An ordinance amending Chapter 60 of the Saint Paul Legislarive Code pertaining to zoning for the City of
Saint Paul and the zoning maps thereof:
WIIEREAS, Pursuant to Minnesota Statutes §462357 and §64.400 of the Legislative Code,
HEALTHEAST duly petifioned to rezone 1412 MARYLt1ND AVENUE EAST, being legally described as
Part N of Rose Ave of W 135.25 ft of E 470.5 ft of part W of Maryland Heights in NW 1/4 of (subj to
Ave) SEC 27 TN 29 RN 22, from RM-2 to B-2 to allow constnxction of a medical clinic, the petition
having been certified by the Planning Division on Febnxary 14, 1995 as having been consented to by at
least 67 percent of the owners of the area of the property to be rezoned, and further having been
consented to by at least two-thirds of the owners of the properiy situated within 100 feet of the total
contiguous property within one year proceeding the date of the petition; and
WHEREAS, The Zoning Committee of the Planning Commission held a public hearing on March 16,
1995, for the purpose of considering the rezoning petition, and pursuant to § 107.03 of the Administrative
Code, submitted its recommendarion to the Pianning Commission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning petition at its meeting held on March 24,
1995 and recommended that the City Council approve the petition; and
WHEREAS, notice of public hearing before the City Council on the said rezoning petition was duly
published in the official newspaper of the City on March 30, 1995 and notices were duly mailed to each
owner of affected properiy and properiy situated wholly or partly within 350 feet of the properiy sought to
be rezoned; and
WHEREAS, a public hearing befare the City Council having been conducted on
April 19, 1995, where all interested parties were heard, the Council having considered all the facts and
recommendations concerning the pefition; now, therefore
THE COUNCIL OF THE CITY OF SA1NT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul, Sheet Number 7, as incorporated by reference in §60301
of the Saint Paul Legislarive Code, as amended, is hereby further amended as follows:

HEALTHEAST submitted a petition to rezone property at 1412 Maryland Avenue East. The Zoning
Committee of the Planning Commission heid a public hearing on the proposed rezoning on
Mazch 16, 1995. A representative for the applicant addressed the committee. At the close of the
public hearing, the committee voted 8-0 to recommend approval to rezone to B-2. The Planning
Commission upheld the Zoning Committee's recommendation with a unanimous vote on Mazch 24,
1995.
This proposed rezoning is scheduled to be heazd by the City Council on April 19, 1995. Please notify
me if any member of the City Council wishes to have slides of the site presented at the public hearing.

WHEREAS, HEALTHEAST, file #95-013, has petitioned to rezone 1412 MARYLAND AVENUE
EAST, situated on the south side of the street between Prosperity and Bimilngham, from RM-2 to B-2
to allow the construction of a medicaI clicric; and
WHEREAS, the Zoning Committee of the Planning Commission held a public hearing on Mazch 16,
1995, at which all persons present were given an opportunity to be heard pursuant to said application
in accordance with the requirements of Section 64.400 of the Saint Paul Legislative Code; and
WHEREAS, the Saint Paul Planning Commission, based on the evidence presented to iu Zoning
Committee at the public heazing, as substantially reflected in the minutes, made the following findings
of fact:

Healtheast recently purchased the property with the intention of developing a medicat clinic and
associated off-street pazking. The e�sting single family home on the site is owned by the
North East Neighborhood Development Corporation and will be moved to a new location to
make way for the development.
The development of the new clinic is a joint veniure between Haze] Park Faznily Practice Clinic •
and Aealtheast. Hazel Park is a family practice residency program, its main focus is on
training doctors to be family practice physicians. The clinic doctors aze physicians in a three
year specialty training program in family practice and work under the guidance of University of
Minnesota faculty physicians. Hazel Pazk's existing health clinic on White Beaz Avenue will
be relocated to this site once the development is complete.
As proposed, the clinic is to be buiIt at the southwest comer of Maryland Avenue and realigned
Prosperity Avenue. Two driveways, at Prosperity and Rose, will provide access to ttte 51
space parldng lot. The cl'uric building is about 11,000 squaze feet and will contain about 20
exam rooms, 3 lazger treatment areas, and 11 o�ces. The anticipated hours of operation for
the clinic aze 8:30 a.m. to 5:00 p.m. Monday through Friday.
2. On balance, the rezoning is in conformance with the comprehensive plan for the city and with
the pending Phalen Village Small Area Plan wluch encourages a concenuation of commercial
uses along Maryland Avenue between Clazence and Prosperity. One of the key ideas and
recommendations of the small azea plan is to "create a compact, mixed-use, more
neighborhood-, pedestrian-, and transit-oriented "Phalen Village commercial azea along
Maryland at Clarence and Prosperiry, eventually replacing the existing shopping center, and

rezone properry to reflect this long range pian." The drafr plan also states that Phalen Village
is undeserved for many health and human service programs and recommends that a medical
center be developed in a central, pedestrian, and transit accessible location.
In addition, relevant policies of the Economic Development Strategy, 1990, inciude: 1) "the
City's land use plan should provide adequate land for industrial and commercial development
and expansion in order to increase the proportion of commercial/industrial tax base," #25,
p.i7; 2) "the City should periodically review its zoning regulations and amend them as
necessary to keep current with technological and economic changes affecting the nature of
business activity #29," p.18; 3) "the City and Port Authority's neighborhood efforts should
focus on reducing vacancies in existing commercial and industrial buildings when economically
feasible; and should pursue redevelopment and new development when doing so better serves
the objectives of jobs, tax base, and/or neighborhood compatibility," p.37.
One of the policies of the Land Use Plan states that the City will continue to review its present
commercial zoning to ensure that 1) each zoning classification reflects uses appropriate to the
intended appiication of that district and 2) each commercial area is appropriately zoned for its
intended use. 4.2-5 p.27
One of the major recommendations of the economic pian in the District 2 Plan states, "The City
should conduct a land use, economic, and transportation study in the area around the Phalen
� Center to resolve existing conflicts and to assure the furure viability of the center."
3. Rezoning the property to commercial is in keeping with the way the area is developing. The
realigned Prosperity Avenue will create a prime location for commercial development and the
proposed medical clinic is an excellent use of that site which provides good pedestrian and
transit access. The new medicai clinic will be directiy across the street from the new
Walgreens Dug Store and with proper site development the proposed ciinic will not have an
adverse impact on adjacent residential property. "
This stretch of Maryland Avenue cazries more than 18,000 vehicies per day; the newly
realigned Prosperity is expected to carry about 4,000 vehicles per day.
4. The applicant submitted a sn�cient petition signed by two-thirds of the property owners within
one hundred (100) feet of the property to be rezoned consenting to the rezoning (12 pazcels
eligible, 8 needed, and 8 signed).
NOW, THEREFORE, BE IT RESOLVED, by the Saint Paul Planning Commission that the petition
of HEALTHEAST to rezone property at 1412 MARYLAND AVENUE EAST, more particularly
described as Part N of Rose Ave of W 135.25 fr of E 470.5 ft of part W of Maryland Heights in NW
1/4 of (subj to Ave) SEC 27 TN 29 RN 22, from an RM-2 zoning classification to a B-2 zoning
classification is consistent with the Comprehensive Plan for the City; and
BE IT FURTHER RESOLVED, that the Saint Paul Planning Commission does hereby recommend to
• the Council of the City of Saint Paul that property located at 1412 MARYLAND AVENi7E EAST be
rezoned from RM-2 to B-2 in accordance with the petition for rezoning on file with the Saint Paul

#95-019 St. Paul Technical Colle¢e - Sign Variance - A 210 sq.ft. sign area vaziance. Total
sign azea of 240 sq.ft. requested and 30 sq.fr. maYimum allowed (235 Marshall Ave;

MOTTON: Ms. Morton moved approvai of the requested sign variance with the following
conditions: 1) the sign shall be mounted on the north side of the building parallel to

shall not be lighted; 4) the sign shall be of a color other than white; and 5) the existing sign

Kady Dadlez, Planning Division staff, reviewed the staff report and presented
slides. Staff recommended approval of the petition to rezone to B-2 based on
findings 1 through 4 of the staff report.
The District 2 Community Council voted to support the rezoning petition. One
letter was received in opposition of the rezoning.
Jean Jansen, 933 White Bear Avenue, the applicant, spoke. Ms. Jansen, the
manager of the Hazel Park Clinic which is located on White Bear Avenue and has
� been there for 20 years, said they will be closing this facility and opening a
new one at 1412 Maryland. Ms. Jansen briefly described their operation and
said that about 40 percent of their patient population is the undersezved
medical assisted population, and that the move to the new location will
enhance their services to that population group.
Brian McMahon, staff inember with the Northeast Neighborhoods Development
Corporation, the recipient of the home to be moved, said they strongly support
the proposal. Mr. McMahon said that Healtheast has been a very good neighbor
and has operated the clinic on White Bear Avenue very successfully.
Commissioner Field moved approval of the petition to rezone to 8-2.
Commissioner Rramer seconded the motion. The motion carried with a voice vote
of 8 to 0.

clinic is an excellent use of that site which provides good pedestrian
and transit access. The new medical clinic will be directly across
the street from the new Walgreens Dug Store and with proper site
development the proposed clinic will not have an adverse impact on
adjacent residential property.
This stretch of Maryland Avenue carries more than 18,000 vehicles per
day; the newly realigned Prosperity is expected to carry about 4,000
vehicles per day.
The applicant submitted a sufficient petition signed by two-thirds of
the property owners within one hundred (100) feet of the property to
be rezoned consenting to the rezoning (12 parcels eligible, 8 needed,
and 8 signed) .

the site that we are considering for our new clinic site along
with Healtheast and the University of Minnesota.
I have enclosed a site plan, along with a proposed building
design and floor plan. We are a family practice residency
program with our main focus being in training doctors to be
family practice physicians.
The current location of our clinic is 933 White Bear Avenue. The •
business hours that we currently have are 8:30 to 5:00, Monday

We are in receipt of a communication froia your committee relating to
public hearing notice for rezoning of the property at 1412 East
Maryland Avenue, St. Paul, Minnesota.
On behalf of the owner of our property, I am responding in the negative
towards the rezoning application at this time. The reason for this
response is that we have a concern about spot rezoning in an area where
there is a plan in process but which has not yet been fully approved.
Our concern is that the medical building proposed for this property is
to be a"cornerstone" of the redevelopment of the entire Phalen
Shopping Center area. In the event that that redevelopment plan does
not proceed, we will have a mixed zoning designation along Maryland
Avenue. This would seem to be inappropriate at this time.
We would strongly support this petition as well as any other if the
full development project has been approved and is moving forward to
completion by the City relative to the relocation of Prosperity Avenue
and the redevelopment of all of the property to the west of Prosperity
Avenue along Maryland and going down to Phalen Shopping Center.
We plan to be present at the hearing in order to e�cpress our concerns.
