FURTHER RESOLVED, That the Council hereby determines that the estate
required for this improvement be as described above, and that the proper City
officers submit a report to the City Council for the purpose of the Council's
making an award of damages for the interest acquired and determination of
assessments, if any, against the benefitted property.

As part of the process to complete the separation of sanitary and storm sewer systems in the City, it
will be necessary to install a new sewer line near Kenny and Desoto. The proposed easement is for thi
project.

New sewer can be constructed as planned, further separating the City's sewer system.
ISADVANI'AGES IF APPROVED:
Owner of affected property would have an encumbrance on their property. Also, the City will
be obligated to pay compensation to the property owner for the takiug of the easement.

Sewer could not be built as planned. Another location would have to be found for it.

Building in the City of Saint Paul.
That notice of said public hearing be given to the persons and in the manner
provided by the Charter, stating the time and place of hearing, the nature of
the improvement and the total cost thereof as estimated.

=n the Matter of condemning and taking a perpetual easement for sewer purposes in connection with the
Railroad Island Area Improvement Project, near Kenny Road and Desoto Street, described as follows:
A 6.000 meter (19.685 foot) wide permanent sewer easement over, under and across those parts of Lots 7,
8 and 9, Block 4, Brunson's Addition to the Town of St. Paul in the County of Ramsey and Territory of
Minnesota, the centerline of said easement being desctibed as follows:
Commencing at the southwest corner of said Biock 4; thence north along the west line of said
Block 4, a distance of 18.600 meters (61.023 feet) to the point of beginning; thence
southeasteriy 31.5 meters (103346 feet) more or less to a point on the south line of said
Block 4 and there tenminating, said point of ternunation being 25.500 meters (83.661 feet)
east of the southwest corner of said Block 4. The sade easement lines are prolonged or
shortened to temunate on the west and south lines of said Block 4.
The Council of the City of Saint Paul having received the report of the Mayor
upon the above improvement, and having considered said report, hereby resolves:

That the said report and the same is hereby approved with no alternatives, and
that the estimated cost thereof is $3,500 financed by Sewer Repair Funds.
That a public hearing be had on said improvement on the 22nd day of July, 1998,
at 5:30 o'clock P.M., in the Council Chambers of the City Hall and Court House
Building in the City of Saint Paul.
That notice of said public hearing be given to the persons and in the manner
provided by the Charter, stating the time and place of hearing, the nature of
the improvement and the total cost thereof as estimated.
