Thus, the western-most portion of the restaurant (non-smoking section) is a nonconfornung use and its expansion possibilities are 1'united. The applicant would like to expand the dining space available for non-smokers by providing an addition to the west of the smoking section and north of the non-smoking section. To be able to proceed with the expansion, the groperty must first be rezoned to a zone which allows the restaurant use. The rezoning will impact the entire lot and will therefore rezone the property on which there is a five-unit apartment to B-2. The zoning code states that "in any...B-2... district, existing residential uses shail not be nonconforming as to use of structure and land... " 2. The rezoning is in conformance with the comprehensive plan. The property is adjacent to property aiready zoned B-2. In addition, the rezoning will make the restaurant a conforming use.
