WHEREAS, the Trust for Public Land, Midwest Region, is assisting the City in the acquisition of the 25 acre
L,ower Phalen Creek site from the BNSF Railroad, as requested in CF 00-486, and
WHEREAS, the Trust for Public Land has and will incur certain expenses in the City's behalf during said
acquisition process, said expenses anticipated not to exceed $85,000.00
WHEREAS, reimbursement to the Trust for Public Land can be made from National Park Service grant funds
to be received by the City, to the extent that TPL expenses aze eligible grant costs, and
THEREFORE, it is ordered that the proper City officials are hereby authorized and directed to pay the Trust
for Public Land, Midwest Region, 2610 University Avenue, Suite 300, Saint Paul, Minnesota, 55114, an amount not
to exceed $85,000.00 as reimbursement for expenses incurred by the Trust for Public Land in the City's behalf, in the
Lower Phalen Creek acquisition project.

The Trust for Public Land is assisting the City and the Dayton's Bluff Community in the acquisition of a 25 acre site from
BNSF railroad in the area below the Mounds Park Bfuff, as requested by the City (CF 00-486). TPL is incurring
ain cost which the City can reimburse under its grant agreement for purchase of the property and costs related to the
acquisition.
