TO TIDE COMMON COUNCIL OF THE CITY OF ST.PAUL:
The petitioners, The Congregation of the Son's of Jacob,
and The Congregation of the Son' s of Moses, respectfully petition
your honorable body for the vacation of all Walsh Street in Catlin's
Addition to the city of St.Paul and state the following facts and
circumstances as grounds for their petition for such vacation.
Oh and prior to July 2, 1887, Fredrick M. Catlin, was the
owner of a certain tract of land comprising a part of the north half
of the northeast quarter of the northeast quarter of section twenty,
township twenty-nine, north range twenty-two, west of the fourth
principal meridian, situate in the county of Ramsey, state of
Minnesota and now embraced within the corporate limits of the city
of St. '_'aul and on that day duly executed a plat of said land and
therein and thereby dedicated to public use certain streets among
others a short street sixty feet in width extending from Idaho
Avenue, north to California Avenue and said street constitutes the
eastern boundary of block five and six and the west boundary of
block four in said Catlin/a Addition. Said plat was recorded ih
the office of the register of deeds of said Ramsey county on July
2S, 1887 in Book 8 of Town Plats at page 32. Embraced within the
lines of said Catlin's Addition, but constituting no part thereof,
is square one half acre tract, purchased on April 7, 1877, from
the then owners, by your petitioner, The Congregation of the Son's
of Jacob, and ever since and now is used by said Congregation as a
cemetery. Said Congregation is also the owner of all of block six
and of lot . ten :;$ x3cmear in block five, lying to the north and
east of said half acre tract, and constituting part of said ceme-
tery. The southeast corner of said half acre tract extends over
the west line of said Walsh Avenue, as platted to the fiddle of the •
said street, but said congregation at the time the said plat of
Catlin's Addition was made and filed, was the owner of said one
half acre tract, and never joined in said plat, or consented to the
dedication of any part of its property, as a part of said Walsh ' -
Avenue, and at the time the said plat was made and filed said Con-
gregation was and still is using all that part of its property, em-
braced within the lines of said Walsh Avenue as a part of its
cemetery and numerous bodies have been interred in that part of said
cemetery. Shortly after its purchase of said tract the said Con-
gregation of the Son' s of Jacob, enclosed said tract of land with a
fence but owing to an error in the location of said tract the fence
at the southeast corner thereof was projected still further into
said Walsh Avenue, to the east line thereof and the portion of said
7alsh Avenue so enclosed, by said fence, was at the time of the
execution and recording of the plat of said Catlin's Addition,
actually fused and occupied by said Congregation, as a part of its
cemetery, and numerous bodies have been interred therein. Your
petitioner the Congregation of the Son's of *Roses is the owner of
lots one and two in block five of said Catlin's Addition and said
lots and certain other adjoining property, for a number of years
have been used and now are being used by said Congregation, as a
cemetery. The said Congregation a number of years ago, also en-
closed its property with a fence, but owing to an error in locating
the east line of said lot one in block five, the said fence was ex-

tended over the east line of lot and into said Walsh Avenue and so
a x_ortion of said Walsh Avenue was and is enclosed by said fence as
a part of said cemetery and the portion so enclosed has been and is
used by said Congregation in connection with its other property and
numerous bodies have been interred in that part of said cemetery.
Attached to this petition is a surveyors plat showing the
location of all of the properties herein referred to and of said
Walsh Avenue and of the true fines of said half acre tract as it
extends into said Walsh Avenue and of the fence constructed and
