Resolution - 04 -561 - Approving payment in the amount of $100,000 to Kathleen O'Connor and her attorney's Meshbesher & Spence, Ltd. and Sandra K. Kensy, in full settlement of their claim against the City of Saint Paul. 6. Resolution - 04 -562 - Approving payment of $100,000 to Julie Tossey and her attorney's Meshbesher & Spence, Ltd. and Sandra K. Kensy, in full settlement of their claim against the City of Saint Paul. 7. Resolution - 04 -563 - Authorizing the proper city officials to enter into a grant agreement with the Metropolitan Council for completion of Phase II of the Como Conservatory refurbishment and establishing the budget. 8. Resolution - 04 -564 - Creating a financing and spending plan for the Division of Parks and Recreation to facilitate the Saint Paul Youth Job Corps program. 9. Resolution - 04 -565 - Authorizing the reallocation of $90,000 from the Highland Picnic Area Project to Highland Park's Southwest Maintenance Facility project. 10. Resolution - 04 -566 - Amending the 2004 Capital Improvement Budget to allow for STAR funding of a Phalen Park entrance sign. 11. Resolution - 04 -567 - Accepting the contribution of a Toro Workman 3200 from MTI Distributing to be used for golf turf maintenance and thanking MTI for the contribution. 12. Resolution - 04 -568 - Accepting the transfer of a 1967 Wenger Showmobile from Ramsey County to the Division of Parks and Recreation. 13. Resolution - 04 -571 - Accepting a grant from the Minnesota Department of Public Safety and authorizing the City to enter into, and Chief William Finney to implement, a grant agreement with the Minnesota Department of Public Safety. 16. Resolution - 04 -572 - Authorizing the Police Department to enter into an agreement with Independent School District 4625 to provide the School Resource Officer Program to students in the City of Saint Paul from January 1, 2004 to December 31, 2004. 17. Resolution - 04 -573 - Amending the special fund activity in the Department of Human rights to reflect new revenues and use of fund balance to ensure that the contracted number of Equal Employment Opportunity Commission cases are completed in 2004. 18. Resolution - 04 -574 - Approving a Cultural STAR grant to the Minnesota Bicycle and Pedestrian Alliance. 19. Resolution Approving Assessment - 04 -575 - In the matter of the assessment of benefits, cost and expenses for the Seventh Place Mall operation and maintenance costs for 2003, and setting date of public hearing for July 28, 2004. Final Adoption - 04 -520 - An ordinance prohibiting smoking in bars and restaurants; creating responsibilities for proprietors; prohibiting retaliation; and providing penalties for violation. 25. Final Adoption - 04 -521 - An ordinance exempting off -sale licenses issued to hotels /motels from the calculation of the half -mile radius in the downtown business district and creating a half -mile radius around the Xcel Energy Center in which off -sale liquor establishments are prohibited. 26. Third Reading - 04 -538 - An ordinance memorializing City Council action granting the application of Headwaters Real Estate to rezone property from RM -2 (Multi - Family Residential) to OS -1 (Office Service) or TN (Traditional Neighborhood - if available) for a consulting firm office at 585 Grand Avenue, between Oakland Avenue and Dale Street. (Public hearing held April 28, 2004) 27. Second Reading - 04 -559 - An ordinance regarding the definition of an "adult bookstore" to remain in effect until such time as zoning studies have been completed and any action taken based upon the studies 28. First Reading - 04 -578 - An ordinance memorializing City Council action granting the application of Alfred & Hoyoko Yahanda to rezone property from RM -1 (Multiple - Family Residential) to B -2 (Community Business) at 1435 Cleveland Avenue North, southwest corner at Buford. (Public hearing held May 5, 2004) 29. First Reading - 04 -579 - An ordinance memorializing City Council action granting the application of Marlin Broberg to rezone property at 337 Atwater Street, between Farrington and Western, from RM -2 (Multi - family Residential) to I -1 (Industrial) to provide off - street parking and storage of equipment and supplies. (Public hearing held May 5, 2004) PUBLIC HEARINGS (public hearings will begin at 5:30 p.m.) 30. Third Reading - 04 -537 - An ordinance amending Chapter 61 of the restructured Zoning Code, setting fees to defray costs of reviewing, investigating and administering services, materials and work performed and furnished to persons making zoning applications to the City, and reducing the period for administrative appeals and appeals to the City Council. 31. Resolution - 04 -580 - Approving the establishment of the Tenth and Jackson Street Tax Increment Financing District, approving a tax increment financing plan, and approving the modification of the redevelopment plan for the North Quadrant Redevelopment Project Area. 32. Resolution 04 -581 - Approving the application of Mike Farmer, Project Manager, representing Ryan Companies US, Inc., for a sound level variance from 7:00 a.m. to 6:00 p.m. on June 7, 2004 through May 15, 2005 to allow construction of a condominium and underground parking lot at 370 Marshall Avenue. 33.
