November 20, 2002, at 5:30 p.m. in the City Council Chambers, Third Floor, City
Hall-Courthouse, 15 West Kellogg Boulevard, Saint Paul, MN, to consider the
appeal of Clear Channel Outdoor, Inc. to a decision of the Saint Paul Planning
Commission revoking a billboard repair permit issued by the Office of License,
Inspections and Environmental Protection (LIEP) for a wooden, v-shaped billboard
with two sign faces on the northwest corner of St. Clair Avenue and Ayd Mill
Road. (A third sign face, the one closest to Ayd Mill Road, is structurally separate

SECURITY CHECKPOINT INFORMATION
Stop by the information booth near the tram station on the Tunnel Level. At the
information booth, you will be asked to complete a security checkpoint access form and
show valid, government-issued photo identification, such as a driver's license. Take
your completed access form with you up two floors, to the Ticketing Level security
checkpoints. Show your approved access form to security checkpoint personnel. You
will then be screened just as if you were traveling. Access forms are only valid for the
purpose of attending a public MAC meeting at a particular date and time.
Commission Chambers are located on the Mezzanine Level overlooking the airport's
central shopping area (above Chili's Restaurant), past the main security checkpoints.
Allow yourself at least 30 minutes to park, complete the access form and get through
the security checkpoint prior to the meeting.

Brief Description of Facility:
Carl Bolander& Sons (Bolander) currently operates a demolition debris landfill with a permitted
capacity of 1,534,356 cubic yards (CY) at the location described immediately above. Bolander
proposes, in a permit application, to fill at an accelerated rate, the remaining permitted capacity
and a proposed expansion of 2,488,924 CY. Under the draft permit being noticed, the MPCA
will allow land disposal of demolition debris materials in the existing permitted area and the
expansion areas denoted Phases 1, 2, and 3.
The waste proposed for disposal involves no change from the existing permit and includes that
generated through the demolition of man-made structures and includes concrete,brick, untreated
wood, glass, pavement, rubble and plastic. The MPCA proposes to modify and reissue this
permit. If the permit is not contested and subsequently denied by the MPCA Citizens' Board or
the courts, the MPCA may issue a permit for a term up to five (5) years. If the permit issues, at
least 180 calendar days prior to the expiration of the modified permit, the permittee shall submit
a new application for the re-issuance of the expiring modified permit, if continued operation of
the Facility is desired.

NOTICE:
The Minnesota Pollution Control Agency(MPCA)has received an application for a permit to
modify the operation of the solid waste facility identified above. The applicant proposes an
expansion of the existing demolition debris landfill.
LANDFILL HISTORY
The existing permitted landfill sits on a 51 acre site in the footprint of a pre-existing sand and
gravel pit that was closed in 1980. The MPCA originally issued a permit on November 11, 1986,
for the disposal of 1,525,000 cubic yards of in-place demolition and weekly, intermediate, and
final cover. Prior to 1991, some construction(industrial)waste was received at the facility. The
MPCA re-issued the permit on November 13, 1994, for the same capacity. A minor modification
request, dated August 2001,was received and approved by the MPCA to reflect an average
bottom elevation of 126.5, and the incorporation of the existing sand banks in the southern
portion of the Facility. As part of the approval of the minor modification, the Facility's capacity
was increased slightly to 1,534,356 cubic yards.
PROPOSAL AND DRAFT PERMIT REQUIREMENTS
The Facility proposes to increase its permitted volume to 4,023,280 cubic yards and open the site
both to the facility owner and other approved demolition contractors. The draft permit treats
557,780 CY of this capacity as subject to future MPCA approval. The remainder, 3,465,500 CY
is proposed as the permitted airspace volume. Of this, approximately 951,400 CY,had been
filled by March 2002. This leaves 2,514,100 CY as available airspace for waste disposal and
cover during the life of the permit. The draft permit divides this airspace into three cells, called
Phases 1, 2, and 3 in the plans. The three Phases range in size from 6.4 acres to 9.2 acres and run
in number from north to south. Filling has already been initiated in Phases 1, 2, and 3 and will
be completed to the proposed final grades in Phase 1 first, followed by Phases 2 and Phase 3.
During filling,waste will be layered on the working face in depths ranging from one to three feet
thick for optimal compaction.
The Facility will accept only solid waste resulting from the demolition of buildings, roads, and
other man made structures. Acceptable materials include concrete, brick,bituminous concrete,
untreated wood, masonry,glass,trees, rock, and plastic building parts. Prohibited wastes
include, but are not limited to mixed municipal wastes, dead animals, food and beverage
containers, yard wastes,wastes containing free liquids, septic tank pumpings, sludge, vehicles,

tires, machinery, appliances, fertilizers; or hazardous wastes as defined by Minn. R. 7045. Other
wastes that will not be accepted at the Facility include asbestos containing materials and
construction debris including building and packaging materials from construction.
Waste will enter by truck traffic via the existing access at Dawnway Landfill and pass through a
locking entrance gate before reaching the office. Truck traffic loading will increase to an
approximate thirty to thirty-five trucks a day to sustain an increased volumetric rate. The facility
wishes to increase traffic in order to close the facility by a planned 2018.
Surface water incident to the working face during operations will drain to a temporary infiltration
pond located directly to the south. An existing groundwater monitoring network is in-place and
will be expanded to detect any Facility impacts to the groundwater. Although methane will not
likely be generated by the mostly inert waste stream, the Facility will include methane
monitoring probes placed at 500 foot intervals around the perimeter of the Facility.
The fill Phases referenced above will receive final cover as they reach final elevation. The final
cover system will consist of a two foot thick soil barrier cap. The bottom one and one-half feet
will contain common borrow, with the top six inches a MnDOT specified organic topsoil. A
vegetative cover will be established on the topsoil. The overall final drainage pattern for the
Facility will be from the higher western side down to the lower eastern side. The proposed
grades are 2% in the southwest corner, then vary from 2% to 20% across the middle of the
landfill to the eastern side. When the three permitted Phases and the one planned Phase have all
received final cover, a sedimentation basin east of the fill area will accept surface water routed
off the final cover. The water will then drain into the South St. Paul and Inver Grove Heights
storm sewers.
After review of application materials, the MPCA Commissioner has made a preliminary
determination to approve the application and issue the permit. The MPCA has developed a draft
permit. The MPCA will mail a copy of the draft permit to an interested person upon request to
the MPCA staff contact. The file with regard to this permit, including all comments received,
will be available for inspection between the hours of 8:00 a.m. and 3:00 p.m. at the MPCA's
office located at 520 Lafayette Road North, St. Paul, Minnesota, 55155. The MPCA will make
copies from this file upon request. There is a charge for copy orders greater than twenty pages.

The procedures that the MPCA will follow with regard to this permit application are set forth in
its operating and procedural rules, Minn. R. chs. 7000 and 7001. Copies of these rules are
available on www.pca.state.mn.us, at most local libraries, and by request directed to the MPCA.
The MPCA strongly recommends that interested persons review these rules.
COMMENTS SOLICITED
By this Notice, interested persons are invited to submit comments to the MPCA on the pending
application. As the application before the MPCA, involves the re-issuance and modification of

an existing permit,the MPCA invites comments any aspect of the proposed facility's design and
operation. To ensure consideration, comments must be received by the last day to submit
comments identified above, and should include the following:
A. A statement of the person's interest in the permit application or the draft permit;
B. A statement of the action the person wishes the agency to take, including specific references
to sections of the draft permit that the person believes should be changed; and
C. The reasons supporting the person's position, stated with sufficient specificity as to allow the
commissioner to investigate the merits of the person's positions.
Any submissions should display the public notice number, 02-SW-823, next to the address on the
envelope and on each page of any submitted comments, and include a return mailing address and
telephone number. The MPCA will consider all comments received during the comment period
and may modify the proposed permit based on those comments.
REQUESTS FOR PUBLIC INFORMATIONAL MEETING, CONTESTED CASE
HEARING,AND/OR MPCA BOARD CONSIDERATION
Public informational meeting. A public informational meeting is an informal meeting during
which interested persons can ask questions concerning the proposed facility. MPCA staff will be
present to provide information. If an interested person would like the MPCA to hold a public
informational meeting, the person should include all information identified above under the
section of this Notice titled "Comments Solicited" and should in addition include:
A. A statement of the reasons the person desire the agency to hold a public informational
meeting; and
B. The issues that the person would like the agency to address at the public informational
meeting.
The MPCA Commissioner will hold a public informational meeting if the MPCA Commissioner
(or the MPCA Citizens' Board) determines that a public informational meeting would help
clarify and resolve issues regarding the MPCA Commissioner's preliminary determination to
issue the permit or the terms of the draft permit. If a public informational meeting will be held,
notice will be published as required under Minn. R. 7001.0120. Comments received from the
public during the meeting will be considered by the MPCA.
Contested Case Hearing. A contested case hearing is a formal proceeding before an
administrative law judge empowered to advise the MPCA regarding issues of fact. Interested
persons may petition the MPCA to hold a contested case hearing on this proposed permit. To be
timely, a request for a contested case hearing on a permit must be received during the public
comment period established by this Notice. The rules of the MPCA establish what must be
included in a petition for a contested case hearing, and the standard that the MPCA will apply in

determining whether that petition should be granted. See Minn. R. 7000.1800 through
7000.1900. The MPCA strongly recommends that persons petitioning for a contested case
hearing review the rules before submitting a petition. If a petition for a contested case hearing is
received, the MPCA Citizens' Board will consider the issuance of the permit and whether the
petition for the contested case should be granted.
MPCA Board Consideration. Interested persons may petition the MPCA Citizens' Board to
consider this permit by asking the MPCA Commissioner to place the matter on the MPCA
Citizens' Board meeting agenda, or by asking an MPCA Citizens' Board member to request that
the MPCA Commissioner place the matter on an MPCA Citizens' Board meeting agenda. To be
timely, a petition must be served by mail at least 24 days before the meeting during which a
petition would like the matter to be considered, or by personal service or facsimile at least 21
days before the meeting. See Minn. R. 7000.0650. The MPCA Citizens' Board will consider the
matter if requested by an MPCA Citizens' Board member. Names and addresses of MPCA
Citizens' Board members are available at www.pca.state.mn.us. The MPCA Commissioner may
deny a request to place a matter on the MPCA Board meeting agenda, but must inform the
MPCA Citizens' Board members of that decision.
PERMIT ISSUANCE
If there are no requests for a public informational meeting, contested case hearing, or MPCA
board consideration, the MPCA Commissioner will make the final decision on the proposed
permit. Persons who have submitted comments during the comment period will be notified of
the MPCA Commissioner's decision.
