The applicant owns the property and intends to sell it to allow development of a parking lot to serve the business located at 534 Selby Avenue, Mytana, a manufacturer of power sewer cleaning equipment. The company has eight employees. As proposed, the parking lot will have between 19 and 21 spaces. Since there will be extra spaces, plans include leasing parking spaces to the four-plex to the west and the cafe, salon and flower shop across the street. A variance from tiie Boazd of Zoning appeals is also being requested to allow a zero foot setback to the south and west. 2. The proposed zezoning is in conformance with the comprehensive plan for the city. The Land Use Plan identifies Selby Avenue as a mixed use strip. Land use development strategies of the Selby Avenue Plan include: 1) sites requiring a lvgher zoning classification for new development should be rezoned on a case by case basis as redevelopment proposals are submittec3, this will allow greater control over development; and 2) retain mixed uses from Arundel to Kent pp.4-5. One of the land use objectives of the District 8 Plan states, "to encourage a mixture of commercial and residential uses along Selby Avenue" p.7. In addition, the plan states, "there is a need for more off-street parking for businesses already located on Selby Avenue as well as for future commercial establistunents", p.9 #8. The proposed site is adjacent to land already zoned B-2, the requested rezoning is a logical extension of the existing zoning boundary. There is a documented need for additional off-street parking on Selby Avenue and the current proposal to try to meet some of that need is consistent and compatible with the way the area has developed. 4. The applicant submitted a sufficient petition signed by two-thirds of the property • owners within one hundred (100) feet of the property to be rezoned consenting to the rezoning (53 parceis eligible, 36 parcels needed and 38 parcels signed). ABSENT: Chavez, excused Field Time: 4:30 - 4:55 p.m. The meeting was chaired by Gladys Morton, Chairperson. To at Kady Dadlez, Planning Division staff, zeviewed the staff report and presented slides. SCaff recommended approval of the rezoning based on findings 1 through 4 of the staff report. Both the Summit University Planning Council and the Ramsey Hill Association voted to support the rezoning and the variances that would be required. Commissioner Kramer asked for an eacplanation for why the rezoning reguest was for B-2 (a business zoning) rather than P-1 (a parking zoning). Peter Carlson, Carlson and Frank Architects, 482 Dayton Avenue, representative • of the agplicant, spoke. Mr. Carlson said that B-2 zoning was recommended when the applicant was seeking help in the process of application, and that they were advised by staff that it would give them more flexibility in development in the £uture. Mr. Carlson, using diagrams, reviewed the proposal. Commissioner Kramer said that he did not see any potential use at this site other than parking, and questioned whether the applicant is adverse to having the P-1 parking zoning. Commissioner Kramer also addressed whether if in the future those properties are so1d, whether the B-2 zoning allows for the potential elimination of the parking. Mr. Gottstein reviewed that the proposal has arisen in an effort to devise a plan for what to do with the properties in the event his elderly uncle who owns the pzoperty passes away. In the event that someone may want to purchase all the properties for different uses, he originally felt that P-1 may restrict them in that kind of planning process. Following approximately 9 meetings that took place before this formal meeting, Mr. Gottstein said he has since questioned whether B-2 has been the best way to go. However Mr. Gottstein said he has been working with Sean Kershaw, Business Development, PED, and has decided to get a nice looking parking lot that everybody in the neighborhood likes, so that it will make this building much more viable for preferably a single tenant. Mr. Gottstein said they are working diligently to conform to F�IPC standards and the B-2 zoning gives them the freedom to think generically, rather than specifically. Greg DeShonn, Executive Director for the Summit University Planning Council, and also on behalf of the Ramsey Hill Association, spoke in support of the rezoning. Mr. DeShonn said that the two groups have been working closely together in and for the variances that are required for the rezoning and have • been looking at it as a package. Mr. DeShonn said that there have been many neighborhood meetings and that some very good compromises have been arrived at 95=708 and that the official position of the Planning Council as well as Ramsey Hill, is to support the rezoning and variances required to build the parking lot • with conditions outlined in the letter distributed to Commissioners at the meeting. Grant Tracy, owner of the property at 531 Selby spoke. Mr. Tracy said he felt the proposed plan to move the home into a residential area is an excellent one. Mr_ Tracy said he attended the neighborhood meetings and has been impressed with how well Mr. Gottstein has worked with the neighborhood. He felt that the neighborhood really needs the parking and would be a great boost for the businesses as well. Commissioner Gurney questioned what possible conseguences may arise in the event of a B-2 zoning with respect to future development of the parking lot, and parking requirements for such a development in the event of the loss of this parking lot. Ms. Dadlez said that any new development requires that parking be provided, and that either parking would have to be provided or a parking variance would have to be obtained. A building would not be allowed to be constructed without finding another location for existing reguired parking and the new required parking that would be needed with a new structure. The public hearing was closed. Commissioner Gurney moved the rezoning to P-1. The motion died for lack of a second. Commissioner Rraater moved the rezoning to B-2 based on the staff recommendation. Commissioner Faricy seconded the motion. The motion carried with a voice vote o£ 4 to 1(Guraey against.) ZONSNG CODE CITATION: Section 64.400(a) of the zoning code states in part, "the council may, from time to time, amend, supplement or change the district boundaries or the regulations herein, or subsequently established herein pursuant to the provisions of Minnesota Statutes Section 462.357 and amendments thereto as may be made from time to time. The planning commission may, from time to time, review district boundary lines to determine if, pursuant to state laws, such district boundary lines should be changed." F. HISTORY/DISCIISSION: There are two current cases concerning this property. One case is for a site plan review £or the proposed parking lot and the other is a yard setback variance for the parking lot. No action has been taken on the applications.
