The streets fo be improved are: FOURTH STREET - Minnesota Street to Jackson Street CEDAR STREET - Fifth Street to Eleventh Street under Preliminary Order approved The Council of the City of Saint Paul has conducted a public hearing upon the above improvement, due notice thereof having been given as prescribed by the City Charter; and WHEREAS, The Council has heard all persons, objections and recommendarions pertaining to said proposed improvement and has fully considered the same; now, therefore, be it RESOLVED, That the Council of the City of Sainf Paul does hereby order that the above-described improvement be made, and the proper City officers are hereby directed and authorized to proceed with the improvement; and be it further RESOLVED, That the City reasonably expects to reimburse itself for the payment of certain costs of the improvement out of the proceeds ofbonds to be issued by the City after the date ofpayment of such costs. BY� 'i io-2� SUMMARY OF ENGINEERING RECOMMENDATIONS CENTRAL CORRIDOR LIGHT RAIL TRANSIT DOWNTOWN STREETSCAPE / STREET LIGHTING IMPROVEMENTS December, 2009 Project In conjunction with the Central Corridor Light Rail Transit Project, above standard street lighting and streetscape improvements will be constructed within the right-of-way along Cedar Street between Fifth Street and Eleventh Street and afong Fourth Street between Minnesota Street and Broadway Street. Initiating Action The project was initiated by the Central Corridor Light Rail Transit Project. ABOVE STANDARD STREET LIGHTING SYSTEM CONSTRUCTION Proposed Improvements Above Standard Single Globe Style street lights will be installed along Fourth Street between Minnesota Street and Jackson Street, and along Cedar Street befinreen Fifth Street and Eleventh Street. The area will be included in the existing Wabasha / St. Peter Maintenance Area. The above standard portion of the operation and maintenance costs will be assessed to abutting properties at the current Wabasha / St. Peter maintenance rate. Sidewalk and boulevard construction will allow the construction of pedestrian scale Single Globe style street lights in addition to roadway style lighting at signalized intersections and midblock locations. Positive Benefits The new lighting instailation will match the surrounding street light system and will match planned lighting improvements for Fifth and Sixth Streets beiween Robert and Cedar. Adverse Effects Assessments to abutting property owners for a portion of the capital cost of the lighting, as well as ongoing operation and maintenance assessments for the lighting. Increase in the City's operation and maintenance budget. In the event City records show that MPR was given proper notice, MPR further ob}ects to the proposed assessments on the grounds that: (1) The assessments are premised on a demonstrable mistake of fact: the assertion that the proposed CCLRT—related improvements will enhance the market value of the MPR Broadcast Center; and (2) The assessments are in excess of any actual benefits to the MPR Broadcast Center; in fact, the proposed improvements help diminish, not enhance, the market value of the MPR Broadcast Center. Much of the MPR Broadcast Center's value lies in its being equipped and arranged for "special purpose" uses. Under guidelines of the Federal Transit Administration (FTA), which govern the CCLRT project, the MPR Broadcast Centar is explicitly recognized as a protected, "Class 1" facility, because it contains numerous broadcast and recording studios and performance halls. The high level of noise and vibration associated with the CCLRT project — both its construction and operation — will significantly, adversely affect operarions within the MPR Broadcast Center. MPR's engineers, after extensive study, believe the CCLRT line will actually diminish the "special use" value of the MPR Broadcast Center. Municipal improvements associated with the CCLRT aid in the diminution of the value of the MPR Broadcast Center. Thus, the proposed assessments are, as to the parcels comprising the MPR BroadcasY Center, unlawful and must not be levied. For the same reasons, MPR hereby objects to the related special assessments for annual maintenance (#19083M) that the City proposes to assess against the MPR Broadcast Center. Definitions. For the purpose of this chapter the terms herein shall have the meaning ascribed to them as follows: (1) Town Square means those city-owned public areas, including, bui not limited to, pedeshian concourses or skyways, bounded by Cedar, Eighth, Minnesota and Sixth Streets, which are used publicly for leisure activity, pedestrian traffic or other public use. (2) Operation and/or maintenance means all services rendered or contracted for by the city in the day-to-day operation or maintenance of Town Squaze, including, but not Iimited to, such services as management fees, cleaning sweeping, lighting, heating, repairing, repiacing, inswing and policing. (3) Service charges means the costs and expenses to be incurred or inctured by the city in the operation and maintenance of Town Square, which costs and expenses may be collected against benefited property in a manner and amounts as deternuned by the city and as provided herein. (a) The council of the City of Saint Paul, having the power to operate and maintain public azeas defined in section 66.01(1), may charge and collect all or part of the service charges incurred therefor pursuant to this chapter. (b) The council each year shall estimate the services and the costs necessary to operate and maintain Town Squaze under this chapter and the chazges to be levied against benefited property as provided herein. After these estimates have been made the city councii shall fix a date for public hearing, and the city clerk shall cause to be published notice of such hearing in a legal newspaper at least twice no less than one (1) week prior to such public hearing. Not less than ten (10) days before the hearing, notice thereof shall aiso be mailed to the owner of each parcel within the area proposed to be charged, but failure to give mailed notice or any defects in the notice shall not invalidate the proceedings. For the purpose of giving mailed notice, owners shall be those shown to be such on the records of the county auditor or county tax statements, but other appropriate records may be used for this purpose. The notice shall state the date, time and place of such hearing, the particular services to be performed, and the estimate of the costs and expenses of such services to be charged against benefited property. (c) At such heazing the council shall hear property owners with reference to the scope and desirability of the proposed services and the method of collection for such services. (Ord. Any annual service charge levied or imposed under this chapter shall be placed or distributed against property if the city reasonably deems such property has benefited, under Article X, Section 1 of the Minnesota State Constiturion, by the continued clean 10-27 and safe operation and maintenance of Town Square; shall be payable in one (1) single installment but collected in two (2) payments in the same manner as real property taxes; and shall be payable when due notwithstanding any appeal as provided in section 66.05, except that in the event an appealing party is successful on appeal the city shall reimburse the appealing party by the amount reduced or eliminated. With these exceptions, service charges shall be collected using the procedures set forth in Minnesota Statutes, Sections 429.061 and 429.071 and shall be remitted in their entirety, including any interest, directly to the city. In the case of property owned, occupied and used by the church for worship or religious education or hospital care, the city shall determine the amount of service charges to be charged or assessed thereon as all other property is being chazged or assessed.
