Ware's Cumberland Addition Plat 1, from OS-1 to R-3 to allow the property to be used for residential single-family use, the perition having been certified by the Planning Division on September 17, 1996 as having been consented to by at least 67 percent of the owners of the area of the property to be rezoned, and further hauing been consented to by at least two-thirds of the owners of the property situated within 100 feet of the total contiguous properry within one year proceeding the date of the petition; and WHEREAS, The Zoning Committee of the Plauning Commission held a public heazing on October 17, 1996, for the purpose of considering the rezoning petition, and pursuant to § 107.03 of the Administrative Code, submitted its recommendation to the Planning Commission that the petition be granted; and WHEREAS, The Plauning Commission considered the rezoning pefition at its meeting held on October 25, 1996 and recommended that the Ciry Council approve the petition; and WHEREAS, notice of public hearing before the Ciry Council on the said rezoning petition was duly published in the official newspaper of the City on November 6, 1996 and notices were duly mailed to each owner of affected property and property situated wholly or partly within 350 feet of the property sought to be rezoned; and WI�EREAS, a public hearing before the City Council having been conducted on November 27, 1996, where a11 interested parties were heard, the Council having considered a11 the facts and recommendarions concerning the petition; now, therefore THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. TYtere was discussion of various zoning designations and Cheir allowed uses, and it was established that there is not a zoning designation that allows for office use or residential use as separate uses. Commissioner Chavez inquired whethez the drywall installation firm currently located at one of the homes would discontinue the firm's operation following the rezoninq of the property. John Rodrigue, 6942 Crown Circle Drive NW, St. Francis, the applicant, testified that the owner of the drywall installation firm is interested in purchasing the property if it is rezoned and will not continue the firm's drywall operation out of the home following the rezoning of the property. Kady Dadlez, Planning Division sta£f, reviewed the staff report and presented slides. Staff recommended approval of the petition to rezone the property from OS-2 to R-3. The District 6 Planning Council voted to support the rezoning petition. Commissioner Kramer asked whether residential uses are prohibited in the OS zone. TYtere was discussion of various zoning designations and Cheir allowed uses, and it was established that there is not a zoning designation that allows for office use or residential use as separate uses. Commissioner Chavez inquired whethez the drywall installation firm currently located at one of the homes would discontinue the firm's operation following the rezoninq of the property. John Rodrigue, 6942 Crown Circle Drive NW, St. Francis, the applicant, testified that the owner of the drywall installation firm is interested in purchasing the property if it is rezoned and will not continue the firm's drywall operation out of the home following the rezoning of the property. Commissioner Field moved approval of the rezoning o£ the property from OS-1 to R-3. Coaanissioner Wencl eeconded the motion.
