An ordinance amending Saint Paul Legislative Code Chapter 43
relating to vacant buildings by adding new language which
provides the owner of a fire damaged building with a temporary
exemption from the registration requirements of that chapter
upon the fulfillment of certain conditions and by renumbering
the remaining sections of the chapter.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
SECTION 1
That Saint Paul Legislative Code Chapter 43, Section 43.04, is hereby amended to read:
Sec. 43.04. Exemntions.
A buildine which has suffered fire dama�e shall be exempt from the registration
re uirement for a �enod of ninetY (90Ldays after the date of the fire if the nronertv owner
subm�ts a request for exemption in writing to the Enforcement Officer This request shall
mclude the followine mformarion supplied bv the owner•
Ia) A descrintion of the premises
(b) The names and address of the owner or owners
�cl A statement of intent to repair and re-occup,v the buildine in an exnedient
manner.
SECTION 2
That Saint Paul Legislative Code Chapter 43, Sections 43.04 - 43.07 aze hereby renumbered
as follows:
Sec. 43.045. Inspections.
The enforcement officer shall inspect any premises in the city for the purpose o€
enforcing and assuring compliance with the provisions of this chapter. Upon the request of the
enforcement officer, an owner shall provide access to all interior portions of an unoccupied
building in order to permit a complete inspection.

Once every three (3) months the enforcement efficer shall send to the city councii a
list of all vacant buildings which have become known to the enforcement officer during the
preceding three (3) months, as well as a list of all previousiy declared vacant buildings which
aze no longer subject to the provisions of this chapter.
Sec. 43.Og7. Penalties.
Any person violating any provision of this chapter or providing false information to
the enforcement officer shaii be punished as provided by section 1.05 of the Saint Paul
Legisiative Code.
Sec. 43.0�8. Alternative procedures.
Nothing in this chapter shall be deemed to abolish or impair existing remedies of the
city authorized under Chapters 33, 34, 45 of the Saint Paul Legisiative Code or Minnesota
Statutes Section 463.15 through 463.26. Any conflicts between this chapter and Chapters 33
and 45 will be superseded by the provisions of Chapters 33 and 45.
SECTION 3
That this ordinance revision shall take effect thirty (30) days after its passage, approval and
pubiication.

The current ordinance language does not allow a property owner who has suffered property
damage from a fire sufficient time to obtain a repair permit and start repairs without
being subjected to the requirement of having to obtain a Certificate of Code Compliance
for the entire structure.
ADVAN7AGES IF APPROVED:
If an owner intends to make fire repairs promptly they will not be penalized by the Vacant
Building ordinances.

Property owners who have a fire in tfieir building will continue to be forced to
rehabilitate the entire building up to code before reoccupying it and will have to pay the
