that said newspaper during said time, has never been, and is not now a dupli-

• C ty Auditor of said Ramsey County an affidavit setting forth the facts
required by Section 5516 of the Revised Laws of 1905 of the State of Minne-
sota.

the facts and reasons for such vacation; and
WHEREAS, Said Board deemed it expedient that the matter therein
referred to should be proceeded with, and ordered said petition and ac-
companying plat to be filed of record in the office of the City Clerk of
said City, and ordered said Clerk to give notice by publication in the
official paper of said City in the manner and for the time required by
law, that said petition and the subject matter thereof would be heard and
considered by the Committee on Streets of the Board of Aldermen at its
regular meeting to be held in the Council Chamber in the Court House on
the first day of May, 1913, at four o' clock P . ? . , which said notice was
duly published and given; and
WHEREAS, Said Committee on Streets did meet at the time and place
above mentioned, and did hear all testimony and evidence adduced on the
part of said petitioners and all other persons interested in the matter of
said vacation, and being of the opinion that the prayer of said petition
should be granted upon the terms hereinafter stated, did duly report its
conclusions to said Board of Aldermen, recommending the adoption of an
appropriate resolution declaring such vacation; now therefore, it is hereby
RESOLVED, By the Common Council of the City of St . Paul, that
the south alley, running east and west, in Block 8, Clarke' s Addition to
the City of St . Paul, from Victoria street to the west line of the alley
running north and south in said addition, as shown upon the plat annexed
to said petition, be and the same is hereby vacated and discontinued as
a public alley, subject, however, to the following conditions, that is

Such vacation is granted upon the express condition that said
petitioners shall, before this resolution takes effect, pay into the
treasury of said City the sum of libtelpy Dollar+ ( EEO) in addition to
the cost of this proceeding, which is hereby fixed as the compensation
for said vacation .

Gentlemen: —
The un. ersin ed , Assets Realization Company , a
foreigh corporation, authorized to transact business in the
State of Ninnesota, and Rose A. Edwards and J az.es F. Edwar.'ls ,
her husand , residents of St . Paul , Ramsey County , Liinnesota,
respectfully state that they are the owners of all the lands
abutting on the alley in Block 8 , of Clarke ' s Addition to
the City of St . Paul and petition that your Honorable Body
cause the south alley , runni 7 east and ,rest in Block 8, of
Clarke ' s A 'diton to the City of St . Paul , prom Victoria
Street t to the °:,rest line of alley running north ana south in
said Addition, to be vacated . The reason for such vacation
is as follows :
The undersigned, as owners of such property has
caused the salle to be surveyed and re-platted and. there Till
be two alleys in said block when re-platted and an alley ;ro-
vided for in each and every lot , that attached to this peti-
tion and made a part hereof is a plat of said Block 8, show-
ing the alley sought to be vacated .
Your petitioner further states that this letition
is filed to correct an error in the vacation proceedings of
the heretofore deecribed alley , which petit' on was filed with
the Corron Council June 14th , 1910 nd ordered vacated by
your Honorable Body , that at the tide said petition was filed,
the legal title to said property stood in I:-a ?' . Cobe instead
of the Assets Realization Cor:pany , who petitioned at that tile .
Since the vacation of this alley the Assets Realizat�i_on Company

have caused to be platted and placed on record a ne°,v plat ,
a blue print of which is hereto attached and i:ade p part
thereof , of said property, known and described as 'Valton' s
Re-arrangeoent ro .2 and that said Assets Realization Coirpahy
paid the City of St . Paul Fifty Dollars ($50 .00 ) in consider-
ation of vacating said property , together with the costs per-
taining thereto , that your petitioner Rose A. Ed.vards as
deeded Lot 5, Talton' s Re-arra.,.gen.ent 1 o .2 since said vaca-
tion proceedings and she and her husbanel now join in this pe-
t t'_on .
Your ,etit.i-oner now prays that your Honorable Body
re-vacate said alley and agrees to pay the costs necessary in
said procee-+-irgs .
