The Council of the City of Saint Paul has conducted a public hearing upon the
above improvement, due notice thereof having been given as prescribed by the City
Charter; and
WHEREAS, The Council has heard all persons, objections and recommendations
pertaining to said proposed improvement and has fully considered the same; now,
therefore, be it
RESOLVED, That the Council of the City of Saint Paul does hereby order that the
above-described improvement be made, and the proper City officers are hereby directed
and authorized to proceed with the improvement; and be it
FURTHER RESOLVED, That upon the completion of said improvement, the proper City
officers shall calculate all expenses incurred therein and shall report the same to
the City Council in accordance with Chapter 14 of the City Charter.

The City of St. PauV has entered into a purchase agreement with Jerry's Enterprises for the purchase and redeveiopment of
the Phalen Shopping Center Site, which will implement major parts of the Small Area Plan. As part of the agreement, the City
wili construct public improvements on the site. These improvements are included in the proposed 1998/1999 Capital
Improverr�nt Budget.

Public Hearing -
PROJECT:
Construct public improvements in the Phalen Village Area. Public improvements to include
construction of sanitary sewer, storm sewer, water main, concrete curb and gutter, a new
bituminous surFaced roadways, concrete driveway aprons, sidewalks, boulevard sodding, tree
planting, sueet lighting, traffic signal, wetlands and water and sewer service connections.
Also, obtain the right-of-way and easements necessary for this project.
INTTIATING ACTION:
Por the past several years, the area around the Phalen Shopping Center has been the subject of the
development of the Phalen Village Small Area Plan, which has been approved by the City Council.
A major component of the Phalen Village Small Area Plan is the realignment of Prosperity
Avenue between Johnson Parkway and Maryland Avenue. In 1995, the first phase was
completed, the construction of a realigned Prosperity Avenue between Rose Avenue and
Maryland.
In June of 1997, the City of St. Paul and Jerry's Enterprises finalized a purchase agreement for the
Phalen Center Shopping Center site. As part of the redevelopment of the site, the City agreed to
construct the remainder of a realigned Prosperity Avenue between Johnson Parkway and Rose
Avenue. The City also agreed to construct a wetland on part of the site as shown on the attached
drawing.
The Prosperity Avenue and the Phalen Wet]and Construction are inc3uded in the proposed 1998
Capital Improvement Program Budget.
EXISTIlVG CONDITIONS:
The realigned Prosperity Avenue will go chrough the Phalen Center parking lot. The section of
Johnson Pazkway which will be reconstructed is a paved street with bent straw style street
lighting. The e�cisting Prosperity Avenue/Johnson Pazkway intersection is a channelized
intersection with a number of naffic islands, which promote high speed turning movements. The
existing railroad bridge over Johnson Parkway restricts the width of Johnson Pazkway and also
reduces sight distance for vehicles turning onto Johnson Pazkway from Prosperity and Magnolia
Lane.
PROPOSED IMPROVEIl4ENTS:
Prosperity will be aligned to match the new Prosperity nonh of Rose Avenue and will match into
3ohnson Pazkway where the proposed Phalen Boulevard intersects with Johnson Parkway.

Prosperity Avenue will include a median, one traffic lane in each direction, bike lanes, and parking
lanes, sidewalk, and boulevard trees. The desib will facilitate the projected traffic for the area. If
and when Phalen Boulevard is constructed, and if traffic volume warrants, it is possible to ban
parldng and institute an additional traffic lane on the roadway. In accordance with the City
Lighting Policy, which requires bent straw lighting for a street wider than 52 ; a bent straw
lighting system is proposed for Prosperity Avenue. The Johnson Parkway/Prosperity intersecrion
wiIl be a standard intersection design, with a new naffic signaL
Johnson Pazkway from 800' south of Johnson Parkway to 600' north of 7ohnson Parkway will be
realigned and reconstructed to facilitate the Prosperity ali;nment. Johnson Parkway will be
constructed to a 36' width which will accommodate one traffic lane and a bike lane in each
direction. Johnson Parkway will be widened in the vicuuty of the Prosperity intersection to
accommodate a left tum lane. It is proposed to salva;e and reinstall the existing bent straw
lighting system on Johnson Parkway.
As result of the realignment of Prosperity Avenue, Clarence Street will be extended southeriy to
connect to new Prosperity Avenue, Geranium Avenue will be extended easterly to connect to the
Clazence Street extension, and existing Prosperity Avenue will be removed between Johnson
Parkway and Clarence Street.
Tt is proposed to remove the Burlington Northern railroad berm which is now under the
ownership of the Ramsey County Regional Railroad Authority, between Maryland and south of
Johnson Pukway. The existing bridge will be removed. It is planned to use the fill from the
berm for the Prosperity Avenue construction. The Phalen Creek Trail will be relocated as shown
in the attached drawing.
Wetlands will be constructed in the locations shown in the attached drawing. In order to
ma�cimize the wetland area, it is proposed to remove part of the Magnolia Avenue roadway
between Johnson Parkway and Barclay.
Public Works is also investigating the possibility of consaucting additionai wetiands/water
features in the area bounded by Johnson Parkway, Maryland Avenue, Clarence Street and
realigned Prosperity Avenue.
ALTERNA,TES:
To do nothing would be inconsistent with the city's commitment to fulfill the intent of the Phalen
Village Small Area Plan.
POSTTIVE BENEFTTS:
Improver[�nt of Phalen Village Area will dramatically icnprove the neighborhood.
ADVERSE EFFECTS:
Normal problems associated with construction such as noise, dust and general disruption will be
present.

EFFECTS ON TREES:
A lazge number of trees will be removed as a result of the berm removal and construction of the
wetland south of Magnolia Avenue. New trees will be planted in the berm removal area, in the
boulevards adjacent to the streets and in the wetiand areas.
TIME SCAEDULE:
The project will begin in the spring of 1998. Due to poor soils in the azea and the need to place a
large amount of fill, the work an Prosperity east of Clazence will be completed in two stages. The
fill and grading for the roadway will be completed in 1998 and the construction of the roadway,
sidewalks, and lighting will be compieted in 1999. All of the roadway work on Prosperity and
Johnson Parkway in the azea west of Clarence Street will be completed in 1998. The wetlands
will be substantially completed in 1998, with some planting to be done in 1999. Some of the
funding for the wedands has a sunset date of June 1, 1999.

Funding for the Prosperity construction is not included in the 1997-1999 Ramsey County
Transportation Improvement Program Ramsey County and the City are working in a agreement
where the City will fund the County's shaze of the construction with MSA funds, and then be
reunbursed by the County when the project is funded through the County's Capital Budget
Process. This reimbursement would take place no later than 2002. The estimated County share of
the project is �690,000.

1. That the said report and the same is hereby approved with no alternatives, and
that the estimated cost thereof is $2,974,000 financed by 1997 Municipal State
Aid $100,000., 1998 Municipal State Aid $1,060,000., 1998 Capital Improvement
Bonds $510,000., Metropolitan Council for Liveable Communities Grant $150,000 „
Tax Increment Financing $550,000., Legislative Commission on Minnesota
Resources Grant $600,000 and Assessments (Street lighting only) $4,000.

1998,at 4:30 o'clock P.M., in the Council Chambers of the City Hall and Court

PROJECT:
Construct public improvements in the Phalen Village Area. Public improvements to include
construction of sanitary sewer, storm sewer, water main, concrete curb and gutter, a new
bituminous surFaced roadways, concrete driveway aprons, sidewalks, boulevard sodding, tree
planting, sueet lighting, traffic signal, wetlands and water and sewer service connections.
Also, obtain the right-of-way and easements necessary for this project.
INTTIATING ACTION:
Por the past several years, the area around the Phalen Shopping Center has been the subject of the
development of the Phalen Village Small Area Plan, which has been approved by the City Council.
A major component of the Phalen Village Small Area Plan is the realignment of Prosperity
Avenue between Johnson Parkway and Maryland Avenue. In 1995, the first phase was
completed, the construction of a realigned Prosperity Avenue between Rose Avenue and
Maryland.
In June of 1997, the City of St. Paul and Jerry's Enterprises finalized a purchase agreement for the
Phalen Center Shopping Center site. As part of the redevelopment of the site, the City agreed to
construct the remainder of a realigned Prosperity Avenue between Johnson Parkway and Rose
Avenue. The City also agreed to construct a wetland on part of the site as shown on the attached
drawing.
The Prosperity Avenue and the Phalen Wet]and Construction are inc3uded in the proposed 1998
Capital Improvement Program Budget.
EXISTIlVG CONDITIONS:
The realigned Prosperity Avenue will go chrough the Phalen Center parking lot. The section of
Johnson Pazkway which will be reconstructed is a paved street with bent straw style street
lighting. The e�cisting Prosperity Avenue/Johnson Pazkway intersection is a channelized
intersection with a number of naffic islands, which promote high speed turning movements. The
existing railroad bridge over Johnson Parkway restricts the width of Johnson Pazkway and also
reduces sight distance for vehicles turning onto Johnson Pazkway from Prosperity and Magnolia
Lane.
PROPOSED IMPROVEIl4ENTS:
Prosperity will be aligned to match the new Prosperity nonh of Rose Avenue and will match into
3ohnson Pazkway where the proposed Phalen Boulevard intersects with Johnson Parkway.

Prosperity Avenue will include a median, one traffic lane in each direction, bike lanes, and parking
lanes, sidewalk, and boulevard trees. The desib will facilitate the projected traffic for the area. If
and when Phalen Boulevard is constructed, and if traffic volume warrants, it is possible to ban
parldng and institute an additional traffic lane on the roadway. In accordance with the City
Lighting Policy, which requires bent straw lighting for a street wider than 52 ; a bent straw
lighting system is proposed for Prosperity Avenue. The Johnson Parkway/Prosperity intersecrion
wiIl be a standard intersection design, with a new naffic signaL
Johnson Pazkway from 800' south of Johnson Parkway to 600' north of 7ohnson Parkway will be
realigned and reconstructed to facilitate the Prosperity ali;nment. Johnson Parkway will be
constructed to a 36' width which will accommodate one traffic lane and a bike lane in each
direction. Johnson Parkway will be widened in the vicuuty of the Prosperity intersection to
accommodate a left tum lane. It is proposed to salva;e and reinstall the existing bent straw
lighting system on Johnson Parkway.
As result of the realignment of Prosperity Avenue, Clarence Street will be extended southeriy to
connect to new Prosperity Avenue, Geranium Avenue will be extended easterly to connect to the
Clazence Street extension, and existing Prosperity Avenue will be removed between Johnson
Parkway and Clarence Street.
Tt is proposed to remove the Burlington Northern railroad berm which is now under the
ownership of the Ramsey County Regional Railroad Authority, between Maryland and south of
Johnson Pukway. The existing bridge will be removed. It is planned to use the fill from the
berm for the Prosperity Avenue construction. The Phalen Creek Trail will be relocated as shown
in the attached drawing.
Wetlands will be constructed in the locations shown in the attached drawing. In order to
ma�cimize the wetland area, it is proposed to remove part of the Magnolia Avenue roadway
between Johnson Parkway and Barclay.
Public Works is also investigating the possibility of consaucting additionai wetiands/water
features in the area bounded by Johnson Parkway, Maryland Avenue, Clarence Street and
realigned Prosperity Avenue.
ALTERNA,TES:
To do nothing would be inconsistent with the city's commitment to fulfill the intent of the Phalen
Village Small Area Plan.
POSTTIVE BENEFTTS:
Improver[�nt of Phalen Village Area will dramatically icnprove the neighborhood.
ADVERSE EFFECTS:
Normal problems associated with construction such as noise, dust and general disruption will be
present.

EFFECTS ON TREES:
A lazge number of trees will be removed as a result of the berm removal and construction of the
wetland south of Magnolia Avenue. New trees will be planted in the berm removal area, in the
boulevards adjacent to the streets and in the wetiand areas.
TIME SCAEDULE:
The project will begin in the spring of 1998. Due to poor soils in the azea and the need to place a
large amount of fill, the work an Prosperity east of Clazence will be completed in two stages. The
fill and grading for the roadway will be completed in 1998 and the construction of the roadway,
sidewalks, and lighting will be compieted in 1999. All of the roadway work on Prosperity and
Johnson Parkway in the azea west of Clarence Street will be completed in 1998. The wetlands
will be substantially completed in 1998, with some planting to be done in 1999. Some of the
funding for the wedands has a sunset date of June 1, 1999.

Funding for the Prosperity construction is not included in the 1997-1999 Ramsey County
Transportation Improvement Program Ramsey County and the City are working in a agreement
where the City will fund the County's shaze of the construction with MSA funds, and then be
reunbursed by the County when the project is funded through the County's Capital Budget
Process. This reimbursement would take place no later than 2002. The estimated County share of
the project is �690,000.

accommodate a left tum lane. It is proposed to salva;e and reinstall the existing bent straw
lighting system on Johnson Parkway.
As result of the realignment of Prosperity Avenue, Clarence Street will be extended southeriy to
connect to new Prosperity Avenue, Geranium Avenue will be extended easterly to connect to the
Clazence Street extension, and existing Prosperity Avenue will be removed between Johnson
Parkway and Clarence Street.
Tt is proposed to remove the Burlington Northern railroad berm which is now under the
ownership of the Ramsey County Regional Railroad Authority, between Maryland and south of
Johnson Pukway. The existing bridge will be removed. It is planned to use the fill from the
berm for the Prosperity Avenue construction. The Phalen Creek Trail will be relocated as shown
in the attached drawing.
Wetlands will be constructed in the locations shown in the attached drawing. In order to
ma�cimize the wetland area, it is proposed to remove part of the Magnolia Avenue roadway
between Johnson Parkway and Barclay.
Public Works is also investigating the possibility of consaucting additionai wetiands/water
features in the area bounded by Johnson Parkway, Maryland Avenue, Clarence Street and
realigned Prosperity Avenue.
ALTERNA,TES:
To do nothing would be inconsistent with the city's commitment to fulfill the intent of the Phalen
Village Small Area Plan.
POSTTIVE BENEFTTS:
Improver[�nt of Phalen Village Area will dramatically icnprove the neighborhood.
ADVERSE EFFECTS:
Normal problems associated with construction such as noise, dust and general disruption will be
present.

EFFECTS ON TREES:
A lazge number of trees will be removed as a result of the berm removal and construction of the
wetland south of Magnolia Avenue. New trees will be planted in the berm removal area, in the
boulevards adjacent to the streets and in the wetiand areas.
TIME SCAEDULE:
The project will begin in the spring of 1998. Due to poor soils in the azea and the need to place a
large amount of fill, the work an Prosperity east of Clazence will be completed in two stages. The
fill and grading for the roadway will be completed in 1998 and the construction of the roadway,
sidewalks, and lighting will be compieted in 1999. All of the roadway work on Prosperity and
Johnson Parkway in the azea west of Clarence Street will be completed in 1998. The wetlands
will be substantially completed in 1998, with some planting to be done in 1999. Some of the
funding for the wedands has a sunset date of June 1, 1999.

Funding for the Prosperity construction is not included in the 1997-1999 Ramsey County
Transportation Improvement Program Ramsey County and the City are working in a agreement
where the City will fund the County's shaze of the construction with MSA funds, and then be
reunbursed by the County when the project is funded through the County's Capital Budget
Process. This reimbursement would take place no later than 2002. The estimated County share of
the project is �690,000.

In the Matter of Phalen Village Public Improvements - In realigned Prosperity Avenue
from Johnson Parkway to Rose Avenue - public improvements to include construction
of sanitary sewer, storm sewer, water main, concrete curb and gutter, new bituminous
surfaced roadways, concrete driveway aprons, sidewalks, boulevard sodding, tree
planting, bent straw street lighting, traffic signal, wetlands, water/sewer service
connections and doing all other work necessary to complete said project being a part
of the Phalen Village Small Area Plan.
The Council of the City of Saint Paul having received the report of the Mayor
upon the above improvement, and having considered said report, hereby resolves:
1. That the said report and the same is hereby approved with no alternatives, and
that the estimated cost thereof is $2,974,000 financed by 1997 Municipal State
Aid $100,000., 1998 Municipal State Aid $1,060,000., 1998 Capital Improvement
Bonds $510,000., Metropolitan Council for Liveable Communities Grant $150,000 „
Tax Increment Financing $550,000., Legislative Commission on Minnesota
Resources Grant $600,000 and Assessments (Street lighting only) $4,000.

That a public hearing be had on said improvement on the 7th day of January,
1998,at 4:30 o'clock P.M., in the Council Chambers of the City Hall and Court
House Building in the City of Saint Pau1.
That notice of said public hearing be given to the persons and in the manner
provided by the Charter, stating the time and place of hearing, the nature of
the improvement and the total cost thereof as esCimated.
