PURSUANT, to the authority granted by the City Council seated as the Board of the Housing
and Redevelopment Authority in Resolution No. 77-5/25-2, the proper City and HRA Officials
are directed to authorize Eminent Domain Proceedings to secure title on the following pro-
perty in North of St. Stanislaus Redevelopment Area, West Seventh District 9; and

Funds are being expended from North of St. Stans, C.D. Year V. 143 5/13 (this will
cover the additional costs for acquisition price if any, from the Commissioners Award).
Thecosts for the proceedings, filing fees, etc. will come from CD Year VI , HRA 56
Acquisition, Miscellaneous Expenses.

DOMAIN PROCEEDINGS
ACTION RE9UESTED;
Authorization to commence Eminent Domain Proceedings on Parcel 56-7 (422 Superior)
located in North of St. Stans Redevelopment Area, West Seventh District 9.
PURPOSE AND RATIONALE FOR THIS ACTION:
This structure has been inspected and determined to be infeasible for rehabilitation
(duplex). The owner is a willing seller but is at an impasse with the Authority on a
fair market cash value. In accordance with Acquisition regulations, the owner has the
opportunity to go into eminent domain and allow the Court to make a determination as
to the value.
Since fourteen structures have already been acquired in the area for the above-noted pur-
pose; and this structure is located between two new single family residences, the Authority
feels that the acquisition of this structure is essential for the final end result of all
. activities in this area.
