WHEREAS, Citizen Service Office, Division of Code Enforcement has requested the City
Council to hold public hearings to consider the advisability and necessity of ordering the repair ox
wrecking and removal of a 907 Margazet Street (rear house) located on property hereinafter referred
to as the "Subject Property" and commonly known as 907 Margaret Street (rear house). This
property is legally described as follows, to wit:
Lot 23, Robert P. I,ewis' Sub-division of Block 106 of Lyman Dayton's Addition to
St. Paul
WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Division of Code Enforcement on or before 7uly 9, 1998, the following are
the now known interested or responsible parties for the Subject Properry: Giulio & Mary Casci,
2210 Bush Avenue, St. Paul, MN 55119-3944; Carlos E. & Kelly L. Casci, 9378 Preserve Trail,
Woodbury, MN 55125-7502; Gary H. Zielsdorf, Jr., 8420 Atlas Avenue, Inver Grove Heights,
MN 55077
WHEREAS, Division of Code Enfarcement has served in accordance with the provisions of
Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to Abate Nuisance
Building(s)" dated August 4, 1998; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Properry is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this arder informed the interested or responsible parties that they must repair or
demolish the structure located on the Subject Property by August 10, 1998; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property declazing
this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Division of Code
Enfarcement requested that the Ciry Clerk schedule public hearings before the Legislative Hearing
Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislauve Code, of the time, date, place and
purpose of the public hearings; and

WHEREAS, a hearing was held before the L.egislative Hearing Officer of the Saint Paul City
Council on Tuesday, November 17, 1998 to heaz testimony and evidence, and after receiving
testimony and evidence, made the recommendarion to approve the request to order the interested or
responsible parties to make the Subject Proper[y safe and not detrimental to the public peace, health,
safety and welfare and remove its blighting influence on the community by rehabilitating this
structure in accordance with all applicable codes and ordinances, or in the alternaCive by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitarion or demolirion of the structure to be completed within five (� days after the date
of the Council Hearing; and
R'HEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
November 25, 1998 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Properry at 907 Margaret Street (rear house):
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estnnated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition Have not been conected.
6. That Division of Code Enforcement has posted a placard on the Subject Property
which declares it to be a nuisance condition subject to demolition.
7. That this building has been rouunely monitored by the Citizen Service Offices,
Division of Code Enforcement, Vacant/Nuisance Buildings.
8. That tbe known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul Ciry Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject Property safe
and not deuimental to the public peace, health, safety and welfare and remove its blighting
lnfluence on the community by rehabilitating this structure and correcting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all applicable codes and ordinances, or in the alternative by demolishing and removing the
structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition and removal of the structure must be completed within five (� days after the date
of the Council Hearing.

2. If the above corrective action is not completed within this period of time the Citizen Service
O�ce, Division of Code Enforcement is hereby authorized to take whatever steps are
necessary to demolish and remove this structure, fIll the site and charge ffie costs incurred
against the Subject Properry pursuant to the provisions of Chapter 45 of the Saint Paul
Legislarive Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal properry or fistures of any kind which interfere with the demolition and removal
shall be removed from the properiy by the responsible parties by the end of flus time period.
If all personal properiy is not removed, it shall be considered to be abandoned and the City
of Saint Paul shall remove and dispose of such properry as provided by law.
4. It is fur[her ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul I.egislative Code.

to the then known responsible parties to eliminate this nuisance condition by conecting the

Inasmuch as this Order to Abate has not been complied with the nuisance condition remains
unabated, the community continues to suffer the blighting influence of this property. It is the
recommendation of the Division of Code Enforcement that the City Council pass a resolution
ordering the responsible parties to either repair, or demolish and remove this building in a
timely manner, and failing that, authorize the Division of Code Enforcement to proceed to
demolition and removal, and to assess the costs incurred against the real estate as a special
assessment to be collected in the same manner as taxes.

Gerry Strathman called the meeting to order at 10:02 a.m.
Summarv Abatement Order appeal for 328 Le�ngton Parkwav North.
Mohammed Shahidullah, owner, appeazed and stated he received a letter to cut the grass. When
Mr. Shahidullah went to the property, he found there was no grass except for some tall weeds in
various spots. Gerry Strathman asked could these weeds be cut down. Mr. Shahidullati
responded there is nothing to cut; he just pulled them out.
Chuck Votel reported the grass was probably spazse, however Code Enforcement received
complaints about it. Mohammed Shahidullah responded someone complained in a false manner
and he got blatned. Mr. Shahidullah feels he does not have good communication skills. When
he explains his position, he makes enemies.
Gerry Strathman stated if there aze any weeds over 8 inches tall, Mohammed Shahidullah should
get rid of them. Mr. Shahidullah stated there is nothing there to cut and he is afraid the City will
send him a bill for $400. Mr. Strathman asked Guy Willits would he be willing to go with Mr.
Shahidullah to look at the property. Mr. Willits agreed.
Gerry Strathman recommended denying the appeal, however, Guy Willits will meet with
Mohammed Shahidullah today at 11:Q0 a.m. at the property. At that time, Mr. Shahidullah will
be told what needs to be cut.
Resolution ordering the owner to remove or renair the buildin�at 907 Margaret Street
(rear housel. If the owner fails to complv with the order. Code Enforcement is ordered to
remove the buildine.
Chuck Votel reported this property is owned by Giulio and Mary Casci. There is storm damage,
but the propefty was in bad shape before the storm. The owners have signed a registration form
for the vacant buildings program acknowledging that they would like to have the City remove the
building. Removing the building will result in an assessment of over $10,000. There is a party
on record who has a bankruptcy interest in the property. This resolution would order the owner
to remove or repair the property in five days.
Gerry Strathman recommended approval.

Since then, Mr. Robinson has spoken to the appellant and gave her an extension of time to

Gerry Strathman called the meeting to order at 10:02 a.m.
Summarv Abatement Order appeal for 328 Le�ngton Parkwav North.
Mohammed Shahidullah, owner, appeazed and stated he received a letter to cut the grass. When
Mr. Shahidullah went to the property, he found there was no grass except for some tall weeds in
various spots. Gerry Strathman asked could these weeds be cut down. Mr. Shahidullati
responded there is nothing to cut; he just pulled them out.
Chuck Votel reported the grass was probably spazse, however Code Enforcement received
complaints about it. Mohammed Shahidullah responded someone complained in a false manner
and he got blatned. Mr. Shahidullah feels he does not have good communication skills. When
he explains his position, he makes enemies.
Gerry Strathman stated if there aze any weeds over 8 inches tall, Mohammed Shahidullah should
get rid of them. Mr. Shahidullah stated there is nothing there to cut and he is afraid the City will
send him a bill for $400. Mr. Strathman asked Guy Willits would he be willing to go with Mr.
Shahidullah to look at the property. Mr. Willits agreed.
Gerry Strathman recommended denying the appeal, however, Guy Willits will meet with
Mohammed Shahidullah today at 11:Q0 a.m. at the property. At that time, Mr. Shahidullah will
be told what needs to be cut.

Chuck Votel reported this property is owned by Giulio and Mary Casci. There is storm damage,
but the propefty was in bad shape before the storm. The owners have signed a registration form
for the vacant buildings program acknowledging that they would like to have the City remove the
building. Removing the building will result in an assessment of over $10,000. There is a party
on record who has a bankruptcy interest in the property. This resolution would order the owner
to remove or repair the property in five days.
Gerry Strathman recommended approval.

WHEREAS, Citizen Service Office, Division of Code Enforcement has requested the City
Council to hold public hearings to consider the advisability and necessity of ordering the repair ox
wrecking and removal of a 907 Margazet Street (rear house) located on property hereinafter referred
to as the "Subject Property" and commonly known as 907 Margaret Street (rear house). This
property is legally described as follows, to wit:
Lot 23, Robert P. I,ewis' Sub-division of Block 106 of Lyman Dayton's Addition to
St. Paul
WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Division of Code Enforcement on or before 7uly 9, 1998, the following are
the now known interested or responsible parties for the Subject Properry: Giulio & Mary Casci,
2210 Bush Avenue, St. Paul, MN 55119-3944; Carlos E. & Kelly L. Casci, 9378 Preserve Trail,
Woodbury, MN 55125-7502; Gary H. Zielsdorf, Jr., 8420 Atlas Avenue, Inver Grove Heights,

WHEREAS, Division of Code Enfarcement has served in accordance with the provisions of
Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to Abate Nuisance
Building(s)" dated August 4, 1998; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Properry is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this arder informed the interested or responsible parties that they must repair or
demolish the structure located on the Subject Property by August 10, 1998; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property declazing
this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Division of Code
Enfarcement requested that the Ciry Clerk schedule public hearings before the Legislative Hearing
Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislauve Code, of the time, date, place and
purpose of the public hearings; and

WHEREAS, a hearing was held before the L.egislative Hearing Officer of the Saint Paul City
Council on Tuesday, November 17, 1998 to heaz testimony and evidence, and after receiving
testimony and evidence, made the recommendarion to approve the request to order the interested or
responsible parties to make the Subject Proper[y safe and not detrimental to the public peace, health,
safety and welfare and remove its blighting influence on the community by rehabilitating this
structure in accordance with all applicable codes and ordinances, or in the alternaCive by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitarion or demolirion of the structure to be completed within five (� days after the date
of the Council Hearing; and
R'HEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
November 25, 1998 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Properry at 907 Margaret Street (rear house):
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estnnated to exceed
three thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition Have not been conected.
6. That Division of Code Enforcement has posted a placard on the Subject Property
which declares it to be a nuisance condition subject to demolition.
7. That this building has been rouunely monitored by the Citizen Service Offices,
Division of Code Enforcement, Vacant/Nuisance Buildings.
8. That tbe known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul Ciry Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject Property safe
and not deuimental to the public peace, health, safety and welfare and remove its blighting
lnfluence on the community by rehabilitating this structure and correcting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with
all applicable codes and ordinances, or in the alternative by demolishing and removing the
structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition and removal of the structure must be completed within five (� days after the date
of the Council Hearing.

2. If the above corrective action is not completed within this period of time the Citizen Service
O�ce, Division of Code Enforcement is hereby authorized to take whatever steps are
necessary to demolish and remove this structure, fIll the site and charge ffie costs incurred
against the Subject Properry pursuant to the provisions of Chapter 45 of the Saint Paul
Legislarive Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal properry or fistures of any kind which interfere with the demolition and removal
shall be removed from the properiy by the responsible parties by the end of flus time period.
If all personal properiy is not removed, it shall be considered to be abandoned and the City
of Saint Paul shall remove and dispose of such properry as provided by law.
4. It is fur[her ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul I.egislative Code.
