connection does freeze, the
3 o property owner is responsible for retaining a private thawing company to restore water delivery
31 to the premises, all work to be in accordance with the standards of the water utility. When labor
32 and equipment are available in sufficient numbers, the urility may offer to thaw such sections of

35 operations, and provided the owner agrees to pay and deposit in advance a sum equal to the

(b) If the utility deternunes that the frozen secrion is in the street right-of-way, the utility
may thaw the service without charge. If the owner elects to have the section of the service
thawed by a private contractor at the owner's expense, all work shall be in accordance with
standazds of the utility.

That the following section 88 of the Saint Paul Legislative Code is hereby amended as
follows:
Chapter 88. Water Code--Meters

(b) If the meter is found to be registering in excess of one hundred two percent (102%) of
actual flow, the deposit will be returned to the consumer. If not, the deposit will be retained by
the utility to offset the cost of the meter test.
(c) The meter sha11 be tested at three (3) rates of flow: masimum, intermediate, and
minunum, as defined by the American Water Works Association (AVJVJA) Standard far Testing
Cold Water Meters, C 705-60 or latest revision thereof.
(d) The owner may, if desired, be present at the time the meter is tested. The result of the
test shall be reported to the owner in every case.
Section 3
That the following section 89 of the Saint Paul Legislative Code is hereby amended as
follows:

(a) The board of water commissioners may render a special service to private property for
private fue protection purposes.
(b) The annual charges sha11 be made in accordance with ttte following schedule based
upon the size of the service connection, and such charges shall cover the cost of the special
service rendered; the cost of all water used exclusively for fire extinguishing purposes; water
used for testing the fire equipment; testing and inspections by the water utility; �°` .��

15 The owner shall cause to be installed and maintained on the service, as directed and

2 o Sec. 89.11. Number of services.

22 One service only will be allowed to any one building or premises unless, in the opinion of
23 the board of water commissioners, more than one is absolutely necessary for the proper
24 protection of the premises. All fire protection equipment connected to the ciry service shall be
2 5 confined within the building or on the premises named in the application, and, where two (2) or
26 more connecrions aze made for one building or premises they shall be kept sepazated unless
2 7 special permission is obtained from the � �. to connect the

3 0 Sec. 89.12. Use of service.

3 2 (a) No water shall be drawn from the fire service pipes for any purpose whatever except
3 3 far the extinguishment of fire. This section is not to be construed as prohibiting the use of water
3 4 for drainage of a system to prevent freezing or for proper testing of the fire protection facilities in
3 5 accordance with water utility 1'unitation standazds. Use of water above the limitation standards
3 6 shall be paid for by the owner at the consumprion rate in effect at the time of such usage.

3 8 (b) Any owner or tenant on whose premises a fire protection se�iee . is installed
3 9 who sha11 tap or allow to be tapped any fire service pipe for other than fire protection purposes

42 Sec. 89.13. Cross connections.

44 (a) Any fire protection system supplied with water from the city service shall be supplied
4 5 exclusively with such water, and no connection will be allowed with any other system drawing
4 6 its supply from any other source whereby the ciry water supply may be subjected to
4 7 contamination by failure to close valves, or leaking check valves, etc., and no aiixiliary or
4 8 secondary suction pipe to any pumping system taking water from any private source will be

1 (b) Any fire protection system using water from any other source than the city service
2 shall be kept entirely sepazate from any such system supplied from the city service.
4 (c) Cross connections to domestic service. No connection shall be made at any time
5 between the fire service pipe system and the regular water supply to the premises unless such
6 connection shall have been approved by the _watei utility. Valves on hose outlets, drain cocks,
7 etc., placed on the pipe system shall be of a style that can be sealed by the water urility.

(b) All combined systems shall be installed and metered in accardance with water utility
standazds.
(c) The maintenance and guarantee of combined fire st�l� and domestic water systems
sha11 be the same as provided in Section 89.10 above.

3 7 Sec. 89.16. Illegal use of fire service.

3 9 In any case when the owners or occupants of any premises are found to be using water
4 0 from a fire service for any purpose other than fire protection, the water sha11 be shut off from

3 the expense of the owner, and any registration of water which has not been legitimately used for
4 fire protection will be charged at the regulaz consumprion rate (not including the fi.zed charge for
5 water.)
7 Sec. 8917. Excepfions.
9 (a) Standpipes hereinafter installed in an unsprinklered building and to be used
1 o exclusively fox fire protection purposes sha11 be considered as a fire su�y s�"„�� and installed

11 in accordance with this chapter, except that a maximum of three (3) such standpipes may, with
12 written pernussion, be supplied with water through the domestic service; provided, that the size
i3 of such standpipes shall be no larger than the size of the domestic water meter; and provided
14 further; that the building has no other fire protection service to wkrich they can be connected.
15 Wet standpipe systems shall be sepazated from the domesfic water system by use of an approved
16 type backflow preventer. No anrifreeze shall be introduced into existing standpipe systems
17 unless that system meets the current provisions of the State Plumbing Code. Property owners
18 shall notify the utility when additives are used in a system.

2 0 (b) Automatic sprinklers to be installed in a building not served by a separate automatic
21 fire service and to be used exclusively far fire protecfion purposes may be installed in accordance
2 2 with the provisions of this chapter, except that the design demand of the automatic sprinlcler shall
2 3 not exceed the capacity of the domestic service and meter. If a proposed automatic sprinkler
24 system design demand exceeds one hundred fifry (150) gallons per minute, a separate fire service
2 5 is required. Automatic sprinkler interior piping shall be sepazated from the domestic water
2 6 system by use of an approved type backflow preventer. No antifreeze shall be introduced into
27 existing automatic sprinkler systems unless that system meets the current provisions of the State
2 8 Plumbing Code. Property owners shall notify the utility when additives are used in a system.

Sec. 89.18. Violation of rules.

8 Sec. 90.02. Permits.

10 (a) Application for permits to use a fire hydraut shall be made at the office of the boazd of
11 water commissioners. Permits will be granted only when, in the opinion of the �zr;�����
12 , the use of the fire hydrant will not unduly jeopardize the rights of
13 the public and when water cannot be conveniently had from any other source.

15 (b) . Permits will be issued for a
16 minnnum period of thirty (30) days or multiple tl�irty-day periods and are renewable thereafter at

(c) The location of the hydrant or hydrants used shall be as shown on the permit, which
shall be available for inspection by water utility inspectors at a11 times.
Sec. 90.03. Cash deposit required.
24 Applicants to whom pernvts aze granted shall be required to make a cash deposit of �ae
2 5 �e&€� �b� dollars ($�39 .00) in advance. The deposit is for the purpose of
2 6 guazanteeing payment far water used and to cover any breakage or damage to the fire hydrant or
2 7 meter. Upon return of the equipment issued to the permittee by the utility, said deposit, less
28 chazges against the permittee's account, will be returned to the permittee.

WATER CODE REVISIONS

StafFis proposing numerous revisions to sections ofthe Legislative Code which aze collecrively
refened to as the Water Code. The proposed revisions range in scope from simple word changes
for clarification to revisions of chazges for work performed by Water Utility forces. The Boazd of
Water Commissioners has approved the revisions and has recommended the Council amend the
code accordingly.
The following summary is intended to address the substantive proposals of each Chapter.
Changes in phrasing and tenninology far the purpose of improved accuracy and clarity, and
numerous replacements of "board" with "water utility" when the referenced action is presently
and rightfully performed by staff are not individually addressed.
Chapter 87. Water Code--Water Service Connections
Sec. 87.03. Installation, maintenance and guarantee.
(b) and (e)
Installation and maintenance language was revised to reflect 1997 changes to the Water Utility
Standards for the Installation of Mains which allowed service connection installation by
contractor in certain situations.

(f) lstparagraph
This revision eliminates the requirement that a building must exist on the property in order for
the property owner to receive a free lead replacement street service when the property owner
installs new piping in the property. This revision results in equal treatment to property owners
who redevelop or move existing buildings onto vacant lots with those who refurbish existing
buildings.
(f) 3d pazagraph
If a lead slreet service replacement is in a location different from the existing, the existing lead
service must be cut off and an additional street excavation must be performed. This proposal
requires properry owner pay the achxal cost if the cut off is requested by the property owner.
Sec. 87.14. Charges for street service connections.
(a) The downtown area used to be described in Sec 8716 Cut off charges which is proposed for
eliminarion. It is now described in this section.
The proposed statement at the beginning of Table I identifies for the first time all activities
covered by the schedule chaiges. All b�at the first meter setting are currently covered. That
proposal is explained in Sec 88.07. Cost of setting.

The following changes to the current chazges for installation of street service connections aze
proposed:
- 4-inch and larger connections to be chazged actual cost
- Rock chazge to be actual cost
- Frost charge to be at schedule chazge which is proposed to be increased by 50%
- 2-inch and smaller connections to be at schedule chazge and right-of-way width
categories combined to reduce the number of categories.
- 1%2 -inch and smaller connections to be raised 7.5% for 1998 and raised again on
January 1, 1999 to 15% above 1997 charges. Table I reflects these increases. (2-inch
connection chazges to remain unchanged)
(b) This $75 administrative fee was first instituted in 1991 on certain Maplewood services
installed by contractor. Incorporating it into the Water Code is necessary now that the op6on of
contractor installed services in certain situations is available to all retail suburban communities.
Sec. 87.15. Additional costs; street repair and extraordinary excavation charges.
(3) The City of St. Paul began enforcing their new street permit charges on August 18, 1947. All
utilities, including the Water Utility, have begun paying these new charges for street disruption.
The proposed amount of $55 per service connection will reimburse the Utility for those costs
until such time as permit charges are increased.
(4) The following changes to the current charges for installation of street service connections aze
proposed:
- 4-inch and lazger connections to be chazged actual cost.
- 2-inch and smaller connections to be at schedule charge and right-of-way width
categories combined to reduce the number of categories. Cost for the common
residential service connection to be increased by 15%.
Sec. 87.16. Cut off charge.
Properiy owners will no longer be charged for the cut off of unused street service connections
when a properiy is redeveloped. Those costs will be included in the maintenance budget. If a cut
off is requested for whatever reason by the property owner, the property owner will be charged
the actual cost of the cut off.

Sec. 87.17. Service connections where property was not previously assessed.
This chazge to property owners not previously assessed for water main has historically been the
same as that chazged for sewer. Raising the chazge to $25 per assessable foot will again bring it
into parity with the sewer charge.
Sec. 87.18. Thawing offrozen service connections and fzre services.
Property owners who choose to request the Water Utility thaw their service in private properry
will be chazged the Utility's actual costs.
Chapter 88. Water Code--Meters
Sec. 88.07. Costofsetting.
The proposed elimination of a charge for the first meter setting is in response to numerous
customer complaints. It is proposed tk•.at this cost now be rolled into the schedule charge for
service installation.
Sec. 88.11. Meter testing.
The proposed increase in chazges for meter testing mare closely approximates the Utility's cost
to perform this work. As before, this chazge is incurred only if the meter is found to be
registering 102% or less of actual flow.
Chapter 89. Water Code--Fire Services
Discussions with the Fire Department during the past two years have resulted in staffls
recommendation that approval of fire service size come from the Fire Department based on the
hydraulic calculations which aze already performed for each service by a fire sprinkler company.
The Water Utility currently provides a redundant evaluation and size approval process which is
not necessary. Proposed revisions in Secs. 89.04, 89.05 and 8915.1 address this change.
Sec. 89. 06. Installation by board.
This section has been eliminated because the statements are more appropriate to Sec. 87. 03 (b)
Limits of installation and maintenance and they have been transfered to that section.
Chapter 90. Water Code--Fire Hydrants
Sec. 90. 04. Charges for hydrant rental
Staff proposes the following revisions:
Raise the refundable deposit for necessary hydrant equipment from $250 to $300 to
more closely reflect the costs to repair damaged equipment.

Raise the additional monthly charge for winter usage from $25 to $30 to more closely
reflect the costs of frequent inspections and maintenance trips required during winter
months. The charge was last increased in 1990.
- Chazge $10 per month per hydrant used on each pernut instead of requiring one pernut
for each hydrant used. Staff believes this will decrease the number of unreported
hydrants used by permittees.
Chapter 91. Water Code--Miscellaneous Provisions
Sec. 91. 03. Water conservation
It is proposed to require water conserving devices on all new lawn sprinkler systems. According
to Rain Bird Sprinkler Systems, reliable devices can be purchased locally for $35 and can be
installed for approximately $50.
Sec. 91.13. Turn-on service charge.
This section was revised to create a new term, "collection service fee", to describe the charge
currently due if a truck is dispatched to turn off a water service for non-payment of delinquent
charges and the charges are subsequently paid to avoid turn off of service. This charge was
previously referred to as the same "turn-on service charge" which must be paid to get a service
turned back on. This has caused confusion with those who must pay the charge because no water
is actually turned off, making it appear inappropriate for the Utility to charge a"turn-on service
charge".
Sec. 91.17. Private water facilities, maintenance.
This new section is proposed to clarify maintenance responsibilities on private facilities. The
most common of these aze hydrants on the private property portion of fire services.
Chapter 93. Water Code---Water Service Connections (Size and Location)
Sec. 93. 03. Water service connections, depth.
Language was revised to reflect 1997 changes to the Water Utility Standards for the Tnstallation
of Mains which increased the depth requirement to 8A feet.
Sec. 93.05. Water service connection in sewer trench
Language was revised to reflect 1997 changes to the Water Utility Standards for the Installation
of Mains which allowed service connection installation by contzactor in certain situations.
Sec. 93.07. Size determined by utility
This proposed revision matches the changes discussed in Sec. 89. Fire services. where the Fire
Department will issue approval of fire service size.

2 3 not exceed the capacity of the domestic service and meter. If a proposed automatic sprinkler
24 system design demand exceeds one hundred fifry (150) gallons per minute, a separate fire service

WATER CODE REVISIONS

StafFis proposing numerous revisions to sections ofthe Legislative Code which aze collecrively
refened to as the Water Code. The proposed revisions range in scope from simple word changes
for clarification to revisions of chazges for work performed by Water Utility forces. The Boazd of
Water Commissioners has approved the revisions and has recommended the Council amend the
code accordingly.
The following summary is intended to address the substantive proposals of each Chapter.
Changes in phrasing and tenninology far the purpose of improved accuracy and clarity, and
numerous replacements of "board" with "water utility" when the referenced action is presently
and rightfully performed by staff are not individually addressed.
Chapter 87. Water Code--Water Service Connections
Sec. 87.03. Installation, maintenance and guarantee.
(b) and (e)
Installation and maintenance language was revised to reflect 1997 changes to the Water Utility
Standards for the Installation of Mains which allowed service connection installation by
contractor in certain situations.

(f) lstparagraph
This revision eliminates the requirement that a building must exist on the property in order for
the property owner to receive a free lead replacement street service when the property owner
installs new piping in the property. This revision results in equal treatment to property owners
who redevelop or move existing buildings onto vacant lots with those who refurbish existing
buildings.
(f) 3d pazagraph
If a lead slreet service replacement is in a location different from the existing, the existing lead
service must be cut off and an additional street excavation must be performed. This proposal
requires properry owner pay the achxal cost if the cut off is requested by the property owner.
Sec. 87.14. Charges for street service connections.
(a) The downtown area used to be described in Sec 8716 Cut off charges which is proposed for
eliminarion. It is now described in this section.
The proposed statement at the beginning of Table I identifies for the first time all activities
covered by the schedule chaiges. All b�at the first meter setting are currently covered. That
proposal is explained in Sec 88.07. Cost of setting.

The following changes to the current chazges for installation of street service connections aze
proposed:
- 4-inch and larger connections to be chazged actual cost
- Rock chazge to be actual cost
- Frost charge to be at schedule chazge which is proposed to be increased by 50%
- 2-inch and smaller connections to be at schedule chazge and right-of-way width
categories combined to reduce the number of categories.
- 1%2 -inch and smaller connections to be raised 7.5% for 1998 and raised again on
January 1, 1999 to 15% above 1997 charges. Table I reflects these increases. (2-inch
connection chazges to remain unchanged)
(b) This $75 administrative fee was first instituted in 1991 on certain Maplewood services
installed by contractor. Incorporating it into the Water Code is necessary now that the op6on of
contractor installed services in certain situations is available to all retail suburban communities.
Sec. 87.15. Additional costs; street repair and extraordinary excavation charges.
(3) The City of St. Paul began enforcing their new street permit charges on August 18, 1947. All
utilities, including the Water Utility, have begun paying these new charges for street disruption.
The proposed amount of $55 per service connection will reimburse the Utility for those costs
until such time as permit charges are increased.
(4) The following changes to the current charges for installation of street service connections aze
proposed:
- 4-inch and lazger connections to be chazged actual cost.
- 2-inch and smaller connections to be at schedule charge and right-of-way width
categories combined to reduce the number of categories. Cost for the common
residential service connection to be increased by 15%.
Sec. 87.16. Cut off charge.
Properiy owners will no longer be charged for the cut off of unused street service connections
when a properiy is redeveloped. Those costs will be included in the maintenance budget. If a cut
off is requested for whatever reason by the property owner, the property owner will be charged
the actual cost of the cut off.

Sec. 87.17. Service connections where property was not previously assessed.
This chazge to property owners not previously assessed for water main has historically been the
same as that chazged for sewer. Raising the chazge to $25 per assessable foot will again bring it
into parity with the sewer charge.
Sec. 87.18. Thawing offrozen service connections and fzre services.
Property owners who choose to request the Water Utility thaw their service in private properry
will be chazged the Utility's actual costs.
Chapter 88. Water Code--Meters
Sec. 88.07. Costofsetting.
The proposed elimination of a charge for the first meter setting is in response to numerous
customer complaints. It is proposed tk•.at this cost now be rolled into the schedule charge for
service installation.
Sec. 88.11. Meter testing.
The proposed increase in chazges for meter testing mare closely approximates the Utility's cost
to perform this work. As before, this chazge is incurred only if the meter is found to be
registering 102% or less of actual flow.
Chapter 89. Water Code--Fire Services
Discussions with the Fire Department during the past two years have resulted in staffls
recommendation that approval of fire service size come from the Fire Department based on the
hydraulic calculations which aze already performed for each service by a fire sprinkler company.
The Water Utility currently provides a redundant evaluation and size approval process which is
not necessary. Proposed revisions in Secs. 89.04, 89.05 and 8915.1 address this change.
Sec. 89. 06. Installation by board.
This section has been eliminated because the statements are more appropriate to Sec. 87. 03 (b)
Limits of installation and maintenance and they have been transfered to that section.
Chapter 90. Water Code--Fire Hydrants
Sec. 90. 04. Charges for hydrant rental
Staff proposes the following revisions:
Raise the refundable deposit for necessary hydrant equipment from $250 to $300 to
more closely reflect the costs to repair damaged equipment.

Raise the additional monthly charge for winter usage from $25 to $30 to more closely
reflect the costs of frequent inspections and maintenance trips required during winter
months. The charge was last increased in 1990.
- Chazge $10 per month per hydrant used on each pernut instead of requiring one pernut
for each hydrant used. Staff believes this will decrease the number of unreported
hydrants used by permittees.
Chapter 91. Water Code--Miscellaneous Provisions
Sec. 91. 03. Water conservation
It is proposed to require water conserving devices on all new lawn sprinkler systems. According
to Rain Bird Sprinkler Systems, reliable devices can be purchased locally for $35 and can be
installed for approximately $50.
Sec. 91.13. Turn-on service charge.
This section was revised to create a new term, "collection service fee", to describe the charge
currently due if a truck is dispatched to turn off a water service for non-payment of delinquent
charges and the charges are subsequently paid to avoid turn off of service. This charge was
previously referred to as the same "turn-on service charge" which must be paid to get a service
turned back on. This has caused confusion with those who must pay the charge because no water
is actually turned off, making it appear inappropriate for the Utility to charge a"turn-on service
charge".
Sec. 91.17. Private water facilities, maintenance.
This new section is proposed to clarify maintenance responsibilities on private facilities. The
most common of these aze hydrants on the private property portion of fire services.
Chapter 93. Water Code---Water Service Connections (Size and Location)
Sec. 93. 03. Water service connections, depth.
Language was revised to reflect 1997 changes to the Water Utility Standards for the Tnstallation
of Mains which increased the depth requirement to 8A feet.
Sec. 93.05. Water service connection in sewer trench
Language was revised to reflect 1997 changes to the Water Utility Standards for the Installation
of Mains which allowed service connection installation by contzactor in certain situations.
Sec. 93.07. Size determined by utility
This proposed revision matches the changes discussed in Sec. 89. Fire services. where the Fire
Department will issue approval of fire service size.

11, utiliTy, it is deemed to be in the best interests of both parties. Service connection piping installed
12 by the owner's plumber between the properry line and the stop valve in the boulevard with water
13 utility approval shall be guaranteed as if it has been installed by the water ufility.

16 connecfion eactends to a properry on which a new building is proposed, application for use of the
17 street service connection to serve said building shall not be accepted if the existing street service

Charges for street service connections in a cul-de-sac are to be based on a street width
equivalent to seventy-five (75) percent of the cul-de-sac diameter.
If a street has two (2) mains on opposite sides of the street, the schedule for a street of
one-half the width shall be utilized to establish the charge, but in no case shall the charge
be less than the charge for a sixty-foot street.

18 Parcels of land not previously assessed for an existing abutting permanent water main and
19 desiring a connection with said permanent main shall be granted permission to connect such

2 8 (a) The property owner shall protect from freezing that part of the water service

(b) If the meter is found to be registering in excess of one hundred two percent (102%) of
actual flow, the deposit will be returned to the consumer. If not, the deposit will be retained by
the utility to offset the cost of the meter test.
(c) The meter sha11 be tested at three (3) rates of flow: masimum, intermediate, and
minunum, as defined by the American Water Works Association (AVJVJA) Standard far Testing
Cold Water Meters, C 705-60 or latest revision thereof.
(d) The owner may, if desired, be present at the time the meter is tested. The result of the
test shall be reported to the owner in every case.

3 2 (a) No water shall be drawn from the fire service pipes for any purpose whatever except

3 4 for drainage of a system to prevent freezing or for proper testing of the fire protection facilities in
3 5 accordance with water utility 1'unitation standazds. Use of water above the limitation standards

6 connection shall have been approved by the _watei utility. Valves on hose outlets, drain cocks,
7 etc., placed on the pipe system shall be of a style that can be sealed by the water urility.

7 Sec. 8917. Excepfions.
9 (a) Standpipes hereinafter installed in an unsprinklered building and to be used
1 o exclusively fox fire protection purposes sha11 be considered as a fire su�y s�"„�� and installed

11 in accordance with this chapter, except that a maximum of three (3) such standpipes may, with
12 written pernussion, be supplied with water through the domestic service; provided, that the size
i3 of such standpipes shall be no larger than the size of the domestic water meter; and provided
14 further; that the building has no other fire protection service to wkrich they can be connected.
15 Wet standpipe systems shall be sepazated from the domesfic water system by use of an approved
16 type backflow preventer. No anrifreeze shall be introduced into existing standpipe systems
17 unless that system meets the current provisions of the State Plumbing Code. Property owners
18 shall notify the utility when additives are used in a system.

2 0 (b) Automatic sprinklers to be installed in a building not served by a separate automatic
21 fire service and to be used exclusively far fire protecfion purposes may be installed in accordance
2 2 with the provisions of this chapter, except that the design demand of the automatic sprinlcler shall
2 3 not exceed the capacity of the domestic service and meter. If a proposed automatic sprinkler
24 system design demand exceeds one hundred fifry (150) gallons per minute, a separate fire service
2 5 is required. Automatic sprinkler interior piping shall be sepazated from the domestic water
2 6 system by use of an approved type backflow preventer. No antifreeze shall be introduced into
27 existing automatic sprinkler systems unless that system meets the current provisions of the State
2 8 Plumbing Code. Property owners shall notify the utility when additives are used in a system.

WATER CODE REVISIONS

StafFis proposing numerous revisions to sections ofthe Legislative Code which aze collecrively
refened to as the Water Code. The proposed revisions range in scope from simple word changes
for clarification to revisions of chazges for work performed by Water Utility forces. The Boazd of
Water Commissioners has approved the revisions and has recommended the Council amend the
code accordingly.
The following summary is intended to address the substantive proposals of each Chapter.
Changes in phrasing and tenninology far the purpose of improved accuracy and clarity, and
numerous replacements of "board" with "water utility" when the referenced action is presently
and rightfully performed by staff are not individually addressed.
Chapter 87. Water Code--Water Service Connections
Sec. 87.03. Installation, maintenance and guarantee.
(b) and (e)
Installation and maintenance language was revised to reflect 1997 changes to the Water Utility
Standards for the Installation of Mains which allowed service connection installation by
contractor in certain situations.

(f) lstparagraph
This revision eliminates the requirement that a building must exist on the property in order for
the property owner to receive a free lead replacement street service when the property owner
installs new piping in the property. This revision results in equal treatment to property owners
who redevelop or move existing buildings onto vacant lots with those who refurbish existing
buildings.
(f) 3d pazagraph
If a lead slreet service replacement is in a location different from the existing, the existing lead
service must be cut off and an additional street excavation must be performed. This proposal
requires properry owner pay the achxal cost if the cut off is requested by the property owner.
Sec. 87.14. Charges for street service connections.
(a) The downtown area used to be described in Sec 8716 Cut off charges which is proposed for
eliminarion. It is now described in this section.
The proposed statement at the beginning of Table I identifies for the first time all activities
covered by the schedule chaiges. All b�at the first meter setting are currently covered. That
proposal is explained in Sec 88.07. Cost of setting.

The following changes to the current chazges for installation of street service connections aze
proposed:
- 4-inch and larger connections to be chazged actual cost
- Rock chazge to be actual cost
- Frost charge to be at schedule chazge which is proposed to be increased by 50%
- 2-inch and smaller connections to be at schedule chazge and right-of-way width
categories combined to reduce the number of categories.
- 1%2 -inch and smaller connections to be raised 7.5% for 1998 and raised again on
January 1, 1999 to 15% above 1997 charges. Table I reflects these increases. (2-inch
connection chazges to remain unchanged)
(b) This $75 administrative fee was first instituted in 1991 on certain Maplewood services
installed by contractor. Incorporating it into the Water Code is necessary now that the op6on of
contractor installed services in certain situations is available to all retail suburban communities.
Sec. 87.15. Additional costs; street repair and extraordinary excavation charges.
(3) The City of St. Paul began enforcing their new street permit charges on August 18, 1947. All
utilities, including the Water Utility, have begun paying these new charges for street disruption.
The proposed amount of $55 per service connection will reimburse the Utility for those costs
until such time as permit charges are increased.
(4) The following changes to the current charges for installation of street service connections aze
proposed:
- 4-inch and lazger connections to be chazged actual cost.
- 2-inch and smaller connections to be at schedule charge and right-of-way width
categories combined to reduce the number of categories. Cost for the common
residential service connection to be increased by 15%.
Sec. 87.16. Cut off charge.
Properiy owners will no longer be charged for the cut off of unused street service connections
when a properiy is redeveloped. Those costs will be included in the maintenance budget. If a cut
off is requested for whatever reason by the property owner, the property owner will be charged
the actual cost of the cut off.

Sec. 87.17. Service connections where property was not previously assessed.
This chazge to property owners not previously assessed for water main has historically been the
same as that chazged for sewer. Raising the chazge to $25 per assessable foot will again bring it
into parity with the sewer charge.
Sec. 87.18. Thawing offrozen service connections and fzre services.
Property owners who choose to request the Water Utility thaw their service in private properry
will be chazged the Utility's actual costs.
Chapter 88. Water Code--Meters
Sec. 88.07. Costofsetting.
The proposed elimination of a charge for the first meter setting is in response to numerous
customer complaints. It is proposed tk•.at this cost now be rolled into the schedule charge for
service installation.
Sec. 88.11. Meter testing.
The proposed increase in chazges for meter testing mare closely approximates the Utility's cost
to perform this work. As before, this chazge is incurred only if the meter is found to be
registering 102% or less of actual flow.
Chapter 89. Water Code--Fire Services
Discussions with the Fire Department during the past two years have resulted in staffls
recommendation that approval of fire service size come from the Fire Department based on the
hydraulic calculations which aze already performed for each service by a fire sprinkler company.
The Water Utility currently provides a redundant evaluation and size approval process which is
not necessary. Proposed revisions in Secs. 89.04, 89.05 and 8915.1 address this change.
Sec. 89. 06. Installation by board.
This section has been eliminated because the statements are more appropriate to Sec. 87. 03 (b)
Limits of installation and maintenance and they have been transfered to that section.
Chapter 90. Water Code--Fire Hydrants
Sec. 90. 04. Charges for hydrant rental
Staff proposes the following revisions:
Raise the refundable deposit for necessary hydrant equipment from $250 to $300 to
more closely reflect the costs to repair damaged equipment.

Raise the additional monthly charge for winter usage from $25 to $30 to more closely
reflect the costs of frequent inspections and maintenance trips required during winter
months. The charge was last increased in 1990.
- Chazge $10 per month per hydrant used on each pernut instead of requiring one pernut
for each hydrant used. Staff believes this will decrease the number of unreported
hydrants used by permittees.
Chapter 91. Water Code--Miscellaneous Provisions
Sec. 91. 03. Water conservation
It is proposed to require water conserving devices on all new lawn sprinkler systems. According
to Rain Bird Sprinkler Systems, reliable devices can be purchased locally for $35 and can be
installed for approximately $50.
Sec. 91.13. Turn-on service charge.
This section was revised to create a new term, "collection service fee", to describe the charge
currently due if a truck is dispatched to turn off a water service for non-payment of delinquent
charges and the charges are subsequently paid to avoid turn off of service. This charge was
previously referred to as the same "turn-on service charge" which must be paid to get a service
turned back on. This has caused confusion with those who must pay the charge because no water
is actually turned off, making it appear inappropriate for the Utility to charge a"turn-on service
charge".
Sec. 91.17. Private water facilities, maintenance.
This new section is proposed to clarify maintenance responsibilities on private facilities. The
most common of these aze hydrants on the private property portion of fire services.
Chapter 93. Water Code---Water Service Connections (Size and Location)
Sec. 93. 03. Water service connections, depth.
Language was revised to reflect 1997 changes to the Water Utility Standards for the Tnstallation
of Mains which increased the depth requirement to 8A feet.
Sec. 93.05. Water service connection in sewer trench
Language was revised to reflect 1997 changes to the Water Utility Standards for the Installation
of Mains which allowed service connection installation by contzactor in certain situations.
Sec. 93.07. Size determined by utility
This proposed revision matches the changes discussed in Sec. 89. Fire services. where the Fire
Department will issue approval of fire service size.

Charges for street service connecfions in a cul-de-sac are to be based on,z�street width

9 (a) Standpipes hereinafter installed in an unsprinklered building and be used

11 in accordance with this chapter, except that a maYimum of three (3) suc standpipes may, with
12 written permission, be supplied with water through the domestic servi ; provided, that the size
13 of such standpipes shall be no lazger than the size of the domesfic w er meter; and provided
14 further; that the building has no other fire protection service to w' h they can be connected.
15 Wet standpipe systems shall be sepazated from the domestic wa r system by use of an approved
16 type bacl�low preventer. No antifreeze shall be introduced in existing standpipe systems
17 unless that system meets the current provisions of the State umbing Code. Property owners

Sec. 91.�23. MisceIlaneous charges.
The board of water commissioners may chazge the actual costs, including labor,
equipment, materiats and overhead, incurred for nonzequired services performed at the request
others, such services to include, but not be Iimited to, hydrant flow tests, relocations of hydr�
relocarion of water mains or connections, inspection and other sicnilar services.
Sec. 91.�324. Special purpose lateral mains.
The boazd may, at its discretion, install special purpose lateral nains within treet rights-
of-way from the public main in the street to the property tine. Special purpose la ral mains may
be used for connections to private water mains, hydrants and multiple street se ice connections
. Charges for special purpose lateral mains shall be i accordance w�th
charges for street service connections and fire services, Sections 87.12, 87. , 87.14, 8715 and
87.16. Special purpose lateral mains shall be maintained by the water uti 'ty as part of the public
water main system.
