being not less than seventeen and three-fourths inches long; that during
all said time said printer and publisher of the said "ST. PAUL REVIEW"
has printed, published and delivered,at each regular issue, more than two
hundred and forty complete copies of said newspaper to paying subscribers;
that said newspaper during said time, has never been, and is not now a dupli-
cate nor made up wholly of patents, or plates and patents and advertise-
ments, or either or any of them.
That the Publisher of said newspaper, on June 10th, 1907, filed with the
County Auditor of said Ramsey County an affidavit setting forth the facts
required by Section 5516 of the Revised Laws of 1905 of the State of Minne-
sota.
That affiant knows personally all the facts set forth in this affidavit,

WHEREAS, There was heretofore presented to the Board of Alder-
men, one of the branches of the Common Council of the City of St . Paul,
the petition of the Standard Oil Company, the owner of all the property
abutting upon and adjoining the portions of the streets hereinafter des-
cribed, praying for the vacation of all that part of Conway street be-
ginning at the westerly boundary of Commercial street and running thence
westerly to the easterly boundary line of Canal street, also that portion
of Herbert street beginning at the westerly boundary of Commercial street
and running thence westerly to the easterly boundary of Canal street, as
shown upon the plat annexed to said petition, which said petition is duly
verified as required by law and sets forth the facts and reasons for such
vacation; and
WHEREAS, Said Board deemed it expedient that the matter therein
referred to should be proceeded with, and ordered said petition and ac-
companying plat to be filed of record in the office of the City Clerk of
said City, and ordered said Clerk to give notice by publication in the
official paper of said City in the manner and for the time required by
law, that said petition and the subject matter thereof would be heard and
considered by the Committee on Streets of the Assembly at its regular
meeting to be held in the Council Chamber in the Court House in said City
on July 14, 1913, at four o' clock P. M., which said notice was duly pub-
lished and given; and
WHEREAS, Said Committee on Streets of the Assembly did meet at
the time and place above mentioned and appointed therefor, and said Com-
mittee did at said time and place hear all testimony and evidence adduced
on the part of said petitioner and all other persons interested in the
matter of said proposed vacation, and being of the opinion that the prayer
of said petition should be granted upon the terms hereinafter stated, did
duly report its conclusions to said Assembly, recommending the adoption
of an appropriate resolution declaring such vacation; now therefore , it
is hereby
RESOLVED, By the Common Council of the City of St . Paul, that
that portion of Conway street beginning at the westerly boundary of Cm-

mercial street and running thence westerly to the easterly boundary of

Canal street; also that portion of Herbert street beginning at the wester-
ly boundary of Commercial street and running thence westerly to the east-
erly boundary of Canal street, as shown upon the plat annexed to said
petition, be and the sale are hereby vacated and discontinued as public r
streets, subject, however, to the following conditions, that is to say:
Such vacation is granted upon the express condition that said
petitioner shall, before this resolution takes effect, pay into the treas-
ury of said City the sum of 7/;,-,21.-¢g, 2 0-zro 1 Dollars, in addi-
tion to the expenses of this proceeding, which is hereby fixed as the
compensation for such vacation.

The undersigned, Standard Oil Company, a corpor-
ation created under the laws of the state of Indiana, is, in connection
with the '.iorthorn Pacific Aailway Company, the o"nner of all property on
the lines of the streets and highways hereinafter described, argil hereby
petitions for the vacation of the following streets, to-wit:-

On the plat attache 5 hereto and Made a p.trt hereof the proper-
ty Jointly owned by your petitioner and said Northern Pacific Railway
Company is shown colored in violet, and the portion of streets which it
is desired to be vacated are shown colored in red. Your petitioner and
the semi No-thorn Pacific Railway Cornp<ny are the owners of all the pro-
perties on both sides of said Conway Street and said Herbert. Street west
of Commercial Street, and the said °fort er.n Pacific Railway Company con-
sents to the vacation of the portion of said streets herein describ ed.
There is not at thie tir.:e, nor has there been for a long time
past, any public use of either said Conway -`Street or Herbert Street vest
of Commercial Street for street purposes except for the business of the
Standard Oil company. The streets named are cut off fro a connection with
other streets to the :rest by large railroad yards and pronerty owned and
used exclusively by railroad companies, and there is no extension of such
streets themselves westerly beyond the westerly boundary line of said
railroad yards, and nubile travel is not now, has not been for many years,
and cannot be accommodated or benefitted by the maintenance and contin-
ued existence of such streets, and said streets cannot accommodate any

The undersigned, Standard Oil Company, a corpor-

with the Northern Pacific Railway Company, the owner of all property on
the lines of the streets and highways hereinafter described, and hereby
petitions for the vacation of the following streets, to-wit:-
All that part of Conway Street beginning at the westerly boun-
dary of Commercial Street and running thence westerly to the easterly
boundary line of Canal Street;
Also all that portion of Herbert Street beginning at the west-
erly boundary of commercial Street and running thence westerly to the
easterly boundary of Canal Street.
On the plat attached hereto and made a part hereof the proper-
ty jointly owned by your petitioner and said Northern Pacific Railway
Company is shown colored in violet, and the portion of streets which it
is desired to be vacated are shown colored in red. Your petitioner and
the said Northern Pacific Railway Company are the owners of all the pro-
perties on both sides of said Cnnway Street and said Herbert Street west
of Commercial Street, and the said Northern Pacific Railway Company con-
sents to the vacation of the portion of said streets herein described.
There is not at this time, nor has there been for a long time

of Commercial Street for street purposes except for the business of the
