WHEREAS, The Council has heard all persons, objections and
recommendations pertaining to said proposed maintenance charge and has fully
considered the same; now, therefore, be it
RESOLVED, having adopted Council Resolution 97-599, the Council of the
City of Saint Paul does hereby order to proceed with the maintenance charge
in accordance with Chapter 429 of Minnesota State Statue.

1 Wf�REAS Town Squaze has been a special assessment district since 1981 and in January of 1997 the City
2 of Saint Paui sold the lower three levels of the four-level Town Square to Koll Real Estate 3ervices; and
3 WHEREAS the City of Saint Paul has continued with its policy of'assessing the annual operation and
4 maintenance cosu of the Town Squaze Pazk Loft to downtown properties in the amount of $321,170.00 for
5 1996-1997;and
6 WHEREAS the pazk has experienced a substantial decrease in use because Cafesjian's Cazouse] and the
7 cascading fountain have been removed from the park ]oft and the lower three levels aze transitioning from
8 retail space to office space; and
9 WHEREAS the City has ceased programming at Town Squaze Park and the pazk is no longer generating
10 rental income resulting in a virtual halt to the public gathering in the park�aiHrna benefit to downtown
ll properties;and and a corresnonding reduction in
12 WHEREAS the annuai operation and maintenance of the City's other pazks are paid for out of the City's
13 general fund; now therefore, be it
14 RESOLVED that the Rea] Estate Division discontinue the policy of assessing the 6% valuation assessment

16 RESOLVED that the 1996-1997 Town Squaze Pazk operation and maintenance charges of $318,762.00 be
l7 phased out over the next two yeazs, the special assessment for fiscal year 1997 be reduced by one-half to
18 $159,381 and again by one-half for fiscal year 1998 in which the finai special assessment wi13 be made in
19 the amount of $79,690, and that the Reai Estate Division continue administering the special assessment for
20 1997 and 1998 using the present rates.

To comply with Minnesota State Statue, Chapter 429, the attached Preliminary Order must be
published twice, no less than 20 days before the proposed scheduled public heazing on October 8,
1997. Publacation dates would be September 6 and September 13, 1997.
City Clerk's office would need the signed Preliminary Order in their office no later than Monday
August 25, 199i.

In the Matter of operating and maintaining the City-owned "Town Square"
Public Spaces located within the following streets; Cedar Street,
Seventh Street, Minnesota Street and Sixth Street.
The level of operation and maintenance of the "TOwn Square Public Spaces"
for the period of July 1, 1998 thru June 30, 1999, shall be performed in
a manner set forth in amended Council Resolution 97-599 adopted July 9, 1997.
A copy of amended Council Resolution 97-599 adopted July 9, 1997 indicating
said service charge is enclosed with this order.
The costs of operating and maintaining the "Town Square" Public Spaces
shall be assessed against the benefitted property owners of the downtown
area as designated in the Town Square Assessment Policy £ormulated by

The Council of the City of Saint Paul having adopted Council Resolution
97-599, hereby resolves:
1. That the estimated annual cost thereof is $79,690.00.
2. That a public hearing be had on said operation and maintenance charge on
the 8th dav of October, 1997, at 4:30 o'clock P M. in the Council
Chambers of the City Hall and Court House Building in the City of
Saint Paul.
3. That notice of said public hearing be given to the persons and in the
manner provided by the State Statue, stating the time and place of
hearing, the nature of the operation and maintenance charge and the
total cost thereof as estimated.
