thereto, and having fully considered the same; herefore, be it
RE50LVED, That the Council of the City of Saint Paul hereby orders said
improvement to be made.
RESOLVED FURTHER, That the Council hereby determines the estate required
for this improvement to be fee simple, absolute and easements as described
above; and the City officers and City Attorney are hereby authorized and
directed to take all actions necessary to acquire said real estate by purchase or
eminent domain.

changed. These changes were neccessary due to diswssions with various property owners and slight changes made in the alignment
during the final design process.

The Council of the City of Saint Paul having received the report of the Mayor upon
the above improvement, and having considered said report, hereby resolves:

That the said report and the same is hereby approved with no alternatives, and
that the estimated cost thereof is $8,000,000 to be financed by Project Funds.
That a public hearing be had on said improvement on the_26th dav of Mav. 2004
at 5:30 P.M.. in the Council Chambers of the City Hall and Court House
Building in the City of Saint Paul.
That notice of said public hearing be given to the persons and in the manner
provided by the Charter, stating the time and place of hearing, the nature of
the improvement and the total cost thereof as estimated.

PROJECT
Acquire permanent easements for right of way purposes, and temporary construction
easements necessary for the construction of Phalen Boulevard between Arcade Street
and Johnson Parkway. See the attached map showing the parcels planned for acquisition.
INITIATING ACTION
The project is being initiated by the Department of Public Works. The proposed alignment
and cross section for Phalen Boulevard are as shown in the Draft Environmenta� Impact
Study which was approved by the City Council on February 24, 1999 (CF 99-180).
This section of Phalen Boulevard wili complete the new roadway being constructed on the
City's East Side, running between I-35E and Johnson Parkway. Once finished, the
roadway will significantly enhance access to the near East Side by providing a better
connection to the regional roadway system a# I-35E, and by providing a direct route from
the Phalen Village area to I-35E north of Saint Paul's downtown.
PROPOSEDIMPROVEMENTS
Phalen Boufevard will be a two lane undivided roadway between Arcade Street and
Johnson Parkway, with a 12' wide pedestrian/bicycle path an the north side of the road.
Sanitary sewer, storm sewer, water main, and private utilities will be installed in the
roadway to serve future development adjacent to the roadway.
A storm water sedimentation pond will be constructed near the intersection of Phafen
Boulevard and Johnson Parkway.
New lantern style street lighting and landscaping will be installed along Phalen Boulevard
as has been done in previous phases of this roadway.
PROPOSED R1GHT OF WAY ACQUISITION
ft is proposed to acquire the right of way as shown on the attached map. The majority of
the parcels acquired will be partial acquisition.
The Ramsey County Regional Railroad Authority (RCRRA) has granted an easement to
the City for the construction of Phalen Boulevard in the RCRRA right of way. As a
condition of the easement, the City is required to acquire additional property as necessary
to provide adequate width for future light rail transit (LRT) in the corridor. The City will then
convey to the RCRRA this acquired property necessary for the LRT corridor.

POSITIVE BENEFITS
The construction of Phalen Boulevard is a project that has a number of interlocking
economic, social, and transportation goals. The overali purpose is to support and enhance
the Lower East Side neighborhood through which the roadway will pass. This support and
enhancement will be achieved in several ways which are considered to be the goals of the
project, including the following.
—To enhance local and regional accessibility for residents, businesses, and visitors
—To improve regional access to Phalen Corridor
—To initiate correction of deficiencies in the I-35E Corridor
—To provide access to othervvise undevelopable industrial sites
—To generate economic growth in the community
—To develop existing "brownfield" sites
ADVERSE EFFECTS
The construction of the new roadway as proposed will necessitate acquisition of right of
way. The City of Saint Paul will provide relocation payments and services to owners of
acquired properties in accordance with the Uniform Relocation Assistance and Real
Properties Acquisition Policies Act of 1970, as amended and as required under state law.
TIME SCHEDULE
The right of way acquisition will be completed in 2004. The construction oF Phalen
Boulevard between Arcade Street and Johnson Parkway will begin in the fali of 2004 or the
spring of 2005, and be completed by fall of 2005 if adequate funding for the project is
secured.
