consider the matter of said proposed vacation, and did then and there
hear all testimony and evidence adduced on the part of the petitioners
and all other persons interested in the matter of said proposed vaca-
tion, and did take proof of the matters averred in said petition, and
being of the opinion that the prayer of said petition should be granted
upon the terms hereinafter stated, did duly report its conclusions to
said. Board of Aldermen, recommending the adoption of an appropriate
resolution declaring such vacation; now therefore, it is hereby
RESOLVED, By the Common Council of the City of S+ . Paul, that
all that portion of the alley in Clarke ' s Subdivision of Block 32 of
Arlington Hills Addition,, lying west of the westerly lines of Lots 3
and 18 in said block; the alley in Rudolph' s Pe-arrangement of a part
of Block 123 of West St . Paul Proper; iglehart avenue between Dunlap
street and Lexingto�v�avenue; the�leys�/ Blocks 3 and 4 of D . W.
Ingersoll' s Addition to St . PauY, tS shown upon the plat annexed to
said petition, be and the same are hereby vacated and discontinued as
public alleys and public street, subject, however, to the following
conditions, that is to say :
Such vacation is upon the condition that said petitioners
shall pay into the Treasury of said City the expenses of this proceed-
ing, as compensation for such vacation .

Gentlemen:- V
The undersigned respectfully represent and show to your
Honorable Body that the City of St . Paul is the owner of all the
land and property abutting upon the alley in Clarke ' s Subdivision of
Block thirty-two (32) in Arlington Hills Addition, lying west of the
westerly lines of Lots three (3) and eighteen (is) in said block; also
of all land and property abutting upon the alley in Rudolph's Re-
arrangement of a part of Block one hundred twenty-three (123) of West
St . Paul Proper; also of all the land and property abutting upon Igle
hart street between Lexington avenue and Dunlap street , and also all
the land and property abutting upon the alleys in Blocks numbered three
(3) and four (--) in D. W. Ingersoll' s Addition to St . Paul, and your
petitioners pray for the vacation o° all that portion of said alley in
Clarke' s Subdivision of Block 35 of Arlington Hills Addition, lying
west o_" the westerly lines of Lots 5 and 18 in said block ; also for
the vacation of rthe alley in Rudolph' s Re-arrangement of a part of
Block 123 of West St . Paul Proper; also for the vacation of Ig'ehart
/40744-between Lexington avenue and Dunlap street ; and also for the
vacation of the alleys in Blocks 3 and 4 of D. 7. Ingersoll' s Addition
to St . Paull p 1-t o' each of said locations showing the streets and
alleys sought to be vacated, with their relation to surrounding 7proper-
ty, arc hereto attached and made a part of this petition.
The facts and reasons for such vacation are that 'he City of
St . Paul has acquired and owns Lots numbered four (4) to seventeen (1")
inclusive in Clarke ' s Subdivision of said Block 32, as a site for the
proposed new East Side High school building, and has acquired and owns
all of Block 123 of West St . Paul Prom, including said Rudolph' s Re-
arrangement of a portion thereof, as a site for the new Sixth Ward
High school building, and has acquired and owns all of Blocks 3 and 4
of said D . 7. Ingersoll' s Addition as a site for 'Le new proposed West
End High school 'wiling.

That said City is now ready and proposes immediately to pro-
ceed with the construction of all of said high school buildings, and
that it cannot proceed to advantage nor are the said sites suitable
for such buildin7s unless the aforesaid streets and alleys are va-
cated. That the vacation thereof will result in no appreciable in-
convenience to the citizens of said City frog:: the standpoint of travel,
and on the other hand, such vacation -..ill result greatly to the public
benefit in furnishing suitable and desirable sites for the construction
of said buildings .
=BEFORE, Your petitioners pray that said streets and alleys
may be vacated as hereinbefore set forth .
