Gentlemen: -
The undersigned petitioners, being a majority of
all the abutting property owners of that portion of Custer
Street it the City of St . fall, comprehended between the
easternly line of Starkey Street and the southernly line of

to vacate and discontinue as a public thoroughfare, hi )iway
or street all that part or rortion of that public thoroughfare
or street, known as Custer Street in said city heretofore
described, and more particularly as follows :-
All that part or portion of Custer Street, lying
and comprehended between Flock four (4) and. Block five (5)
of West St . Falil Froper, and a line extending from the
northeast corner of Lot one (1) Block five ( 5) aforesaid
to the northwest corner of Lot one (1) Block four ( 4)
aforesaid and a line extending from the most southernly
point of Lot five ( 5) Block five ( 5) aforesaid to the south-
west corner of Lot nine (9) Block four (4) aforesaid as

shown on the plat thereof on file and of record in the office
of the Register of Deeds in and for Ramsey County.
That your petitioners respectfully show that the
aforesaid street has never been used as a public thoroughfare
or street ; that the aforesaid street has never been graded,
nor does any sewer, water, etc . occupy the same, that it
contains no sidewalk; that it lies in a sort of a deep gully
or ditch which usually is filled with surface water and is
no practical use or benefit ; that it cannot , because of its
locatior, ever become a thoroughfare, street or outlet for
any purpose whatsoever; that that portion of Custer Street
lying and being north of the railways tracks has been vacated;
that the only practical use of said property would be for
the erection of warehouses or manufacturing plants; that
within ninety (90) days after the vacation of the
afo aesaid street, your petitioner Henry C. Soucheray
or his assigns will erect or commence the erection
Of a building or warehouse, the cost of which will
be not less than three thousand. (3,000) dollars
and probably five thousand (5,000) .
