WHEREAS, Pursuant to Minnesota Statutes §462357 and §64.400 of the Legislative Code, W.A.
FROST/JOHN RUPP & KEN KAMSTRA duly petitioned to rezone 374 SELBY AVENLTE, being legally
described as the northerly 10 feet of Lot 9, all of Lot 10, and the southerly 20 feet of Lot 11; Dayton and
Irvine's Addition, from RM-2 to B-2 to allow expansion of the off-street pazking lot and improvements to
the existing outdoor dining facility, the petition having been certified by the Planning Division on Mazch
18, 1996 as hauing been consented to by at least 67% of the owners of the area of the property to be
rezoned, and fiu•ther havang been consented to by at least two-thirds of the owners of the property situated
within 100 feet of the total conriguous properry within one year proceeding the date of the petition; and
WHEREAS, The Zoniug Committee of the Planning Commission held a public hearing on April 18, 1996,
for the purpose of considering the rezoning petition, and pursuant to § 107.03 of the Administrarive Code,
submitted its recommendation to the Planning Commission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning petition at its meeting held on April 26,
1996 and recommended that the City Council approve the petition; and '
WHEREAS, notice of public hearing before the City Council on the said rezoning petition was duly
published in the official newspaper of the City on May 1, 1996 and notices were duly mailed to each
owner of affected property and property situated wholly or partly within 350 feet of the properry sought to
be rezoned; and
WFiEREAS, a public hearing before the City Council having been conducted on May 22, 1996, where a11
interested parties were heazd, the Council having considered all the facts and zecommendations concerning
the perition; now, therefore
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:

W.A. FROST submitted a petition to rezone property at the southeast corner of Selby & Westem, The
Zoning Committee of the Planning Commission held a public heazing on the proposed rezoning on
April 18, 1996. The applicanYs representative addressed the committee. At the close of the public
hearing, the committee voted 7-0 to recommend approval to rezone to B-2. The Planning Commission
upheld the Zoning Committee's recommendation for approval on a vote of 16-0 on April 26, 1996.
This proposed rezoning is scheduled to be heard by the City Council on May 22, 1996. Please notify
me if any member of the Ciry Council wishes to have slides of the site presented at the public hearing.

WHEREAS, W.A. FROST/JOHN RUPP & KEN KAMSTRA, file #96-050 have petitioned
to rezone a portion of the property at 374 SELBY AVENUE situated on the east side of
Western Avenue between Selby and I,aurel Avenues from RM-2 to B-2 to allow expansion of
the off-street parking lot and improvements to the existing outdoor dining facility; and
WHEREAS, the Zoning Comtnittee of the Planning Commission held a public hearing on
April 18, 1996, at which all persons present were given an opportuniry to be heard pursuant
to said application in accordance with the requirements of Section 64.400 of the Saint Paul
Legislative Code; and
WHEREAS, the Saint Paul Planning Commission, based on the evidence presented to its
Zoning Committee at the public hearing, as substantially reflected in the minutes, made the
following findings of fact:
� 1. W.A. Frost is planning to make significant improvemenfs to its restaurant facilities at
Selby & Westem. W.A. Frost currently uses the majority of the properry to be
rezoned as a parking lot for its restaurant customers. A smaller portion of the lot is
used for outdoor patio seating and kitchen area. W.A. Frost would like to rezone the
property to B-2, the same as the rest of the restaurant site. This wiii allow them to
undertake improvement plans for the outdoor dining area and parking lot.
There are 22 off-street parking spaces in the lot currently. The garage will be
demolished and make way for 7 add'ational spaces. In addition, a trash enclosure will
be constructed at the southeast corner of the lot.
W.A. Frost plans to construct a new building on the patio to accommodate a new bar
and expand the cooking facilities in the outdoor kitchen gazebo. They believe the patio
functions will be greatly improved by these improvements and additions.
2. The rezoning is consisient with the comprehensive plan for the city. One of the land
use objectives of the Disuict 8 Plan states, "to assure that zoning in Summit-University
reflects existing land use" p.7. One of the industry and commerce objectives states,
"to provide adequate off-street parking for Selby Avenue businesses" p.26. In

not have an adverse impact on the surrounding area. The property has been used for
parking and patio for many years. There have been no complaints to the Cit.izen's
O�ce about the operation of the parking lot.
4. The applicant submitted a suff'icient petition signed by two-thirds of the property
owners within one hundred (100} feet of the properry to be rezoned (60 parcels
eligible, 40 parcels needed, and 40 parcels signed).

NOW, THEREFORE, BE IT RESOLVED, by the Saint Paui Planning Commission that the
petition of W.A. FROST/JOHN RUPP & KEN KAMSTRA to rezone a portion of the

Kady Dadlez, Planning Division staff, reviewed the staff report and pzesented
slides. Staff recommended approval of the rezoning petition based on findings
1 through 4 of the staff report.
Ms. Dad2ez circulated the original petition for commissioner�s review, as she
did not include it in the packet as it was very lengthy.
The Summit-University Planning Council voted to support the rezoning petition.
One letter was received in support.
Commissianer Vaught questioned that if part of the patio is currently zoned
residential, whether steps have been taken in the past to make it a legal
nonconforming use, or whether it has been an illegal nonconforming use all of
these years.
Ms. Dadlez said she assumes that it is a legal nonconforming use.
Commissioner Vaught asked the applicant to address that and suggested that a
nonconforming use such as that on a residential lot would be an illegal use,
not a nonconforming use, unless there was some other reason, such as the
implementation of the new zoning code in 1975,
Robert Crew, General Manager of W.A. Frost, 374 Selby Avenue, said that W.A,
Frost was made aware of the fact that the parking lot was zoned residential
about one year ago as they began this project, and that staff had informed
them that a portion of the patio was not zoned B-2 but zoned RM-2.
Hearing no further testimony the public hearing was closed.
Commissioner Field moved approval of the rezoning based on tha staff
recommendationa. Coffiai.saioner weacl seconded the motioa. The motion carried
on a voice vote of 7 to 0.

PARCEL SIZfi: The property to be rezoned has approximately 90 feet of
frontaae on Western Avenue and is approximately 139 feet deep for a total
lot area of about 12,510 square feet.
C. ExISTING LAND IISB: The property to be rezoned is occupied by a garage
and off-street parking for the restaurant to the north as well as a
portion of the outdoor patio area and kitchen. This property is adjacent
to land occupied by W.A. Frost Restaurant and patio.

E. ZONING CODS CITATION: Section 64.400(a) of the zoning code states, "the
council may, from time to time, amend, supplement or change the district
boundaries or the regulations herein, or subsequently established herein
pursuant to the provisions of Minnesota Statutes Section 462.357 and
amendments thereto as may be made from time to time. The planning
commission may, from time to time, review district boundary lines to
determine if, pursuant to state laws, such district boundary lines should
be changed."
Section 64.400(b) of the code states, "an amendment to the zoning code
may be initiated by the council, the planning commission or by petition
of the owners of sixty-seven (67) percent of the area of the property to

relating to noise. Area residents expressed concern about the noise
generated when trash containers are emptied in the evening, especially
the sound of breaking glass and also the time of moming that trashed
was being picked-up. Both the restaurant and the garbage hauler
respon@ed to the compZaint to address the concerns. No additional
complaints have been made since.
The applicant submitted a sufficient petition signed by two-tkirds of
the property owners within one hundred (100) feet of the property to
be rezoned (60 parcels eligible, 40 parcels needed, and 40 parcels
signed).
5. The property is located in the Historic Hill District. Therefore, any
changes to the site require review by the Heritage Preservation
Commission and site plan review.

• Capital Improvements: By June 1996, W. A. Frost will build a new structure on the
pario which will house a new bar and expand the cooking facilities in the outdoor kitchen
gazebo. Operationally, the patio functions will be greatly improved. This new facility
wiil benefit the operarion in these ways:
• To offer an altemative searing area for customers waiting for a table in the dining
section of the patio.
• T'he Garden Bar will be the bar service area for most of the patio. This reduces the
large demand placed on the indoor bar and service stations.
• The Garden Bar would add another dimension to an already successful concept.
• The new structure wouid double the size of the Gazebo kitchen. Giving the Chef
much greater flexibility in the creation and production of the patio menu.
Aside from the reasons stated above, the most dramatic changes would come from an
overall increase in revenue due to added sales and improved customer service This
addition would allow the use of forty seats not currently being utilixed maximally. The
location of this new structure is important The distance between tables and the area
where servers must enter orders from the point-of-sale system and pick-up any beverages
� items will be considerably shortened. This will ultimately result in quicker, more
efficient, and therefore better customer service. The reason for the second bar is obvious
to anyone familiar to the layout and sheer immensity of W. A. Frost. During peak hows
in the summer season, servers must walk great distances to pick-up drink orders.
Furthermore, due to the number of servers working during busy summer shifts (between
12 to 15), there are inevitable traffic jaams which occw at the single service bar currently
in place. This not only adds time to beverage service, but it disuacts the indoor
bartenders from the guests who wish to be served at the bar. As the popularity of W. A.
Frost has grown, we have found that increasing numbers of patrons are willing to wait as
]ong as an hour and one-half for seating. These people are put on a waiting list and then
directed to one of two areas: either the indoor bar or bench seating at the entrance of the
patio. Both areas currently cause congestion problems. Customers directed to the bar
are forced to stand in and around the patio entrance ( in the way of customers leauing or
entering) because the benches outside are often full. This is not only uncomfortable for
t}�ose who wish to wait, but also potential loss of sales (i.e., appetizers or beverages).
The construction of the Garden Bar wiil solve these problems. The Gazebo will be able
to accommodate the higher volume. Customers currently on a waiting list would be
directed to the outside bar area. There they could wait comfortably until their table was
ready (or decide to stay in the bar area). As they wait., they could be served food and a
beverage. This expansion is not only necessary it will also make what already is a long
time great patio into the Twin Cities' finest.

On behalf of the Boazd of Directors of the Blair House Residential Condominium Association and the
residents of �e condominium itself, I would 1�Tce ro express our enthusiastic support for W.A. FrosYs
tezoning petition. At our Board meeting of October 23, 1995, after meeting with Frost's general
manager, Mr. Robert Crew, the Board unanimously adopted a resolution supporting the proposed
e�cpansion and improvements to Frost's existing outdoor dining facility. Indeed, the Boazd urged
individuai residents to support the rezoning effort by signing pefitions to support tfie proposat. The vast
majority of Blair House residents have in fact signed and reiumed such peritioas and to-date I have not
received any negative contments with respect to FrosPs proposal.
For more than twenty yeats W.A. Fmst has been a major asset and vital part of the Cathedral Hill
neighborhood, and Blair House residents have always considered the business to be an excellent
neighbor. We are, of course, very concemed with maintaining the vi�lity of U�is neighborhood and we
sincerely believe that FrosPs continued success is a key eletnent in sustaining and enhancing that vitality.
We believe this project will be not only an aesthetic improvement to the area but will also enhance the
prospects of continued success for Frost. Accordingly, we strongly support Frost's application for
rezoning and encourage the Zoning Committee to issue a favorable recommendation to the St. Paul
Planning Commission.
