iEREAS, There has been presented to the Board of Aldermen,
one of the branches of the Common Council of the City of St.Paul, the
petition of Reece M. Newport the owner of all of the land and propert
abutting upon and adjoining the streets and alleys in Blocks Seven(7)
and Eight (8) in River Boulevard Add.i. ti on to St.Paul, in the City of
St.Paul, Ramsey County, Minnesota, praying for the vacation of the
streets and alleys adjacent to and surrounding said Blocks Seven (7 )
and Eight (8) viz: Bayard Avenue and Sheffer Avenue and the alleys in
said blocks , and
WHEREAS, Said petition was duly verified, and, as required
by law, sets forth the facts and reasons for such vacation, and
WHEREAS, The said Board of Aldermen deemed it expedient
that the matters in said petition referred to should be proceeded with
and ordered said petition and accompanying plat to be filed of record
in the office of the City Clerk of said city, and ordered said City
Clerk to give notices by publication in the official papers of said
city in the manner and for the time required by law; that said peti-
tion and the subject matter thereof would be heard and considered by
the Committee on Streets of said Board of Aldermen at its next meeting
to be held in the Council Chanber in the Court House and City Hall
building, in said City , on the 31st day of July, 1913, at 4 o 'clock
in the afternoon of said date, which said notice was duly published,
and
WHEREAS, Said Committee on Streets of said Board of Aldermen
did meet at the time and place above mentioned, and did then and there
hear all testimony and evidence adduced on the part of said petitioner
and all other parties interested in the matter of said proposed vaca-
tion, and did take proof of the matters averred in said petition, and ,
it appearing thAt the vacation of said streets and alleys was for the
purpose of enabling the owners of the land to replat all that tract of
land lying adjacent to the River Boulevard from St.Clair street on

the north to the junction of Cretin Avenue with the River Boulevard
on the south and to lay out a service boulevard parallel with the
River Boulevard through the nth ole length of said tract as a general
and public improvement according to a plat prepared by Paul L. Mueller,
landscape architect,as amended, which plan is on file in the office
of the City Clerk,rand being of the opinion that the prayer of said
petitioner should be
granted to the extent and upon the terms hereinafter
stated, did duly report its conclusions to said Board of Aldermen recom-
mending the adoption of an aNpropriate resolution declaring said vacation
NOW, THEREFORE, It is hereby,
RESOLVED:by the Common Council of the City of St.Paul that
the following streets and alleys be hereby vacated and discontinued as
public streets and all eys , towit: All of Bayard avenue lying between
said Blocks Seven (7) and Eight (8) from Montrose avenue to Mississippi River
Boulevard and all of Sheffer avenue lying south of said Blocks Eight(8)
from Montrose avenue to Mississippi River Boulevard, and the alleys in
said Blocks Seven(7 ) and Eight (8) between Montrose avenue and Mississi-
ppi River Boulevard, all in River Boulevard Additi on to St.Paul as shown
on the plat annexed to the petition,subject to the following conditions,
that is to say,
Such vacation is upon condition, and shall become effective
when the said Reece M. Newport, or his grantee, the owner of said
property in River Boulevard Addit ion shall lay out and dedicate to the
public a strip of land twenty feet wide off and along the east side
of said Blocks Seven(7 ) and Eight (8) River foul evard Addition to St.Paul
Minn. , necessary to make Montrose avenue one hundred (100 ) feet wide,to
conform thp said amended plan of Paul Mueller, and in add'tion

Gentlemen:-
Pursuant tc instruction of the Committee on Streets of the
Board of Aldermen, I transmit herewith proper form of resolution for the
vacation kf the streets and alleys in Blocks 7 and 8, River Boulevard
Addition, upon petition of Reece M. Newport; the compensation being fixed
at the sum of Twenty-five Dollars and the costs of the proceeding, and the
dedication to the public of a strip of land twenty feet wide along the east
side of said Blocks 7 and 8.

Gentlemen:-
The undersigned is the sole owner of Blocks seven (7)
and eight (8) , except such lots as have been sold to the City of
St .Paul and are now incorporated in River Boulevard, of River
Boulevard Addition to St.Paul, in Ramsey County, State of Ilinne-
sota,being all of the property on the line of and abutting on
the streets and alleys sought to be vacated, and, as such owner
he does respectfully petit ion your honorable body, for a resolution

The facts and reasons for asking for this vacation are
as follows: These Blocks, as now cut up by the River Boulevard
as laid through these blocks, are unsalable and should be re-
platted to conform to the present location of this Boulevard,and
the present plat,with small lots facing north and south, prevents
the land from being laid out into large lots facing the Boulevard
and from being used for the purpose for Which the location and.
the lay of the land requires. That these Blocks adjoin
land owned by the petitioner and with which he desires to replat
the same, all of which facts are shown by the accompanying plat
hereto attached and made a part of this petition.
• That no streets or alleys in or surrounding these
Blocks are opened or graded or used by the public, save and ex-
cept River Boulevard, and that the public generally and the owners

of the surrounding property would be benefited by the vacation
of the two blocks.
That the owners of that tract of land in said City of
St.Paul tying west of Cretin Avenue and between St. Clair street
on the north, and where said River Boulevard crosses Cleveland
Avenue, on the south, and incouding these blocks, are desirous
of having all plats, with small lots and frequent cross streets
intersecting River Boulevard, vacated to harmonize with a general
plan of improvement of this part of the City of St•Paul, as will
appear from the petitions of said owners presented to your honor-
able body.
Upon the above facts and reasons the undersigned does
petition for a resolution of your honorable body vacating Bayard
avenue and Sheffer avenue and the alleys in said. Blocks seven (7)
and eight (8) as above stated.
