WHEREAS, Chapter 293 of the Saint Paul Legislative Code was
enacted to regulate the subject of noise in the City of Saint
Paul; and
WHEREAS, §293.11 provides for the granting of variances from
the sound level limitations contained in §293.09, upon a finding
by the City Council that full compliance with Chapter 293 would
constitute an unreasonable hardship on an applicant, other
persons or on the community; and
WHEREAS, Trigen Energy Solutions of St. Paul, LLC,
represented by Ray LaTronica, Construction Superintendent, who
has been designated as the responsible person on the application,
has applied for a variance to allow work to take place on the
boiler at the St. Paul Cogeneration facility, during the period
from December 3�, 2002 through 2003; and

WHEREAS, applicant is seeking�v�ariance for five
consecutive twenty-four hour periods during the course of the
project; and
WHEREAS, if applicant is not granted a variance it will not
be able to perform the necessary maintenance work on the boiler;
and

WHEREAS, the Office of License, Inspections, and '�
Environmental Protection has reviewed the application and has
made recommendations regarding issuing the variance; now,
therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby
grants a variance for Trigen Energy Solutions of St. Paul, LLC, �
beginning December �.,�2002 and continuing through d��'�; F'���..*
2003 for five consecutive twenty-four hour periods during that �
time period.

Recommended amendments to Council File #02-1125 (sound level variance far the
District Energy boiler cleaning process).
Based on ongoing discussions the Office of License, Inspections and Environmental Protecrion
(LIEP) staff has had with Distxict Energy and their sound consultant, the following monitoring and
operational procedures were developed to help minimize the noise impact from the new boiler
cleaning process and to attempt to maintain sound levels at or below the city nighttime standard at
the nearest residential azea.
LIEP is recommending that the following condirions be added to the sound level variance resolurion.
1. During the initiation of the cleaning process (steam release), District Energy shall monitor the
sound Ievels at two (2) locations:
a. At 25 feet from the steam vent exhaust (muzzler).
b. At a location (home) in the Irvine Park area.
2. Exactmonitoring locations shall be approved by the Office of License, Inspecrions and
Environmental Protection (LIEP) before the start of the process (steam release).
3. If monitored sound levels at the Irvine Park location indicates levels less than 55 dBA, the
process (steam release) may proceed uninterrupted.
4. If the monitored sound levels at the Irvine Park location indicate leveis of 55 dBA but less than
65 dBA during the nighttime hours (10:00 p.m. - 7:00 a.m.), the steam venting process shall at a
minimum, be modified to reduce the sound level at the 25 foot location. The level at the 25 foot
location shall be reduced to a level needed to reach 54.5 dBA at the Irvine Park location. If District
Energy is unable to reduce the sound levels the needed amount at the 25 foot locarion, the cleaning
process (steam release) shall be limited to the daytime hours of 7:00 a.m. to 10:00 p.m.
It is anticipated that with a continuous unrestricted steam venting, the cleaning should take five (5)
days or less. A reduction in the steam venting sound levels or the limiting of the venring to daytime
hours, may reduce the effecriveness of the cleaning process resulting in possibly mare than five (5)
days to complete.
6. After the initial monitoring, LIEP may require District Energy to conduct additional monitoring
during the steam venting process, to verify compliance with these conditions.
7. District Energy is requesting that the dates of the variance be changed to December 26, 2Q02
through February 2,2003.

Attached is a sound level variance application from Raymond Latronica, Construction
Superintendent of Trigen Cinergy Solutions of St. Paul, L.L.C., 50 Kellogg Blvd. West,
Suite 340, Saint Paul, 55102, to allow the cleaning of piping from the boiler to steam
turbine at the St. Paul Cogeneration facility, 76 Kellogg Blvd. West. Noise levels will be
between 70 & 90 decibels at 100 feet from the silencer. A variance is requested for 5
consecutive 24-hour time periods, or until the operation is completed, some time between
December 11, 2002 and January 17, 2003.
Enclosed is the copy of the Public Hearing Notice sent to property owners within 200 feet
of76 Kellogg Blvd. West.
