men, one of the branches of the Common Council of the City of St . Paul,
the petition of Louis A. Bumgardner and others, the owners of the proper-
ty abutting upon the street hereinafter described, praying for the vaca-
tion of that part of Lookout Place lying easterly of the point of inter-
section with the east line of Arkwright street, in said City, excepting
the middle sixteen feet of said Lookout Place running east from said
easterly line of said Arkwright street the entire length of said Lookout
Place, and excepting`the extreme east twenty feet of said Lookout Place,
as shown upon the plat annexed to said petition, which said petition is
duly verified as required by law and sets forth the facts and reasons for
such vacation; and
WHEREAS, Said Board deemed it expedient that the matter therein
referred to should be proceeded with, and ordered said petition and ac-
companying plat to be filed of record in the office of the City Clerk of
said City, and ordered said Clerk to give notice by publication in the
official paper of said City in the manner and for the time required by
law, that said petition and the subject matter thereof would be heard and
considered by the Committee on Streets of said Board of Aldermen at its
regular meeting to be held in the Court House on the 15th day of Lay,

Louis A. Bumgardner, Annie S. Johnson, John A. Olander, Frank Olander

and Fva M. Merrill respectfully petition your honorable body forA vacation of
that part of Lookout Place described as follows, to-wit, All that Hart of Look-
out Place lying easterly of the point of intersection with the ast line of Ark-

wright Street in the 'ity of St. Paul, excepting the middle feet of .
said Lockout Place running, from said easterly line of said Arkwright Street the
entire length of said Lookout Place,and excepting the extreme east twenty (20)
feet of said Lookout Place. As grounds for such vacation your petitioners set N
forth for your consideration the following facts and circumstances, viz:
That your petitioners are the owners of those certain tracts or parcels
of Land lying and being in the City of St. Paul, County of Ramsey and State oft
Minnesota, described as follows, towwit: Said Louis A. Bumgardner is the owner
of Lot one (1) in Block "A" and said Annie S. Johnson is the owner of Lot eight
(8) in Block one (1) of Edmund Rices' Fourth Addition; said John A. Olander and
Frank Olander are joint owners of Lot five ( 5) in Block seven (7) and said Eva y.
M. Merrill is the owner of Lot six (6) in Block seven (7) of Edmund Rices' First
Addition to St. Paul.
That said Lot one (1) in Block "A" and said Lot eight (8) in Block one
(1) of Tdmund Rices' Fourth Addition are located on the south and north sidee,
respectively, of that part of Lookout Place herein asked to be vacated and that
said Lots five ( 5) and six (6) in Block seven (7) of Tdmund Rices' First Addition
to St. Paul abutt on the extreme easterly end of said street; that therm is no
other property along the line of the oort'ion of said street hereby sought to be
vacated or abutting thereon.
That said street ems dedicated to the public use in and by the platting
of said Tdmund Rices' Fourth Addition and that, therefore, your petitioners Louis
A. Bumgardner and Annie S. Johnson, are the owners of all that part of said street
lying easterly of the point of intersection with the east line of Arkwright Street
in- said City except such interest and easement therein as ras dedicated to the
public as aforesaid.

That the easterly end of said Lookout Place constitutes what is
popularly termed a " blind" street, terminating midway between Arkwright Street
and Clark Street, having no outlet from or means of approach to said easterly
end except over tha properties. owned by your netitionere Olander and Merrill
and that said street sought to be vacated serves no purpose except as a rear
approach to the properties of said Olander and Merrill, whose lots face on
Clark Street.
That the general public has no use whatever for said portion cf Look-
out Place and that the maintenance and care thereof is an ynnecessary burden to
the tax payers of the city; that each summer the street is overgrown with un-
sightly weeds and other obnoxious vegetation; that your petitioners, the owners
of all the property abutting on the line of said street, all now have other
adequate street approaches; that a. provision has been made, in the matter of this
proposed vacation, for a drivway or alley approach to the re ises thst would

be affected by such vacation, if granted, by leaving a stripA*eleee—f4t) feet
wide in the center of said Lookout ?lace commencing at the east side of Arkwright
3t reet length en of said Lookout Place and ending in a twenty-foot caves-
road road or "T" running the entire width of said Lookout Blace at the extreme easterly
end thereof, thus affording the aforesaid owners of property on Clark Street, your
petitioners herein, Olander and Merrill1 , ample means of ingress and egress
in the rear of their said lots. In order to accomplish this proposition and
guarantee your petitioners such right-of-way and easement, it is the desire of

your petitioners that the vacation be ordered so as not to apply to this strip,
which it is agreeable to your petitioners, is not to be vacated and shall remain
dedicated to public use.
A plat of Lookout Place is hereto attached showing the tract herein sought
to be vacated indicated thereon in blue pencil, and shoving, also, the location of
the promises owned by your petitioners.
