under Preliminary Order
A public hearing having been had upon the above improvement upon due notice,
and the Council having heard all persons, objections and recommendations relative
thereto, and having fully considered the same; herefore, be it
RESOLVED, That the Council of the City of Saint Paul hereby orders said
improvement to be made.
RESOLVED FURTHER, That the Council hereby determines the estate required
for this improvement to be fee simple, absolute and easements as described
above; and the City officers and City Attorney are hereby authorized and
directed to take all actions necessary to acquire said real estate by purchase or
eminent domain.
Further Rasolved, That the Council hereby determines that the estate required
for this improvement be as described above, and that the proper City officers submit
a report to the City Council for the purpose of the Council's making an award of
damages for the interest acquired and determination of assessments, if any, against
the benefitted property.

PROJECT
Acquire permanent easements for right of way purposes, and temporary construction
easements necessary for the construction of Phalen Boulevard between Arcade Street
and Johnson Parkway. See the attached map showing the parceis planned for acquisition.
fNITIATING ACTION
The project is being initiated by the Department of Public Works. The proposed alignment
and cross section for Phalen Boulevard are as shown in the Draft Environmental Impact
Study which was approved by the City Counc+l on February 24, 1999 (CF 99-180).
This section of Phalen Boulevard will complete the new roadway being constructed on the
City's East Side, running between I-35E and Johnson Parkway. Once finished, the
roadway will significantiy enhance access to the near East Side by providing a better
connection to the regionaf roadway system at I-35E, and by providing a direct route from
the Phalen Village area to I-35E north of Saint Paul's downtown.
PROPOSED IMPROVEiVIENTS
Phalen Boulevard will be a two lane undivided roadway between Arcade Street and
Johnson Parkway, with a 12' wide pedestrian/bicycle path on the north side of the road.
Sanitary sewer, storm sewer, water main, and private utilities will be installed in the
roadway to serve future development adjacent to the roadway.
A storm water sedimentation pond will be constructed near the intersection of Phalen
Boulevard and Johnson Parkway.
New lantern style street {ighting and landscaping wi{f be installed along Phafen Bou{evard
as has been done in previous phases of this roadway.
PROPOSED RIGHT OF WAY ACQUISITION
It is proposed to acquire the right of way as shown on the attached map. The majority of
the parcels acquired wiif be partiai acquisition.
The Ramsey County Regional Railroad Authority (RCRRA) has granted an easement to
the City for the construction of Phalen Boulevard in the RCRRA right of way. As a
condition of the easement, the City is required to acquire additional property as necessary
to provide adequate width for fuiure light raif transit (LRT) in the corridor. The Ciiy will then
convey to the RCRRA this acquired property necessary for the LRT corridor.

POSITIVE BENEFITS
The construction of Phalen Boulevard is a project that has a number of interlocking
economic, social, and transportation goals. The overail purpose is to support and enhance
the Lower East Side neighborhood through which the roadway wilf pass. This suppo�t and
enhancement will be acnieved in several ways which are considered to be the goals of the
praject, including the following.
—To provide access to otherwise undeve{apable industrial sites
—To generate economic growth in the community
To develop existing "brownfield" sites
—To enhance local and regional accessibility for residents, businesses, and visitors
To improve regional access to Phalen Corridor
—To initiate correction of deficiencies in the I-35E Corridor
ADVERSE EFFECTS
The construction of the new roadway as proposed will necessitate acquisition of right ofi
way. The City of Saint Paul wili provide relocation payments and services to owners of
acquired properties in accordance with the Uniform Relocation Assistance and Real
Properties Acquisition Policies Act of 1970, as amended and as required under state law.
TIME SCHEDULE
The right of way acquisition will be completed in 2004. The construction of Phalen
Boulevard between Arcade Street and Johnson Parkway will begin in the fall of 2004 or the
spring of 2005, and be completed by fall of 2005 if adequate funding for the project is
secured.

The Council of the City of Saint Paul having received the report of the Mayor
upon the above improvement, and having considered said report, hereby resolves:

That the said report and the same is hereby approved with no alternatives, and
that the estimated cost thereof is $8,000,000 to be financed by Pzoject Funds.
That a public hearing be had on said improvement on the 24th dav of September,
2003 at 5:30 P.M., in the Council Chambers of the City Ha11 and Court House
Building in the City of Saint Paul.
That notice of said public hearing be given to the persons and in the manner
provided by the Charter, stating the time and place of hearing, the nature of
the improvement and the total cost thereof as estimated.
