RESOLVED FURTHER, That the Council hereby determines the estate required for this improvement to be fee
simple, absolute and easements as described above; and the City officers and City Attorney are hereby authorized and directed
to take all actions necessary to acquire said real estate by purchase or eminent domain.
FurtherResolved, That the Council hereby determines that the estate required for this improvement be as described
above, and that the proper City officers submit a report to the City Council for the purpose of the Council's making an award

PROJECT:
Acquire right of way and easements necessary for the construction of storm sewer and
stormwater drainage facilities for Phalen Boulevard between Mississippi Street and Payne
Avenue.
I1vITIATING ACTION:
The project is being initiated by the Department of Public Works. A separate Final Order for
acquisition of Right of Way for the Phalen Boulevard Roadway improvements was approved by
the City Council on May 23, 2001.
PROPOSED IMPROVEMENTS
Phalen Boulevazd will be a four-lane divided roadway between Mississippi Street and Payne
Avenue, with a 12' wide pedestrian/bicyciist trail on the north side of the road. The section of
Pennsylvania between Mississippi Street and Olive Street will be widened and reconstructed.
The roadway will continue east of Olive Street and bridge over the Burlington Northem Santa Fe
and Union Pacific Railroads with the bridge ending near Westminster Street. Phalen Boulevard
continues east of Westminster, paralleling the Union Pacific Railroad tracks. East of Edgerton
Street, the roadway tums northeast to connect to Payne Avenue. A new signalized at grade
intersection will be constructed at Payne Avenue.
A storm sewer system will be constructed in the Phalen Boulevazd roadway to provide for the
drainage from the roadway and the adjacent Westminster Junction Business Park which will be
developed by the St. Paul Port Authority. The storm sewer outlet will cross the Union Pacific
Railroad to Bush Avenue and oudet into a stormwater retention pond to be constructed at the
southwest comer of Bush Avenue and DeSoto Street. The pond will then outlet into an existing
storm sewer which connects to the Troutbrook storm sewer, which discharges into the
Mississippi River. Minnesota Pollution Control Agency regulations require that a sediment
retention storm water pond be constructed for this type of project. It will be necessary to acquire
private property to construct the pond.
PROPOSED RIGHT OF WAY ACQUISITION:
It is proposed that the City acquire the right of way needed for the storm sewer and storm water
ponding as shown on the attached map.
POSITIVE BENEFITS:
ConstrucUon of the pond will improve water quality. The silt and sand from the storm water
runoff from Phalen Boulevazd, the Westminster Junction Business Park and the neighborhood
along Bush Avenue wili be contained in the stormwater pond, therefore improving the guality of

the storm water discharged into Mississippi River.
ADVERSE EFFECTS:
The construction of the ponding azea will necessitate acquisition of right of way. 'I'he City of
Saint Paul will provide relocauon payments and services to owners of acquired properties in
accordance with the Uniform Relocation Assistance and Real Properties Acquisition Policies Act
of 1970, as amended and as required under state law.
TIlVIE SCHEDULE:
The construction of Phalen Blvd between Mississippi Street and Payne Avenue will begin in
early 2002 and be completed by fall of 2003. The right of way acguisition will be completed in
2001.

RESOLVED, That the Council of the CiTy of Saint Paul hereby orders said improvement to be made.
RESOLVED FURTHER, That the Council hereby determines the estate required for this improvement to be fee
simple, absolute and easements as described above; and the City officers and City Attorney are hereby authorized and directed
to take all actions necessary to acquire said real estate by purchase or eminent domain.
FurtherResolved, That the Council hereby determines that the estate required for this improvement be as described
above, and that the proper City officers submit a report to the City Council for the purpose of the Council's making an award

Right of Way Acquisition

PROJECT:
Acquire right of way and easements necessary for the construction of storm sewer and
stormwater drainage facilities for Phalen Boulevard between Mississippi Street and Payne
Avenue.
I1vITIATING ACTION:
The project is being initiated by the Department of Public Works. A separate Final Order for
acquisition of Right of Way for the Phalen Boulevard Roadway improvements was approved by
the City Council on May 23, 2001.
PROPOSED IMPROVEMENTS
Phalen Boulevazd will be a four-lane divided roadway between Mississippi Street and Payne
Avenue, with a 12' wide pedestrian/bicyciist trail on the north side of the road. The section of
Pennsylvania between Mississippi Street and Olive Street will be widened and reconstructed.
The roadway will continue east of Olive Street and bridge over the Burlington Northem Santa Fe
and Union Pacific Railroads with the bridge ending near Westminster Street. Phalen Boulevard
continues east of Westminster, paralleling the Union Pacific Railroad tracks. East of Edgerton
Street, the roadway tums northeast to connect to Payne Avenue. A new signalized at grade
intersection will be constructed at Payne Avenue.
A storm sewer system will be constructed in the Phalen Boulevazd roadway to provide for the
drainage from the roadway and the adjacent Westminster Junction Business Park which will be
developed by the St. Paul Port Authority. The storm sewer outlet will cross the Union Pacific
Railroad to Bush Avenue and oudet into a stormwater retention pond to be constructed at the
southwest comer of Bush Avenue and DeSoto Street. The pond will then outlet into an existing
storm sewer which connects to the Troutbrook storm sewer, which discharges into the
Mississippi River. Minnesota Pollution Control Agency regulations require that a sediment
retention storm water pond be constructed for this type of project. It will be necessary to acquire
private property to construct the pond.
PROPOSED RIGHT OF WAY ACQUISITION:
It is proposed that the City acquire the right of way needed for the storm sewer and storm water
ponding as shown on the attached map.
POSITIVE BENEFITS:
ConstrucUon of the pond will improve water quality. The silt and sand from the storm water
runoff from Phalen Boulevazd, the Westminster Junction Business Park and the neighborhood
along Bush Avenue wili be contained in the stormwater pond, therefore improving the guality of

the storm water discharged into Mississippi River.
ADVERSE EFFECTS:
The construction of the ponding azea will necessitate acquisition of right of way. 'I'he City of
Saint Paul will provide relocauon payments and services to owners of acquired properties in
accordance with the Uniform Relocation Assistance and Real Properties Acquisition Policies Act
of 1970, as amended and as required under state law.
TIlVIE SCHEDULE:
The construction of Phalen Blvd between Mississippi Street and Payne Avenue will begin in
early 2002 and be completed by fall of 2003. The right of way acguisition will be completed in
2001.
