THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIlV: Section 1 12 Section 33.07. of the Saint Paul Legislative Code is hereby amended to read as follows: 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 "Sec. 33.07. Fences--Requirements. (a) Permit. No person shall wnstruct, or cause to be wnstructed, any fence in the Ciry of Saint Paul without first obtaining a permit therefor from the building official. (b) Height offences. No fence shall be erected exceeding six feet six inches (6'6") in height above the sidewalk or finished grade of any lot in a residence district or on any lot occupied for residendal purposes. Fences and all supporting structures shall be completely within the boundaries of such lot. All fences erected between the front property line and the front setback line as defined in section 60.206 of the Saint Paul Legislative Code shall be no more than three feet siz inches (3'6") in height. Fences not obstructing vision to an extent in excess of twenty (20) percent above a height of three feet six inches (3'6") shall be exempt from the restrictions herein. Fences erected on a corner lot shall also be subject w the provisions of section 62.112 of the Saint Paul I.egislative Code. (e� �€�� Swim»zing pool fences. All yards containing swimming pools shall be enclosed by an obscuring fence not less than four (4) feet in height. The gates shall be of a self-closing and self- latching type, with the latch on the inside of the gate, not readily available for children to open. No bazbed wire fence shall be constructed within the city limits of the City of Saint Paul unless the following conditions aze complied with: (1) No fence which uses barbed wire may be built in a residence district or on a lot occupied residentially. (2) Barbed wire, not exceeding three (3) strands, may be permitted on the top of a fence; providing, that the arms do not project over public properly. The minimum height to the bottom strand of the barbed wire shall not be less than six (6) feet from finished grade. (3) In all cases where a barbed wire fence is requested, an application shall be made to the division of housing and building code enforcement. (4) A cerlificate of insurance indemnifying the City of Saint Paul shall be submitted with the applicarion subject to the approval of the city attorney as to form and in an amount as set forth in Minnesota Statutes, Section 466.04.
