Notwithstanding the foregoing, a licensee may permit, for specific functions or events, up to five (5) times per calendar year, for which written notice is given to the office of license, inspections and environmental protection at least forry- eight (48) hours in advance, the use of slot machines, dice and gambling devices on the licensed premises if (a) their presence or use on the licensed premises does not violate state or federal law, (b) their use is solely for social, recreational or amusement purposes, and not for fundraising of any kind or for any cause or purpose, and (c) no gambling other than lawful charitable gambling takes place on the licensed premises. INITIATING PROBLEM, ISSUE, OPPORTUNITY (Who, What, When, Where, Why): he City of Saint Paul prohibits nonintoxicating liquor establishments to allow the operation of charitable gambling booths and activities within their establishments even though the State Statutes outline no such restriction. VANTAGES IF APPROVED: Improved service availahility. ISADVANTAGES IF APPROVED: ay have an impact on the amount of gambling within the City. ISADVANTAGES IF NOT APPROVED: onintoxicating liquor establishments in the City of Saint Paul will be kept at a disadvantage compared to other Cities who have no restrictions with egard to charitable gambling operations in nonintoxicating liquor establishments.
