Gentlemen:-
Pursuant to instruction of the Committee on Streets of the
Board of Aldermen, I transmit herewith proper form of resolution vacat-
ing the alley in Block 186 of Robertson's Addition to West St . Paul,
upon petition of the Fidelity Realty Company; the compensation being
fixed at Twenty-five Dollars in addition to the expense of the proceed-
ing, and the grading of Walter street from Fairfield avenue to Fillmore
avenue .

Now, therefore , it is hereby resolved by the Common
Council of the city of St. Paul, that all of the alley that runs
through the center of Block numbered one hundred eighty-six (186)
of Robertson' s Addition to West St. Paul, according to the recorded
plat thereof as shown upon the plat annexed to said petition be and
the same hereby is vacated and discontinued as a public alley
subject, however , to the following terms and conditions, that is
to say:
Such vacation is upon the express condition that said
petitioner , the Fidelity Realty 'Company, shall at its own expense,
grade Walter Street from Fairfield .venue to Fillmore Avenue in said
city of St. Paul and shall also pay into the Treasury of said city,
the sum of Twenty-five (25) Dollars in addition to the expenses of
this proceeding, which is hereby fixed as compensation to be paid
to said city in consideration of said vacation. Such grading to be
done upon a permit issued by the commissioner of public works, and a
certificate from said commissioner of the completion of aid work, shall
be satisfactory evidence of compliance with the requirements of this
resolution, in respect to said grading.
