above improvement, due notice thereof having been given as prescribed by the City
Charter; and
WHEREAS, The Council has heard all persons, objections and recommendations
pertaining to said proposed improvement and has fully considered the same; now,
therefore, be it
RESOLVED, That the Council of the City of Saint Paul does hereby order that the
above-described improvement be made, and the proper City officers are hereby directed
and authorized to proceed with the improvement; and be it
FURTI-IER RESOLVED, That upon the completion of said improvement, the proper City
officers shall calculate all expenses incurred therein and shall report the same to

PROJECT
Improve Fillmore Avenue between Wabasha Street and Livingston Avenue, by
reconstructing a new bituminous surfaced street with concrete curb and gutter, sidewalks,
concrete driveway aprons and outwalks, boulevards landscaped with sod and trees, and a
new lantern style street lighting system. In addition, sanitary sewer, storm sewer, and water
services will be instailed if requested by adjacent property owners.
Acquire right of way and temporary easements necessary to construct said improvements.
PROJECT BACKGROUND
it is proposed to construct Fillmore in accordance with the West Side Flats Master Plan .
which was adopted by the City Council on December 19, 2001. The development
agreement for the US Bank site requires that the City complete the connection of Fillmore
between Wabasha and Livingston by the end of 2003. Completion of the connection
requires that a railroad grade crossing be established on Fillmore Avenue at the Union
Pacific Railroad crossing located 425' east of Wabasha Street. The City has offered to
fund the construction necessary to compiete the establishment of the crossing including
warning signals, gate arms, circuitry and crossing surface materials. The Union Pacific
Railroad has not agreed to the establishment of the crossing. The City has filed a petition
with the Commissioner of Transportation for establishment of the crossing.
RIGHT OF WAY
The existing right of way is be 60' wide. and located as per the West Side Flats Master
Plan. It is proposed to widen the right of way by 10 feet to the south to create a 70' wide
right of way for the entire length of Fillmore Avenue as shown on the attached map. From
Wabasha Street through the Union Pacific tracks, the right of way will be acquired.
Between the tracks and Livingston, the right of way will be dedicated to the City by JLT
Group as per the development agreement between the St. Paul HRA and the JLT Group.
EXISTING CONDITIONS
Fillmore Avenue is a paved street centered on a 60 ft. right-of-way, with intermittent
sidewalks. The existing street lighting is old-style davit arm fixtures. There are concrete
barriers blocking the intersection of Fillmore Avenue and the Union Pacific Railroad, (near
Starkey Street). Fillmore Avenue between Livingston Avenue and Robert Street has been
re-buiit with a 70 ft. right-of-way in conjunction with the recent West Side Flats/U.S. Bank

development
PROPOSEDIMPROVEMENTS
Between Livingston and Starkey, the new roadway will be 38 feet wide with parking
allowed on both sides. Between Starkey and Wabasha, the roadway will be constructed to
48' wide to provide for turning movements and to provide capacity for projected traffic at
the Fiilmore/Wabasha intersection. It is also proposed to remove the concrete barriers at
the Union Pacific Railroad and establish a signalized at-grade railroad crossing. The
connection of Starkey Street to Filimore from the north will be closed due to safety and
operational problems caused by having an intersection in close proximity to the railroad
crossing. The new roadway will be a bituminous surfaced street with concrete curb and
gutter, concrete driveway aprons and outwalks, boulevards landscaped with sod and trees,
and a new lantern style street lighting system. A new traffic signal will be constructed at the
Fillmore/Wabasha Intersection.
POSITIVE BENEFITS
Improvements to Fillmore Avenue will accommodate the proposed at-grade railroad
crossing, which will mitigate trafEic impacts resulting fram the US Bank development and
future development of the West Side Flats.
ADVERSE EFFECTS
The increased width of the street will require the City to purchase additional right-of-way.
There will also be the normal problems associated with construction such as noise, dust,
temporary reduced access to the neighborhood and general disruption will be present.
EFFECTS ON TREES
Some trees wili be removed due to the widening of the right-of-way and the roadway.
However, new trees will be planted as part of the boulevard restoration.
TIME SCHEDULE
It is anticipated that the construction will be completed in summer of 2004. The schedule is
dependent on the ruling of the Commissioner of Transportation in regard to establishment
of the railroad crossing.

The CIB funds have been requested as part of the 2004-2005 CIB Process.
The proposed assessment is $28.35 per assessable foot for street reconstruction and
$5.00 per assessable foot for lantern style street lighting fro total of $33.35 per assessable
foot.
In addition to the above listed costs, storm sewer, sanitary sewer and water services will
be installed if requested by adjoining property owners. 100% of cost of services will be
assessed to benefitting property owner.

That a public hearing be hac? on said improvement on the 4th dav of June. 2003,
at 5:30 o'clock P.M.. in the Council Chambers of the City Hall and Court House
Building in the City of Saint Paul.

provided by the Charter, stating the time and place of hearing, the nature of

PAYMENT When the construction, which will begin some rime after approval of the project, has
INFORMATION been comp2eted or substantially completed, you will be notified of another public
hearing, which will occur either in the same year as the construction or the year
following the construction. This public hearing is called "RATIF'ICATION OF
ASSESSMENTS", at which tune the City Council will consider the approval of the
assessments for the project.
You will receive more information at the Time of the Ratification of Assessments public
hearing concerning the number of years the assessment will run and the interest rate.
A few days after the ratification of assessments, you will receive an invoice. You will
then have the opportunity to pay all or part of your assessment within 30 days without
interest. Any remaining balances will be collected with your property taxes over a
eriod of 1 t 20 eazs. Partial payments of $40.00 or more will be accepted at any time.
DEF'ERRED Persons 65 and older or retired by viriue of a permanent and total disability may qualify
PAYMENTS for deferred payment of special assessments. If it would be a hardship and you
homestead the property, you may apply for deferred payment following approval of the
Ratification of Assessments by the City Council.
This plan will defer payment, it will not forgive the payment. During the deferral period
interest will continue to accrue.

CONNECTIONS If the project is for a storm sewer and / or street paving, you may request new
connections for storm sewer, sanitary sewer or water main. As instatlation at a later date
will be more expensive, we suggest you consider installation of these connections at this
time for vacant properties.
Also, if you have a connection that is faulty, broken or deteriorated, you may have it
repaired during conshuction of the project. The Public Works Departrnent will notify
you if your connection needs repair.
New connections and repaired connections will be assessed.

PROPOSED STREET PAVING AND LIGHTING IMPROVEMENT:
A street improvement project has been proposed for FILLMORE AVENLTE from Wabasha Street to
Livingston Avenue. This would include new bituminous surfaced street with concrete curbs and gutters,
sidewalks, concrete driveway aprons and outwalks, boulevard sodding, tree planting, construction of a
lantern style sTreet lighting system, and doing all other work necessary to complete said project. Also, the
conshuction ofand/or repair ofsanitary sewer, storm sewer, and/orwater service connections, ifrequested
by the property owner, in conjunction with the previously mentioned work.
If the City Council approves this project, a portion of the total construction costs will be assessed against

You may request new connections and/or the repair of sanitary sewer, storm sewer or water service
connections. If you own vacant property, we suggest that you consider requesting connections at this
time. If you have experienced a problem with your sewer line, now would be a good time to
repair/replace that service. Ifyou have not experienced problems with your sewer service but your home
is over 50 yeazs old, you might want to consider televising your service (sewer inspection contractors can
be found in the yellow pages). If a problem is found, it could be repaired in conjunction with the street
paving project. Generally, any sewer service or water service work done in conjunction with a street
paving project is more economical because there are no addilional street removal and restoration costs.
Also, to ensure an effective sewer separation program and comply with state and federal mandates, all
zainleaders(downspouts) must be disconnected from the sanitary sewer. Far more information on your
