Hartin Coal Co. , intends, in case the prayer of this petition is granted , to improve its said property above described by the expenditure of thirty or forty thousand dollars in constructing railroad tracks and modern machinery and appliance's for handling and storing coal upon this property. In doing this it is necessary to run its tracks in a north and south direction parallel with Dale street and across its said property across the portions of the streets and alleys which the Council is by this petition asked to vacate , and it is also necessary in carrying out its plans to construct its build- ings and other appliances across this property adjoining such tracks and across such portions of said streets and alleys, and it desires to have vacated those portions of Ireland Street , -or- -2- Capitol avnue ,and of the alleys in said Blocks Thirteen and . Sixteen of said Addition which lie east of a line running south from the southeast corner of Lot seven (7 ) , in Block Twelve (12) . of said Addition, and upon and along theeast line of Lots Seven (7) and Twenty four (24) , in Block Thirteen (13) , and the east line of Lots Seven (7) and Twenty four (24) in Block Sixteen (16 ) , of said Addition, to the north. line of Minnehaha street and west of Dale street.
