1 WHEREAS, Department of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
3 and removal of a one and one half story wood frame single family house located on property
4 hereinafter referred to as the "Subject Property" and commonly known as 688 SHERBURNE
5 AVE . This property is legally described as follows, to wit:

9 WHEREAS, based upon the records in the Ramsey County Recorder's Office and
10 information obtained by Department of Safety and Inspections on or before March 16, 2010, the
11 following are the now known interested or responsible parties for the Subject Property:
12 Stewardship Fund Lp, Attn: Ron Lawrence, 5400 W Plano Pky Suite 200, Plano TX 75093-
13 4855; State Of MN Trust Exempt, Property Tax — Tax Forfeited Lands Section, PO Box 64097,
14 St Paul MN 55164-0097; District Council 7; and

16 WHEREAS, Department of Safety and Inspections has notified the known interested or
17 responsible parties of the "Order to Abate Nuisance Building(s)" dated June 2, 2010 as provided
18 for in Chapter 45 of the Saint Paul Legislative Code; and
19
20 WHEREAS, this order informed the then known interested or responsible parties that the
21 structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
22
23 WHEREAS, this order informed the interested or responsible parties that they must repair
24 or demolish the structure located on the Subject Property by July 6, 2010; and
25
26 WHEREAS, the enforcement officer has posted a placard on the Subject Property
27 declaring this building(s) to constitute a nuisance condition; subject to demolition; and
28
29 WHEREAS, this nuisance condition has not been corrected and Department of Safety
30 and Inspections requested that the City Clerk schedule public hearings before the Legislative
31 Hearing Officer of the City Council and the Saint Paul City Council; and
32
33 WHEREAS, the interested and responsible parties have been served notice in accordance
34 with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
35 purpose of the public hearings; and
36
37 WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
38 City Council on Tuesday, August 10, 2010 to hear testimony and evidence, and after receiving
39 testimony and evidence, made the recommendation to approve the request to order the interested

40 or responsible parties to make the Subject Property safe and not detrimental to the public peace,
41 health, safety and welfare and remove its blighting influence on the community by rehabilitating
42 this structure in accordance with all applicable codes and ordinances, or in the alternative by
4�i demolishing and removing the structure in accordance with all applicable codes and ordinances.
44 The rehabilitation or demolition of the structure to be completed within fifteen (15) days after
45 the date of the Council Hearing; and

47 WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
48 September 1, 2010 and the testimony and evidence including the action taken by the Legislative
49 Hearing Officer was considered by the Council; now therefore
50
51 BE IT RESOLVED, that based upon the testimony and evidence presented at the above
52 referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
53 Order concerning the Subject Property at 688 SHERBURNE AVE .

55 1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
56 Legislative Code, Chapter 45.

58 2. That the costs of demolition and removal of this building(s) is estimated to exceed
59 five thousand dollars ($5,000.00).

61 3. That there now exists and has existed multiple Housing or Building code
62 violations at the Subject Property.

64 4. That an Order to Abate Nuisance Building(s) was sent to the then known
65 responsible parties to correct the deficiencies or to demolish and remove the
66 building(s).

68 5. That the deficiencies causing this nuisance condition have not been corrected.

70 6. That Department of Safety and Inspections has posted a placard on the Subject
71 Property which declares it to be a nuisance condition subject to demolition.

73 7. That this building has been routinely monitored by Department of Safety and
74 Inspections, Vacant/Nuisance Buildings.

76 8. That the known interested parties and owners are as previously stated in this
77 resolution and that the notification requirernents of Chapter 45 have been fulfilled.

81 The Saint Paul City Council hereby makes the following order:

83 1. The above referenced interested or responsible parties shall make the Subject Property
84 safe and not detrimental to the public peace, health, safety and welfare and remove its
85 blighting influence on the community by rehabilitating this structure and correcting all
86 deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in
87 accordance with all applicable codes and ordinances, or in the alternative by demolishing
88 and removing the structure in accordance with all applicable codes and ordinances. The
89 rehabilitation or demolition and removal of the structure must be completed within
90 fifteen (15) days after the date of the Council Hearing.

92 2. If the above corrective action is not completed within this period of time Department of
93 Safety and Inspections is hereby authorized to take whatever steps are necessary to
94 demolish and remove this structure, fill the site and charge the costs incurred against the
95 Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
96 Code.

98 3. In the event the building is to be demolished and removed by the City of Saint Paul, all
99 personal property or fixtures of any kind which interfere with the demolition and removal
100 shall be removed from the property by the responsible parties by the end of this time
101 period. If all personal property is not removed, it shall be considered to be abandoned
102 and the City of Saint Paul shall remove and dispose of such property as provided by law.

104 4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
105 parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

On May 12, 2010, an inspection of the building was conducted, a list of deficiencies which
constitute--a-nuisance condition was develop�d and photographs were taken, An ORDER TO- - -
ABATE A NUISANCE BUILDING was posted on June 2, 2010 with a compliance date of July
6, 2010. As of this date this property remains in a condition which comprises a nuisance as
defined by the legislative code.
The Vacant Building registration fees were paid through assessment on 7/9/10.

The Vacant/Nuisance Buildings Unit, Department of the Department of Safety and
Inspections, Division of Code Enforcement, hereby declares the premises located at:
688 SHERBURNE AVE
With the following Historic Preservation information; NONE _
and legally described as follows, to wit:
Syndicate No 1 Addition Lot 3 Blk 2
to comprise a nuisance condition in violation of the Saint Paul Legislative Code, Chapter
45.02, and subject to demolition under authority of Chapter 45.11.
On Ma_y 12, 2010 a Building Deficiency Inspection Report was compiled and the following
conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at tlus time. This
building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03 and shall
not again be used for occupancy until such time as a Certificate of Compliance or a
Certificate of Occupancy has been issued. All repairs must be in accordance with
appropriate codes. Changes or additions to the electrical system, mechanical system, or
the plumbing system may necessitate updating or upgrading the systems involved.
This is a one and one half story wood frame single family house.

Exterior
1. The chimney is defective, deteriorated or in a state of disrepair. Replace all missing or
defective bricks, tuckpoint as needed to restore the chimney to a professional state of
maintenance and repair. Permit may be required.
2. The eaves and soffits are in a state of disrepair or deterioration. Repair all defects, holes,
breaks, loose or rotting boards, to a professional state of maintenance. Permit may be
required.
3. The exterior walls and/or trim of the house and/or garage has defective, peeled; flaked,
scaled or chalking paint or has unpainted wood surfaces. Scrape and repaint to effect a
sound condition in a professional manner.

defects in a professional manner to a weather-tight, water-tight and rodent-proof
condition. Permit may be required.
5. The exterior walls of the house are defective. Repair all holes, breaks, loose or rotting
siding, to a professional state of maintenance.
6. STORM DOOR(S): The storm door(s) are in disrepair; repair or replace the door(s).
7. DEFECTIVE STAIRS. Stairs are broken, defective, or in disrepair. Repair in a
professional manner.
8. The window and/or door screens are missing, defective or in a state of disrepair.
Provide proper window and door screens for all openable windows and doors. Screens
must be tight-fitting and securely fastened to the f�aimes.
9. The windows and/or storm windows are in a state of disrepair. Replace all missing or
broken window glass. Make all necessary repairs to frames, sashes, hardware and
associated trim in a professional manner. Permit may be required.
Interior
1. The joist support beams in basement show evidence of deterioration.
2. Loose/open electrical fixtures
3. Open electrical wiring
4. Mold in basement
5. Infestation of Cockroaches. Exterminate and eliminate all cockroaches throughout the
entire building. Provide this office with a copy of the extermination report from a
licensed professional Pest Control Operator, and follow their recommendations to
eradicate these pests.
6. Lack of Electricity. Immediately restore electrical service. Failure to provide proper
electrical service will result in these premises being declared Unfit for Human
Habitation and ordered vacated for lack of this basic facility. Use of candles, fuel
operated lighting or extension cord wiring is not permitted while the power is off.
7. FURNACE: Have a licensed heating contractor service and clean the furnace or boiler
and make any necessary repairs. Perform a C/O test on the heating plant. Then, send
the attached form back to the Inspector. Repair of gas fired appliances requires a permit.

8. The stairs have missing or defective handrails, Provide all interior and exterior
stairways and steps of more that three (3) risers with handrails which are grippable and
installed 34" to 38" above the nose of the stair treads.
9. The interior ceilings are defective. Repair all ceiling defects and finish in a professional
manner.
10. The interior walls are defective. Repair all wall defects and finish in a professional
manner.
11. There is evidence of a rodent infestation. Immediately exterminate and eliminate all
rodents from the entire building. Remove rodent harborages in the yard areas.

12. Smoke Detector: Lack of properly installed and operable smoke detector. Provide
functioning smoke detectors in accordance with the attached requirement, within 24
hours.
13. Lack of Water Service. Immediately restore water service. Failure to provide water
service will result in these premises being declared Unfit for Human Habitation and
ordered vacated for lack of this basic facility.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not corrected by July 6, 2010 the Department of Safety and
Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property taxes as a special assessment in

accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 375 Jackson Street, Suite 220, (651) 266-8989. This
inspection will identify specific defects, necessary repairs and legal requirements to correct this
nuisance condition. You may also be required to post a five thousand dollar ($5,000.00)
performance bond with the Department of Safety and Inspections before any permits are issued,

If this building is located in a historic district or site (noted on page 1, above, just below the
property address) then you must contact Heritage Preservation (HPC) staff to discuss your
proposal for the repairs required by this order and compliance with preservation guidelines.
Copies of the guidelines and design review application and forms are available from the
Department of Safety and Inspections web site (see letterhead) and from the HPC staff. No
permits will be issued without HPC review and approval. HPC staff also can be reached by
calling 651-266-9078.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and
any subsequent owners. The property shall not be sold, transferred or conveyed in any manner
until the Nuisance Conditions have been abated and the Certificate of Code Compliance or
Certificate of Occupancy has been issued.

to be a"nuisance condition", subject to demolition and removal by the City. This placard shall
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. The department is further required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement Officer
will notify the City Council that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.

Steve Magner stated that this property first had a Legislative Hearing on August 10. No one
appeared at that time and it was laid over two weeks. It was laid over again for two weeks on
August 24 and September 14.
Amy Spong, staff person with the Historic Preservation Commission, said she had no further
information other than to note that it's a part of the Legacy Survey and ISP areas which makes it
harder when connections can not be made.
Mr. Magner said that a work order was sent in July for tall grass and weeds. In August the
property was investigated due to a complaint of illegal occupancy but it was found to be secure
at that time.
Ms. Moermand's recommendation is for repair or removal within 15 days. She stated that she
will also brief Councilmember Carter on the issue to see if he wants to make a statement
regarding HRA acquisition.

The hearing was called to order at 10:00 a.m.

The property owner of record, Stewardship Fund LP, did not appear. No other parties of interest
appeared.
Ms. Moermond stated that continuance from August 10, 2010 was essentially to determine whether
Frogtown was interested in the property.
Ms. Moermond asked for a report from Mr. Magner.
Mr. Magner stated that the building was a one and one-half story, wood frame, single-family
dwelling on a lot of 3,920 square feet and had been vacant since June 19, 2007. The City had
boarded the building to secure it from trespass. A code compliance inspection had been done on
July 13, 2010, the vacant building registration fees in the amount of $1,100 went to assessment on
July 9, 2010, and the $5,000 performance bond had not been posted. On May 12, 2010, an
inspection of the building was done and a list of deficiencies which constitute a nuisance condition
was developed. An order to abate a nuisance building was posted on June 2, 2010 with a compliance
date of July 6, 2010. To date, the property remained in a condition which comprised a nuisance as
defined by the Legislative Code. Ramsey County Taxation estimated the market value of the land to
be approximately $12,500 and the building to be $45,400. Real estate taxes were current. Code
Enforcement estimates the cost to repair the building to be approximately $65,000 to $75,000. The
cost for demolition was estimated to be approximately $8,000 to $9,000. There had also been seven
abatement notices since 2007, and nine work orders for boarding/securing, and tall grass and weeds.
Code Enforcement recommends the building be removed within fifteen (15) days. Mr. Magner
presented photographs of the property.
Ms. Moermond stated that the taxes were current, and questioned motivation of owners in this
regard. �
Ms. Moermond asked for a quick follow up report from Ms. Spong. Ms. Spong stated that this
building was built in 1892 originally as Greek revival. It had unique features and although there was

a loss of integrity, it contributed to the neighborhood. It was located within the ISP area but was just
outside the potential Frogtown historic district. She encouraged rehab of the building and believed it
would be surveyed as part of the Legacy grant survey which was scheduled to be conducted prior to
the end of 2010. Ms. Spong had not seen any photos of the building interior.
Ms. Moermond passed files with photos for review to Ms. Spong.
Ms. Moermond opens comparative discussion between the building(s) at 667 Lafond Avenue and the
building(s) at 688 Sherburne Avenue.
Ms. Spong stipulates both properties have potential but that the building(s) at 688 Sherburne Avenue
is a better candidate for rehabilitation and preservation. There was additional discussion as to why
the estimated cost for rehabilitation was higher for Sherburne property that for the Lafond property,
given that Sherburne was in better condition. There was speculation on whether it related to the size
of the house, or if different people with different considerations made the estimate.
Ms. Moermond recommended two (2) week layover until City Council meeting to determine if HRA
wants the property since it is in an ISP area and photos reveal some integrity.
